HomeMy WebLinkAboutORD 1985-018 ORDINANCE NO. 85-18 AN ORDINANCE OF THE CITY OF GRAPEVINE, TEXAS, AMENDING CHAPTER 23, SECTION 26, OF THE CITY CODE OF GRAPEVINE, TEXAS , BY SPECIFYING THE REASONABLE AND PRUDENT SPEED FOR PUBLIC STREETS AND ALLEYS WITHIN THE CITY; AUTHORIZING THE ERECTION OF TRAFFIC REGULATION SIGNS; REPEALING CONFLICTING ORDINANCES; PROVIDING A PENALTY NOT TO EXCEED THE � SUM OF TWO HUNDRED DOLLARS ($200 .00) AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED UPON EACH DAY DURING OR ON WHICH A VIOLATION OCCURS; PROVIDING A SEVERABILITY; AND DECLARING AN EMERGENCY NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section l . City Code Chapter 23, Section 26 , Speed Limits on Certain Public Streets . Upon the basis of an engineering and traffic investigation heretofore made as authorized by the provisions of Section 167 and 169 of Article XIX, V.T.C.S. , 6701d, Uniform Act Regulating Traffic on Highways, the following prima facie speed limits hereafter indicated for vehicles are hereby determined and declared to be reasonable and safe; and such speed limits are hereby fixed at the rate of speed indicated for vehicles traveling upon the named public streets and highways, or parts thereof, of the City, said speed limit to be in force and effect unless otherwise limited as prescribed by the provisions of this ordinance. The streets and highways hereby regulated, and the maximum prima facie speed limits thereof, are �"�t as fol lows : � (A) On State Highway 26 from Station 286+50 .6 (southwest city limits of Grapevine, being also the northeast city limits of Colleyville) northeasterly 2 . 149 miles to Station 400+00 (approximately 1, 100 ' southwest of State Highway 114) at 45 miles per hour. (1) School Zone - From Station 317+00 (approximately 630 ' southwest of Mustang Drive) northeasterly 0. 204 mile to Station 327+75 (approximately 445 ' northeast of Mustang Drive) at 35 miles per hour on school days from 7 : 00 a.m. to 9 :00 a.m. and from 2 : 00 p.m. to 4: 00 p.m. ; 45 miles per hour all other times. (B) On State Highway 26 from Station 400+00 northeasterly 0 . 682 mile to Station 436+00 (approximately 720 ' southwest of FM 157) at 45 miles per hour. (C) On State Highway 26 from Station 436+00 northeasterly 0. 540 mile to Station 464+50 (intersection with Spur 103 and Main Street) at 30 miles per hour. Section 2 . That the City Manager, or his agent, is hereby authorized to have speed limit signs and/or stop signs erected, constructed, and placed at such points along said highways, �,,,r streets , or alleys, or portions thereof under construction, maintenance, or repair, so that travelers will be reasonably notified of said traffic regulations. Section 3 . That all ordinances or any parts thereof in conflict with the terms of this ordinance shall be and hereby are deemed repealed and of no force or effect provided, however, that the ordinance or ordinances under which the cases currently filed and pending in the Municipal Court of the City of Grapevine, Texas , shall be deemed repealed only when all such cases filed and pending under such ordinance or ordinances have been disposed of by a final conviction or a finding not guilty of nolo contendere, or dismissal. Section 4 . Any person, firm, or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction in the Municipal Court, shall be fined in an amount not to exceed the sum of Two Hundred Dollars ($200 .00) for each offense and a separate offense shall be deemed i committed upon each day during or on which a violation occurs. Section 5. If any section, paragraph, subdivision, clause, � phrase, or provisions of this ordinance shall be judged invalid or unconstitutional, the same shall not affect the validity of this ordinance as a whole or any portion thereof other than that portion so decided to be invalid or unconstitutional. Section 6 . The fact that the traffic regulations of the City of Grapevine, Texas do not adequately regulate the traffic within the City creates an urgency and an emergency and the preservation of the public health, safety, and welfare requires that this ordinance shall take effect immediately from and after its passage and the publication of the caption of said ordinance as the law and the City Charter in such cases provides. PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS on this the 16th day of April, 1985 .
