HomeMy WebLinkAboutORD 1979-004 ORDINANCE NO. 79-4 AN ORDINANCE AMENDING THE CITY OF GRAPEVINE ' S BASIC ZONING ORDINANCE BY PROVIDING A CLARIFICATION AND DEFINITION TO DETERMINE THE METHOD TO MEASURE FRONT YARD SETBACKS ON CUL-DE-SACS IN R-1 SINGLE FAMILY DWELLING DISTRICTS ; BY AMENDING THE OFF- STREET PARKING REQUIREMENTS IN R-3 MULTIPLE-FAMILY DWELLING DISTRICTS ; AND AMENDING THE DIMENSIONS OF PARKING SPACES AND PROVIDING DRIVING LANE WIDTHS AND TURNING RADIUS REQUIREMENTS IN ALL DISTRICTS ; PROVIDING A SEVERABILITY CLAUSE ; PROVIDING A tam PENALTY AND DECLARING AN EMERGENCY. WHEREAS , the basic zoning ordinance of the City of Grapevine was adopted to enhance and benefit the health, morals and general welfare of the citizens and property owners of the City of Grapevine; and, WHEREAS , from time to time the Planning and Zoning Com- mission recommends that certain specified changes and amendments be promulgated into the said basic zoning ordinance as same is codified in the Code of Ordinances for the City of Grapevine; and, WHEREAS , all of the necessary and required notices have been complied with and public hearings held as required by State Law and the City' s Code; and, WHEREAS , the Planning and Zoning Commission has submitted its recommendations to the City Council that the basic Ordinance be amended; and, WHEREAS , the City Council does find that the amendments are in the best interests of the citizens and property owners and that said amendments do enhance and benefit the health, moral and general welfare of the citizens and property owners of the City of Grapevine; NOW, THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS : Section 1. The basic Zoning Ordinance of the City of Grapevine contained in the Grapevine City Code Title Ten is hereby amended as follows : A. Title Chapter relating to R-1 Single-Family Dwelling Districts is hereby amended by Section front yard to read as follows : "A. Front Yard. There shall be a front yard for every structure in the "R-l" Dwelling District , having a depth of not less than thirty feet (30 ' ) from the front property line to the face of the building. No covered porch, covered terrace or attached accessory building shall project into any required front yard space. On a cul-de-sac, as that term is defined in the City' s per, subdivision Rules and Regulations , the front building line is to be determined by establishing a thirty (30' ) foot setback from the front property pins on the front property or lot lines . A chord connecting these two points shall be the front building line. Where a front property line has a curved section and a straight sec- tion, the front building line shall be determined by establishing a thirty (30 ' ) foot setback on the side property lines thirty (30' ) feet from the property pins . A line perpendicular to the straight section will be established at the property, pin where the curve begins . A point will be established on this line thirty (30) feet behind the property pin. The build- ing line will be established by connecting these two points . The term property pins refer to the front corners of the property contiguous to the street right-of-way as shown on the subdivision plat. " B. Title Chapter relating to off-street parking and loading requirements is hereby amended by the following P sections to read as follows : "Section SCHEDULE OF MINIMUM OFF-STREET PARKING FOR SINGLE-FAMILY, TWO-FAMILY AND MULTIPLE-FAMILY DWELLINGS - RESIDENTIAL DISTRICTS : R-1 R-2 R-3 MH Single-Family Two-Family Multiple-Family Mobile Home Dwelling Dwelling Dwelling Dwelling District District District District Single-Family Dwelling(de- tached) 1 (One) 1 (One) 1 (One) Two-Family Dwelling Spaces per Dwelling Unit 1 (One) 12 (One and one-half) Multiple- 22 (Two and one-half) parking Family spaces per unit or 1 (One) Dwelling space per 400 square feet of Spaces per gross floor area per unit Dwelling Unit whichever requires the greater number of parking spaces . " Section GENERAL PROVISIONS • " (A) An off-street parking space shall be a striped area of not less than one hundred eighty (180) square feet, measuring approximately nine feet by twenty feet (9 ' X 20' ) , not located on a public street or alley. Such parking space, aisles and maneuvering areas shall have an all-weather surfacing, en- closed or unenclosed, and shall be connected by an all-weather surfaced driveway to a street or alley. Head-in parking ad- jacent to a public street or alley, shall not be classified as off-street parking in computing any parking requirements herein specified. " C. Title Chapter is hereby amended by adding the following Section relating to driving lane widths and turning radii: "Section Driving lane widths in all private parking lots shall conform to the following standard: 0° - 45° 18 feet minimum 46° - 90° 25 feet minimum All turning radii - 25 feet minimum" Section 2. Severability - If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto to any person or circumstances is held invalid or unconsti- tutional by a Court of competent jurisdiction such holding shall not affect the validity of the remaining portions of the ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity,which remaining portions shall remain in full force and effect. Section 3. Penalty - Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed two hundred dollars ($200. 00) and a separate offense shall be deemed com- mitted upon each day during or on which a violation occurs or con- tinues after the notice period provided herein has expired. The Court shall, order removal and abatement of the nuisance. Section 4. Emergency - The fact that no present ordinances of the City of Grapevine amends front yard setbacks in R-1 Dwelling Districts , off-street parking requirements in R-3 Dwelling Districts and dimensions of parking spaces exist, creates an urgency and an emer- gency and in the preservation of the public health, safety and welfare requires that this ordinance shall take effect immediately from and after its passage and the publication of the caption as the law and charter in such cases provides .
