HomeMy WebLinkAboutORD 1981-010 ORDINANCE NO. 81-10 AN ORDINANCE ANNEXING ADJACENT AND CONTIGUOUS TERRITORY TO THE CITY OF GRAPEVINE, TEXAS FINDING THAT ALL NECESSARY AND REQUIRED LEGAL CON- DITIONS HAVE BEEN SATISFIED, PRO- VIDING THAT SUCH AREA SHALL BECOME A PART OF THE CITY AND THAT THE OWNERS AND INHABITANTS THEREOF SHALL BE ENTITLED TO THE RIGHTS AND PRIVI- LEGES OF OTHER CITIZENS AND BE BOUND BY THE ACTS AND ORDINANCES NOW IN EFFECT AND TO BE HEREAFTER ADOPTED, AND FURTHER PROVIDING FOR AMENDING AND CORRECTING THE OFFICIAL BOUNDARIES OF THE CITY AS HERETOFORE ADOPTED AND PROVIDING FOR THE ORDINANCE TO GO INTO EFFECT UPON PASSAGE OF THE ORDINANCE ON SECOND READING REQUIRED BY THE CITY CHARTER AND PROVIDING A SEVERABILITY CLAUSE WHEREAS , all required statutory notice pursuant to Article 970a, the Municipal Annexation Act, has been accom- plished, and WHEREAS , a public hearing was conducted on February 3 , 1981, which hearing was conducted after notice had been pub- lished in a newspaper of general circulation not more than twenty (20) days nor less than ten (10) days prior to the - public hearing and which public hearing was not more than twenty (20) days nor less than ten (10) days prior to the institution of annexation proceedings , and WHEREAS, the property to be annexed is contiguous and adjacent to the City limits of the City of Grapevine and not within the boundaries or extraterritorial jurisdiction of another city. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS : Section 1. That all of the above premises are found to be true and correct and are incorporated into the body of this ordinance as if copied in their entirety. Section 2. That the property described in Exhibit "A" , which exhibit is attached hereto and incorporated herein for all purposes, be and is hereby annexed and brought within the corporate limits of the City of Grapevine, Tarrant County, Texas and same is hereby made an integral part hereof. Section 3. That the owners and inhabitants of the area herein annexed be entitled to all of the rights and privileges of other citizens and property owners of said city and are hereby bound by all acts , ordinances and all other legal action now in full force and effect and all those which may be hereafter adopted. Section 4 . That the official map and boundaries of the City of Grapevine, Texas heretofore adopted and amended be and is hereby amended so as to include the aforementioned territory as part of the City of Grapevine, Texas. Section 5 . That this ordinance shall take effect immediately upon second and final reading. Section 6. If any section, subsection, sentence, phrase, or word be found to be illegal, invalid, unconstitu- tional or if any portion of said property is incapable of being annexed by the City of Grapevine , Texas for any reason whatso- ever, the adjudication shall not affect any other section, sentence, phrase, �aord, paragraph or provision of this ordi- nance or the application of any other section, sentence , phrase, word, paragraph, or provision to any other person, situation, or circumstances, nor shall such adjudication affect any other . section, sentence, word, phrase, paragraph or provision of the � Grapevine City Code. The City Council declares that it would have adopted the valid portions and applications of this ordi- nance without the invalid part, and to this end the provisions of this ordinance are declared to be severable. APPROVED: � Mayor ATTEST: S� City Se ta APPROVED AS TO FORM AND LEGALITY: C� _ City Attorney � .,` . •, ' EXHIBIT "A" METES AND BOUNDS DESCRIPTION FOR ANNEXATION The following described tract or parcel of land situated in the Thomas Easter Survey, Abstract No. 458 , Tarrant County, Texas , and being a portion of a tract of land as recorded on Page 592 of Volume 2283 of the Tarrant County Deed Records , and being more particularly described as follows : BEGINNING at a point in the West line of said tract, said point also being in the West line of the Thomas Easter Survey, Abstract No. 458 , and the East line of the S . Freeman Survey, Abstract No. 525; said point also being South 0° 43 ' 41" West 251. 75 feet and South 1° 09 ' S5" West 1099 . 81 feet from the Northwest corner of said Thomas Easter Survey; THENCE North 1° 09 ' 55" East along the West line of said tract for a distance of 1099. 81 feet to an iron pin for a point; THENCE North 0� 43 ' 41" East continuing along the West line of said tract for a distance of 251. 75 feet to an iron pin for corner; said point being the northwest corner of said tract, the northwest corner of said Thomas Easter Survey, the northeast corner of said S . Freeman Survey, and the Southwest corner of the J.L. Whitman Survey, Abstract No. 1593; THENCE South 89° 18 ' 38" East along the North line of said tract and the North line of said Thomas Easter Survey for a distance of 603. 45 feet to an iron pin for a point; THENCE South 89° 04 ' 07" East continuing along the North line of said tract and the North line of said Thomas Easter Survey for a distance of 380. 4 feet to a point; said point being the centerline of an existing creek (Jones Branch} ; THENCE in a south-southwesterly direction following the meander of the centerline of said creek, said centerline being the existing city limit of the City of Grapevine, for an approximate distance of 1590 feet, to a point in a southerly line of said tract; THENCE North 88° 09 ' 16" West along the southerly line of said tract for a distance of 556 . 41 feet to the POINT OF BEGINNING and containing approximately 23 . 941 acres of land more or less.
