HomeMy WebLinkAboutORD 1981-024 C ORDINANCE NO. 81-24 AN ORDINANCE AMENDING THE CODE OF ORDINANCES FOR THE CITY OF GRAPEVINE BY AMENDING CHAPTER 25, SECTIONS 25-28 AND 25-36 ; PROVIDING FOR INCREASES IN WATER RATES AND COST DEPOSITS EFFECTIVE MAY l, 1981, PROVIDING A SEVER- ABILITY CLAUSE; AND DECLARING AN EMERGENCY BE IT ORDAINED BY THE CITY COUNCIL OF TFiE CITY OF GRAPEVINE, TEXAS: Section 1. That Chapter 25 , Sections 25-28 and 25-36 are hereby amended to read as follows : "Sec. 25-28 . Water rates There is hereby levied and shall be collected monthly from customers of the water system of the City the following charge for water service: General Monthly Water Consumption Rate First 2 , 000 gallons , minimum-------------------$ 5. 43 Next 3, 000 gallons , per 1, 000 gallons--------- 2 .12 Next 5, 000 gallons, per 1,000 gallons--------- 1. 32 Next 10, 000 gallons, per 1, 000 gallons--------- 1. 13 Next 30, 000 gallons, per 1 , 000 gallons--------- . 99 Next 50, 000 gallons, per 1, 000 gallons--------- . 93 Next 50, 000 gallons , per 1, 000 gallons--------- . 86 Next 150 , 000 gallons , per 1, 000 gallons--------- . 79 All over 300 , 000 gallons , per 1, 000 gallons------- . 72 Temporary: For a water meter installed for construction or other temporary purposes on a fire hydrant: One dollar and sixty-six cents ($1. 66) per one thousand (1, 000) gallons and a minimum charge of thirty- nine and 67/100 dollars ($39 . 67) . Fire Sprinkler connection 16 . 54 "Sec. 25-36 Application and cost deposit for water, waste water and refuse service. Any person desiring to obtain water, waste water, and refuse service shall make application to the Water Department and before such person may be granted such service, that person shall deposit with the City in the form of cash deposit or cash bond a sum of money equal to the rates shown on the following table: Single-family residential, minimum-------------$ 30 . 00 Multi-family (apartments) , minimum per 2" tap-- 40 . 00 Commercial, minimum---------------------------- 40. 00 Industrial, minimum---------------------------- 230 . 00 Fire hydrant meter, minimum & Construction meter--------------------------- 450 . 00 Upon determination of the City Water Department a sum of money equal to one and one-half (1z) times the average monthly bill for the three (3) services for that type and size of customers may be required. The City Water Department shall have the authority to require an additional deposit if it is determined that the cash bond is inadequate to meet the one and one-half (lZ) times the average monthly bill require- ment. Failure to pay water, sewer and refuse bill(within the time; allotted for payment shall be considered notice by the customer to discontinue services and to apply as much of the deposit as necessary to the satisfaction of the past-due bill. In such cases no service shall be renewed to any customer until all current and delinquent charges plus the 10% penalty or minimum of $3 . 00 , plus an additional seven dollars and fifty cents ($7. 50) . Section 2. The effective date of the increased water rates is May l, 1981 and all customers shall be billed under the new rates commencing said date. Section 3. That the effective date of the increased cost deposit for water pursuant to Section 1 above is May l, 1981 and all customers desiring to obtain water, waste water and refuse service shall pay the increased cost deposits com- mencing said date. Section 4. Severability. If any section, paragraph, sentence, clause, phrase or word in this ordinance, or appli- cation thereto any person or circumstance is held invalid or unconstitutional by a court of competent jurisdiction, such holdings shall not affect the validity of the remaining por- tions of the ordinance and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 5. Emergency. The fact that the present Code of Ordinances for the City of Grapevine, Chapter 25, Sections 25-28 and 25-36 , relating to water rates and cost deposits are inadequate creates an urgency and an emergency and in the preservation of the public health, safety and wel- fare requires that this passage and the publication of the caption as the law and charter in such cases provides.
