HomeMy WebLinkAboutORD 1990-014 ORDINANCE N0. 90-14 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS AMENDING THE CODE OF ORDINANCES BY AMENDING CHAPTER 25 UTILITIES AND SERVICES, SECTION 25-97 ESTABLISHING GARBAGE RATES; PROVIDING A SEVERABILITY; DECLARING AN EMERGENCY AND PROVIDING AN ��� EFFECTIVE DATE WHEREAS, a State mandated solid waste disposal fee for all `"°°' solid waste disposed of in the State of Texas is required to be charged pursuant to Section 4B, Article 4477-7, V.T.C. S. , as added by the 71st Legislature, Regular Session, Senate Bill No. 1519, Chapter 1143 (1989) ; and WHEREAS, the City Council desires to increase the rates for collecting and removing garbage, refuse and trash and other solid waste to cover the State disposal fee by amending Chapter 25, Section 25-97 of the City Code of Ordinances, City of Grapevine, Texas; and WHEREAS, the increase in rates resulting from the State disposal fee is not considered a unit price adjustment contemplated by Section 3 of the Services Contract between the City and Laidlaw Waste Systems, Inc. because the increase is mandated by State law. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: �-� Section l . That the above premises are found to be true and correct and are incorporated into the body of this Ordinance as if fully set forth therein. �<s� Section 2 . That Chapter 25, Section 25-97 of the City Code of Ordinances, City of Grapevine, Texas, is hereby amended to read as follows: " (a) Any houses, buildings, or premises used for residential purposes, that are connected to the City' s water system and pay a minimum monthly charge for water service shall have their garbage, trash, and refuse removed at a monthly charge, where such collection and removal is not required in excess of twice each week, as follows: Single-Family Residential . . . . . . . . . $ 5 . 02 Single-Family Residential without City water service . . . . . . . . . . $ 5. 02 Duplex . . . . . . . . . . . . . . . . . . $ 10 .04 Multi-Family, per unit . . . . . . . . . . $ 5 . 02 (without dumpster container) " ,�.� Section 3 . That the effective date of the rates contained in this ordinance shall be retroactive as of January l, 1990 . �. Section 4 . Should any part, section, paragraph, sentence clause, or phrase contained in this ordinance be held to be unconstitutional, such holding shall not affect the validity of the remaining portion of the ordinance, but in all respect shall remain in full force and effect. Section 5 . The fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace, and general welfare of the public creates an emergency which requires that this ordinance become effective from and after the date of its passage, and it is accordingly so ordained.
