HomeMy WebLinkAboutORD 1989-003 ORDINANCE NO. 89-03 AN ORDINANCE OF THE CITY OF GRAPEVINE, TEXAS, AMENDING THE GRAPEVINE CODE OF ORDINANCES BY AMENDING APPENDIX B, SECTION 2 , PLAT APPROVAL, SUBSECTION (B) (16) RELATING TO FINAL PLAT FEES; BY AMENDING SECTION 2, PLAT APPROVAL, SUBSECTION (C) (7) RELATING TO �^�"� RESUBDIVISION AND REPLAT FEES; PROVIDING A SEVERABILITY CLAUSE, DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE .�..� BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1 . That Appendix B, Section 2, Subsection (B) (16) of the Grapevine Code of Ordinances is hereby amended to read as follows: " (16) A filing fee for each final plat shall be payable by check drawn to the order of the city upon submission of the final plat to the city planning and zoning commission for final approval. The filing fees are as follows: Residential zoning, excluding R-MF-1 and R-MF-2 . . . $138 . 00 + $5 .00/lot Residential zoning, R-MF-1 and R-MF-2 . . . . . . $138 . 00 + $25.00/acre Commercial and Industrial zoning . . . . . . . . $138 . 00 + $25 . 00/acre " Plat corrections . . . . $138 .00" �,, � Section 2. That Appendix B, Section 2 , Subsection (C) (7} of the Grapevine Code of Ordinances is hereby amended to read as follows: " (7) The filing fees for all resubdivisions or replats are as follows: Residential zoning, excluding R-MF-1 and R-MF-2 . . . $138 . 00 + $5 . 00/lot Residential zoning, R-MF-1 and R-MF-2 . . . . . . $138 . 00 + $25. 00/acre Commercial and Industrial zoning . . . . . . . . $138 . 00 + $25 . 00/acre Plat corrections . . . . $138 . 00 A filing fee for all vacations not accompanied by a proposed replat is hereby established at ninety dollars ($90 . 00) . " Section 3. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstance is held invalid or unconstitutional ' by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such y� � remaining portions of this ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 4 . The fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace, and general welfare of the public creates an emergency which requires that this ordinance become effective from and after the date of its passage.
