ANN., ARTICLE 970a, THE MUNICIPAL ANNEXATION ACT, WHEREBY THE CITY OF GRAPEVINE AND THE CITY OF COL- �* LEYVILLE, TEXAS, AGREE TO AN ADJUST�ENT IN � THEIR BOUNDARIES, SAID CITIES BEING ADJACENT ONE TO THE OTHER; PROVIDING FOR THE DIS- ��„ ANNEXATION OF ALL PROPERTY REQUIRED TO EFFECTUATE THIS AGREEMENT; PROVIDING THAT THE ORDINANCE DOES NOT BECOME EFFECTNE UNTIL AND UNLESS THE CITY OF COLLEYVII;LE PASSES AN ORDINANCE INCORPORATING THE IDEN- TICAL PROVISIONS AND AGREEING TO THE IDENTI- CAL TERMS; ESTABLISHING A NON-WANER OF EX- TRATERRITORIAL RIGHTS; AND PROVIDING A SEV- ERABILITY CLAUSE. WHEREAS, the City of Grapevine, Texas, a Home Rule City situated in Tarrant County, Texas, has a contiguous and adjacent boundary line with the City of Colleyville, Texas, a Home Rule City, situated in Tarrant County, Texas, and WHEREAS, the two (2) cities are mutually agreeable to adjusting and recognizing a common, contiguous and adjacent boundary line, and � WHEREAS, the two (2) cities agree that it is in the best interests of both � cities their res ective cit overnment and the citizens living within each of , P Y g the cities to come to a mutual agreement to finalize the boundary line between the two cities and to take all necessary steps to accomplish same, and WHEREAS, the City of Colleyville and the City of Grapevine have elected to accomplish this adjustment of boundaries by a mutual disannexation and annexation of territory pursuant to written contract between the parties dated June 7, 1979; and WHEREAS, V.A.C.S. Article 1175 grants to the cities of Colleyville and Grapevine the power to disannex territory, annex territory, and to provide for the exchange of territory with other cities; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE � j CITY OF GRAPEVINE, TEXAS: � ;�,,,, Section 1. The City Council does hereby find that all of the above stated information is true and correct and does hereby incorporate same into the body of this Ordinance as if copied in f ull. Section 2. That all the area within the territory described in Exhibit A hereto, which is now within the boundaries of the City of Grapevine, Texas, and which constitutes a part of the City of Grapevine, Texas, be, and the same is hereby disannexed from the City of Grapevine, Texas, and said area is discontinued from the City of Grapevine, Texas. Section 3. That this Ordinance is not to be interpreted as a relinquishment or waiver of any extraterritorial jurisdiction rights of the City of Grapevine, e�* Texas, to the territory described in Exhibit A hereto. Section 4. That the official map of the City of Grapevine be modified to � reflect a change of boundaries herein accomplished on final passage hereof. Section 5. This Ordinance shall not become effective, and is of no force and effect unless and until the City of Colleyville passes an Ordinance that disannexes the area currently in Colleyville pursuant to the boundary agreement. Each of the cities shall furnish a certified copy of their respective ordinances to the other City. Upon the passage of identical reciprocal Ordinances by both cities, the same shall be spread upon the minutes of the official records and minute book of both cities and filed for record in the official records of Tarrant County, Texas. Section 6. Severability. If any section, article, paragraph, sentence, clause, phrase or word in this Ordinance, or application thereto to any person or � circumstances is held invalid or unconstitutional by a Court of competent "`°"' jurisdiction, such holding shall not affect the validity of the remaining portions of the Ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. W. Minter Survey, Abstract No. 1034, said point being in the east R.O.W. line of County Road 3024, described more particularly by Warranty Deed Volume 3440, Page 578 , � Tarrant County Deed Records ; THENCE East along the South line of said Veteran' s Land Board Tract 1650. 3 to the Southeast corner of said Tract, said corner being located in the West R.O.W. line of County Road 3081; THENCE East, perpendicular to the West R.O.W. line of County Road 3081 to the East R.O.W. line of said County Road; THENCE North along the East R.O.W. line of County Road 3081 to the Southwest corner of the Ivan Tull , Trustee tract in the E. Cox Survey, being more particularly described by Warranty Deed, Volume 5517 , Page 495 , Tarrant County Deed Records ; THENCE East 1662. 3 along the South line of the Tull Tract a distance of 1662. 3 feet to the Southeast corner of said tract, said corner being located on the West R.O.W. line of F.M. 157 ; THENCE South along the West R.O.W. line of F .M. 157 to the North R.O.W. line of County Road No. 3036 ; THENCE East along the North R.O.W. line of County Road 3036 , a distance of 1970 feet more or less to the intersection with the East line of the C. C. Doss Survey, Abstract No. 439 ; THENCE North along the East line of the said C.C . Doss Survey a distance of 2288. 9 feet more or less to the Northwest corner of the Leon Smith Tract being more particularly described by Warranty Deed Volume 4704, Page 397 , Tarrant County Deed Records , said Northwest corner also being the Southwest corner of the Kenneth Z. Bond, Trustee tract in the G. W. Minter Survey described more particularly by Warranty Deed Volume 6192 , Page 496 , Tarrant County Deed Records ; THENCE East along the South line of the Bond tract 1687 . 9 feet to the Southeast corner of said tract, said corner being located on � the West R.O.W, line of County Road 3024; THENCE East acorss County Road 3024 to the East R.O.W. line of said road and the Southwest corner of the Veteran' s Land Board of the State of Texas tract in the G.
