HomeMy WebLinkAboutORD 1982-018 ORDINANCE NO. 82-18 AN ORDINANCE OF THE CITY OF GRAPEVINE, TEXAS , SPECIFYING THE REASONABLE AND PRUDENT SPEED FOR PUBLIC STREETS AND ALLEYS WITHIN THE CITY; REPEALING CON- FLICTING ORDINANCES; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED TWO HUNLRED DOLLARS ($200 . 00 ) FOR EACH OFFENSE; PROVIDING A SEVERABILITY CLAUSE; AND DECLARING AN EMERGENCY NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1 . Speed Limits on Certain Public Streets. Upon the basis of an engineering and traffic investigation heretofore made as authorized by the provisions of Section 169 , V.T.C.S. , 6701d, Uniform Act Regulating Traffic on Highways , the following prima facie speed limits hereafter indicated for vehicles are hereby determined and declared to be reasonable and safe; and such speed limits are hereby fixed at the rate of speed indicated for vehicles traveling upon the named public streets and highways, or parts there- of, of the City, said speed limit to be in force and effect unless otherwise limited as prescribed by the provisions of this ordinance. The streets and highways hereby regulated, and the maximum prima facie speed limits thereof, are as follows : Twenty miles per �our (20 m.p.h. ) on the Fairway Drive detour, more specifically described as follows : FROM Station 0 + 00 on center line for the north end of the Grapevine Dam, along said cen- ter line S 42° 06 ' 18" E, a distance of 2067 . 87 feet to a point for center line of spillway; THENCE N 61° 55 ' E, a distance of 1060 feet, more or less, to a point in the center line of Fairway Drive; THENCE Southeasterly a distance 500 feet along the center line of Fairway Drive to the point of beginning; THENCE Northwesterly alor�g the center line of Fairway Drive 500 feet to a point; THENCE S 56° 50 ' W, a distance of 458 feet, more or less, to a point for the beginning of a curve to the right; THENCE along the arc of said curve to the right (Central Angle = 67° 45 ' , Tangent = 105 . 65 feet, Radius = 100 . 00 feet) , 118 . 25 to a point for end of said curve; THENCE N 55° 25 ' W, 175 . 42 feet to a point for the beginning of a curve to the right; THENCE along the arc of said curve to the right (Central Angle = 93° 09 ' , Tangent = 105 . 65 feet, Radius = 100 . 00 feet) , 162 . 58 to a point for end of said curve; THENCE N 37° 44 ' E, 500 feet, more or less , to a point situated in the center line of Fairway Drive; THENCE Northwesterly a distance of 500 feet to the end of line. Section 2 . That the City Manager, or his agent, is hereby authorized to have speed limit signs erected, con- structed, and placed at such points along said highways, streets , or alleys , or portions thereof under construction, maintenance , or repair so that travelers will be reasonably notified of said speed. Section 3. That all ordinances , or any parts thereof, in conflict with the terms of this ordinance shall be and hereby are deemed repealed and of no force or effect pro- vided, however, that the ordinance or ordinances under which the cases currently filed and pending in the Municipal Court of the City of Grapevine , Texas , shall be deemed repealed only when all such cases filed and pending under such ordi- nance or ordinances have been disposed of by a final con- viction or a finding not guilty of nolo contendere, or dismissal. Section 4 . Any person, firm, or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction in the Munici- pal Court, shall be fined in an amount not to exceed the sum of Two Hundred Dollars ($200 . 00) for each offense. Section 5. If any section, paragraph, subdivision, clause, phrase , or provisions of this ordinance shall be judged invalid or unco�stitutional , the same shall not affect the validity of this "ordinance as a whole or any portion thereof other than that portion so decided to be invalid or unconstitutional. Section 6 . The fact that the traffic regulations of the City of Grapevine do not adequately regulate the traffic within the City creates an urgency and an emergency and the preservation of the public health, safety, and welfare re- quires that this ordinance shall take effect immediately from and after its passage and the publication of the cap- tion of said ordinance as the law and the City Charter in such cases provides.
