HomeMy WebLinkAboutORD 1981-008 , ORDINANCE N0. 81-8 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF GRAPEVINE SAID ORDINANCE BEING CONTAINED IN APPENDIX "A" OF THE CITY CODE OF THE CITY OF GRAPEVINE BY ADDING NEW SECTION 16-106 TO PROVIDE A WAITING PERIOD OF ONE (1) YEAR BETWEEN THE DATE AN APPLICATION FOR A CHANGE OF ZONING FOR THE SAME ZONING DIS- TRICT, OR DISTRICTS OR PRINCIPAL USE (S) RE- QUESTED I�.AY BE ACCEPTED; PROVIDING AN EXCEP- TION; PROVIDING A PENALTY; PROVIDING A SEVER- ABILITY CLAUSE; AND DECLARING AN EMERGENCY WHEREAS , all necessary and required notices have been satisfied; and WHEREAS , the Planning and Zoning Commission has re- commended and the City Council does find that the health, safety, morals, and general welfare of the community will be served by providing a one (1) year waiting period between the date an application for a change in zoning is denied by the City Council and the date a new application for a change in zoning is accepted. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE: Section 1. That the City of Grapevine Zoning Ordinance contained in Appendix "A" of the Grapevine City Code is hereby amended by adding a Section 16-106 which section shall read as follows : "16-106" Waiting Period to Refile A waiting period of one (1) year, between the date an application for amendment to the zoning ordi- nance, or a requested change in zoning, is denied by the City Coun- cil and a new application for such a change or amendment is accepted, is hereby established. The one year waiting period shall be applicable to all requested amendments and changes for the same zoning district, or districts, and/or principal use (s) , on all or any por- tion of the property previously con- sidered for amendment or changes in zoning, provided however, said one (1) year waiting period shall not be applicable to any proposed amend- ment or change instituted by the City Council or the Planning and Zoning Commission. Section 2. Penalty: That a person violating a pro- vision of this ordinance upon conviction, is punishable by a fine not to exceed $200. 00. 5ection 3. Severability Clause: If any section, - paragraph, subdivision, clause or phrase of this ordinance shall be adjudged invalid or held unconstitutional; the same shall not affect the validity of this ordinance as a whole or any part of any provision thereof other than the part so decided to be invalid or unconstitutional. Section 4. Emergency: The fact that the City of Grape- vine, Texas, does not have a zoning ordinance that establishes a waiting period after a case is denied creates an urgency and an emergency and the preservation of public health, safety, and welfare requires that this ordinance shall take effect immediately from and after its passage and the publication of the caption as the law in such cases provides . � DULY PASSED by the City Council of the City of Grapevine, Texas, on this �day of , 1981.
