HomeMy WebLinkAboutORD 1989-020 ORDINANCE NO. 89-20 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, AMENDING CHAPTER 14, ARTICLE II, DIVISION 1 OF THE CODE OF ORDINANCES RELATING TO BILLIARD HALLS AND SKILL OR PLEASURE COIN-OPERATED MACHINE ESTABLISHMENTS BY AMENDING SECTION 14-20 AND , BY THE ADDITION OF A NEW SECTION NUMBERED 14-26 TO BE ENTITLED HOURS OF OPERATION; REPEALING ALL INCONSISTENT ,,;�„ ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, Section 14-20, Division 1, Articl� II, Chapter 14 of the Code or Ordinances currently limits the hours of operation of a billiard hall; and WHEREAS, the City Council concludes that the ability to enforce the hours of operation of billiard halls would be improved and simplified by making the hours of operation consistent with the hours of operation prescribed by the Texas Alcoholic Beverage Code for those billiard hall operators holding a valid mixed beverage permit. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1 . That all of the matters stated in the preamble � are true and correct and are hereby incorporated into the body of this ordinance as if fully stated therein. Section 2 . That Chapter 14 , Article II, Division 1 of the Code of Ordinances relating to billiard halls and skill or pleasure coin-operated machine establishments is hereby amended as follows: A. Section 14-20 relating to definitions is hereby amended by amending the definition of billiard hall permit in its entirety to read as follows: "Billiard hall permit. A permit issued to operate a billiard hall in accordance with the hours of operation prescribed by Section 14-26 . " B. A new Section numbered 14-26 and entitled "Hours of Operation" is hereby added which shall read as follows: "Section 14-26 . Hours of operation. (a) If the premises on which the billiard hall is operated is operating pursuant to a mixed beverage permit issued by the Texas Alcoholic Beverage Commission and is in compliance with all applicable regulations and ordinances of the City regarding alcoholic beverages, the hours of operation of the billiard hall shall be the �ame as those hours permitted under the alcoholic beverage permit issued for the premises. (b) If the premises on which the billiard hall is operated is not operating pursuant to a mixed beverage permit issued by the Texas Alcoholic Beverage Commission, or is not in compliance with all applicable regulations and ordinances of the City regarding alcoholic beverages , the hours of operation shall be between 8 : 00 a.m. to 11 : 00 p.m. Monday through Friday; 8 : 00 a.m. until 12 : 00 midnight, Saturday, and 1 : 00 p.m. to 6 : 00 p.m. on Sunday. " Section 3 . That all ordinances or parts of ordinances inconsistent or in conflict with the terms of this ordinance are hereby repealed to the extent of the inconsistency or conflict. Section 4 . If any section, article, paragraph, sentence, „� clause, phrase or word in this ordinance, or application thereto any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 5 . The fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace, and general welfare of the public creates an emergency which requires that this ordinance become effective from and after the date of its passage, and it is accordingly so ordained.
