HomeMy WebLinkAboutORD 1988-003 ORDINANCE NO. 88-03 AN ORDINANCE OF THE CITY OF GRAPEVINE, TEXAS, AMENDING THE CODE OF ORDINANCES, CHAPTER 25, ARTICLE II, DIVISION I WATER AND SEWERS RELATIVE TO WATER AND WASTEWATER TAP CHARGES; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF FIVE HUNDRED DOLLARS ($500 . 00) AND A �� SEPARATE OFFENSE SHALL BE DEEMED COMMITTED UPON EACH DAY DURING OR ON WHICH AN OFFENSE OCCURS OR CONTINUES; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS : Section 1 . That Chapter 25, Article II, Division I of the City Code of the City of Grapevine, Texas , relating to Water and Sewers is hereby amended in the following particulars and all other sections, subsections, paragraphs, sentences, definitions, phrases and words of said Code of Ordinances is not amended, but shall remain intact and is hereby ratified, verified and affirmed. Section 2 . That the City Code, Chapter 25, Article II, Division I, Water and Sewers, Section 25-22 relating to Water tap charges is hereby amended to read as follows: Section 25-22 . Whenever the water service line has been properly and legally installed by a real estate developer, builder or other person, and whenever the only work to be performed by the city water department is installing the connection and water meter this shall be considered a pre-made tap. " Section 3. That the City Code, Chapter 25, Article II, Division I, Water and Sewers, Section 25-24 relating to Wastewater tap charges is hereby amended to read as follows : Section 25-24 . Same--Wastewater tap charges "Whenever any potential customer desires that a wastewater line on private property be connected with the wastewater system, the City shall charge the following fees for making a wastewater tap available: (1) When the nearest wastewater line is within the � right-of-way of an asphalt or concrete street, the fee is four hundred dollars ($400 . 00) for a four-inch tap. (2) When the nearest wastewater line is within the right-of-way of a gravel or otherwise unimproved street, or if the necessary service was installed before the street was upgraded to an asphalt or concrete street, the fee is two hundred and fifty dollars ($250. 00) for a four-inch tap. (3) When the nearest wastewater line is within an unimproved utility easement adjoining the property to be served, the fee is two hundred and fifty dollars ($250 . 00) for a four-inch tap. (4) Larger than a four-inch tap to be agreed upon by contract. (5) When the wastewater line is tapped and the service is properly and legally installed by a real estate development, builder, or other person, the fee is "�'� forty dollars ($40 . 00) . " Section 4. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Five Hundred Dollars ($500 . 00) for each offense and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues . Section 5 . If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 6 . The fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace, and general welfare of the public creates an emergency which requires that this ordinance become effective from and after the date of its � passage, and it is accordingly so ordained.
