AN ORDINANCE AMENDING THE CITY CODE
OF THE CITY OF GRAPEVINE, TEXAS ,
CHAPTER 21, ARTICLE II RELATING TO
THE HOTEL OCCUPANCY TAX AND THE CON-
VENTION AND VISITORS BUREAU BY AMEND-
ING SECTION 21-29 RELATING TO APPOINT-
MENT OF MEMBERS TO THE CONVENTION AND
VISITORS BUREAU; AMENDING SECTION 21-30
RELATING TO THE POWERS AND DUTIES OF
THE CONVENTION AND VISITORS BUREAU;
AMENDING SECTION 21-31 RELATING TO
BUDGETARY MATTERS; PROVIDING A SEVER-
ABILITY CLAUSE AND DECLARING AN
EMERGENCY
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS :
Section 1. That Chapter 21, Article II of the Grapevine
City Code is amended by amending Sections 21-29 , 21-30 , and
21-31 as follows :
A. Section 21-29 shall be amended by changing the date
of appointments of inembers from November until April. The
second and third sentences of Section 21-29 shall be amended
to read as follows :
" {1) Regular appointments shall be made on the date
of the first official City Council meeting in April.
The expiration date of each term of office shall fall
on the date of the first official City Council meeting
in April during the year in which the term shall expire. "
" (2) Al1 parties having received appointments in Novem-
ber of 1981 shall serve until April, 1984. All parties
having received appointments in November of 1980 shall
serve until April, 1983. This transition schedule shall
apply to all parties appointed to fill out an unexpired
term. Thereafter commencing in 1983 all parties receiv-
ing appointments shall receive two (2) year terms in
April. "
B. Section 21-30 is hereby amended to read as follows :
"Section 21-30 - Powers and Duties
The Bureau sha11 have advisory powers only and shall make
recommendations to the City Council in the following areas :
(1) Recommendations concerning the acquisition,
construction, lease, or purchase of convention center
facilities, including, but not limited to, civic center
facilities, convention buildings, auditoriums, coliseums ,
and parking areas or facilities for the parking or stor-
age of motor vehicles or other conveyances located at or
in the immediate vicinity of the convention center
facilities.
(2) Assist in providing and locating facilities ,
personnel, and materials for the registration of conven-
tion delegates or registrants.
(3) Make recommendations concerning utilization
of funds for advertising for general promotional and
tourist advertising of the City and its vicinity and
conducting solicitation and operating programs to attract
conventions and visitors.
(4) Recommend the hiring of a Director who shall
be hired by the City Manager as a City employee with the
approval of the City Council. The Director shall be
directly responsible to the City Manager and shall carry
out the duties established by the City Manager. "
C. Section 21-31 shall be amended to read as follows :
"Section 21-31 - Same - Budget and Audit
(1) The tax funds projected to be derived from the
Hotel Occupancy Tax shall be included in the City' s annual
budget and shall be budgeted and expended in accordance
with and pursuant to Tex. Rev. Civ. Stat. Ann. Art.
1269j4 . 1.
(2) The City Manager is authorized to promulgate
procedures relative to expenditures and accounting of
said Hotel Occupancy Tax Funds.
Section 2. Severability. If any section, sentence, phrase,
word, paragraph, or provision of this ordinance or the applica-
tion of that section, sentence, phrase, word, paragraph, or pro-
vision to any person, situation, or circumstances is for any
reason adjudged invalid, the adjudication shall not affect any
other section, sentence, phrase, word, paragraph, or provision
of this ordinance or the application of any other section, sen-
tence, phrase, word, paragraph, or provision of any other person,
situation, or circumstances, nor shall such adjudication or pro-
vision of the Grapevine City Code. The City Council declares
that it would have adopted the valid portions and applications
of this ordinance without the invalid part, and to this end the
provisions of this ordinance are declared to be severable.
Section 3. Emergency. The fact that the present ordinances
and regulations of the City of Grapevine, Texas, are inadequate
to properly safeguard the health, safety, morals, peace, and
general welfare of the inhabitants of the City of Grapevine,
Texas , creates an emergency for the immediate preservation of
public business, property, health, safety, and general welfare
of the public which requires that this ordinance shall become
effective from and after the date of its passage, and it is
accordingly so ordained.

GRAPEVINE, TEXAS on this the 2nd day of March, 1982.
