HomeMy WebLinkAboutORD 1983-001 CITY OF GRAPEVINE ORDINANCE NO. 83-01 AN ORDINANCE AMENDING CHAPTER 25 OF THE CITY CODE � OF TIIE CITY OF GRAPEVINE, TEXAS, BY AMENDING SECTION f ` 25-20 BY AMENDING THE DEFINITION OF CUSTOI�ZER OR I CONSUMER TO INCLUDE AN OWNER, ADDING A DEFINITION � OF DELINQUENCY; AMENDING SECTION 25-38 BY PROVIDING THAT THE CITY MAY DISCONNECT ALL CONNECTIONS IN THE CITY UPON SAID CUSTOMER BECOMING DELINQUENT; AMENDING SECTION 25-42 AND ADDING A NEW SECTION 25- 42(a) RELATING TO MINIMUM RATES FOR CUSTOMERS NOT CONNECTED TO THE CITY'S WATER SYSTEA4; PROVIDING A PENALTY; PROVIDING A SEVERABILITY CLAUSE; AND DE- CLARING AN EMERGENCY BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPE- VINE: SECTION l. That Chapter 25, Article II of the Grapevine City Code relating to water and sewers is amended in the follo�ving particulars as follows: A. Section 25.20 is amended by amending the definition of "customer or consumer" and by adding a definition of "delinquency" to read as follows: "Section 25-20. Definitions: Customer or Consumer - Any person owning, occupying or using a building, residence or other structure or premises which is tied on to the water and/or waste water system of the City." "Delinquency - A customer or consumer (which includes an owner) is deemed to be delinquent in the payment of all water and sewer bills due and payable to the City by said customer when said customer or consumer is delinquent on the payment of any water bill or sewer bill to the City, and all Sections of Chapter 25, Article II relating to delinquent water and sewer bills shall be applicable to said customer or consumer". B. Section 25-38 is amended by adding a new Section 25- 38(b)(1) as follows: "Section 25-38(b)(1): The above paragraph (b) relating to delinqeent notices and disconnections shall apply to all water and sewer connections of the customer or consumer and the City in order to protect the fiscal and economic integrity of its water and sewer system shall have the right to disconnect all water and sewer connections of the customer or consumer upon said customer or consumer becoming delinquent in payment of any water or sewer bill to the City and the procedures of this Chapter 25 being followed". C. Section 25-42 is hereby amended to read as follows: "Section 25-42. Rates Outside City: The rates charged by the City for water and/or waste water service outside the corporate limits of the City, including tap charges, pro rata charges, comsumption charges, deposits or any other charges shall be not less than double the rates charged to customers within the corporate limits". D. A new Section 25-42(A) is hereby added to read as follows: "Section 25-42A. Minimum Rates for Waste Water Customers Not Connected to the Water System: VVaste water charges for a customer or consumer not connected to the water system of the City shall be at a monthly rate of $11.26 per connection." SECTION 2. Penalty. Any person violating any of the portions of this ordinance shall be deemed guilty of a misdeameanor, and upon conviction thereof, shall be fined $1.00 to $200.00, and each day such violation continues shall constitute a separate and distinct offense. SECTION 3. Severability. If any section, sentence, phrase, word, paragraph, or provision of this ordinance or the application of that section, sentence, phrase, word, paragraph, or provision to any person, situation or circumstances is for any reason adjudged invalid, the adjudication shall not affect any other section, sentence, phrase, word, paragraph or provision of this ordinance or the application of any other section, sentence, phrase, word, paragraph, or provision to any other person, situation, or circumstance, nor shall such adjudication affect any other section, sentence, phrase, word, paragraph or provision of the Grapevine City Code. The City Council declares that it would have adopted the valid portions and applications of this ordinance without the invalid part, and to this end the provisions of this ordinance are declared to be severable. SECTION 4. Emergency. The fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of public business, property, health, safety, and general _ welfare of the public which requires that this Ordinance shall become effective from and after the date of its passage and it is accordin�ly so ordained.
