HomeMy WebLinkAboutORD 1984-019 CITY OF GRAPEVINE, TEXAS ORDINANCE NO. 84-19 AN ORDINANCE AMENDING THE CITY CODE OF THE CITY OF GRAPEVINE, TEXAS, BY AMENDING CHAPTER 16 RELATING TO PARKS AND RECREATION BY ADDING A NEW SECTION RE- LATING TO TIME LIMITATIONS ON PUBLIC USE OF PARR PARK, TO BE CALLED SECTION 16-12; PROHIBITING PUBLIC USE OF SAID PARK BETWEEN THE HOURS OF 8:30 P.M. AND 6:30 A.M.; PROVIDING EXCEPTION; DIRECTING PLACEMENT OF SIGNS AND GATES; PROVIDING A PENALTY NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED UPON EACH DAY DURING OR ON WHICH A VIOLATION OCCURS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFEC- TNE DATE AND DECLARING AN EMERGENCY WHEREAS, the City Council is empowered to impose reasonable time limitations on public use of the parks within its corporate limits; and WHEREAS, the City Council does find and determine that due to the isolated location of Parr Park that for the greater safety and welfare of the inhabitants of the community that it is in the best interest of the citizens of the City to impose time limitations on the public use of Parr Park; and WHEREAS, the City Council finds and determines that the time restrictions on the public use of Parr Park recommended by the City staff are reasonable. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That Chapter 16 of the City Code of the City of Grapevine, Texas, relating to Parks and Recreation is hereby amended in the following particulars and all other existing Sections, Subsections, Paragraphs, Sentences, Definitions, Phrases and Words of said City Code are not amended, but shall remain intact and are hereby ratified, verified and affirmed: A. That a new section relating to time limitations on public use of Parr Park, Section 16-12, is hereby added to read as follows: Section 16-12. Time limitations on public use of Parr Park; providing exception; authorizing placement of signs and gates. (a) It shall be unlawful for any person to use, enter into or be within the area delineated as Parr Park located within the City of Grapevine, Texas, during the hours of 8:30 o'clock p.m. and 6:30 o'clock a.m., except when city-sponsored or co-sponsored events are being held. (b) The city manager is authorized and directed to place signs at appropriate locations in Parr Park to notify all persons of the prohibited hours. Such signs shall state "No Persons Allowed in Parr Park Between the Hours of 8:30 P.M. to 6:30 A.M." (c) The city manager is authorized and directed to erect a gate at the main entrance to Parr Park on Parr Lane, and is further authorized and directed to lock the gate so erected on Parr Lane and the gate located at the low water crossing adjacent to Old Mill Run Road during the hours of 8:30 o'clock p.m. and 6:30 o'clock a.m. Section 2. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction such holding shall not affect the validity of the remaining portions of the ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect: Section 3. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Hundred Dollars ($200.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 4. The fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its passage and it is accordingly so ordained.
