AN ORDINANCE OF THE CITY OF GRAPEVINE AMENDING
THE CITY CODE TO INCREASE THE DOG IMPOUNDMENT
FEE FROM $1. 50 TO $10 . 00 AND TO INCREASE THE
FEE EACH TIME THE DOG IS IMPOUNDED DURING ANY
TWELVE (12) MONTH PERIOD; PROVIDING A PENALTY;
PROVIDING A SEVERABILITY CLAUSE AND DECLARING
AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE , TEXAS :
Section 1. That the City Code of the City of Grapevine ,
Title , Chapter , Section is hereby amended to read as
follows :
"Section Right to Redeem
The owner of any dog impounded under the terms of this
Chapter shall have the right to redeem same, unless otherwise pro-
vided, upon payment to the City for each dog so redeemed the sum of
$10. 00. For each addditional impoundment of the same dog that occurs
during any twelve (12) month period, the impoundment fee shall in-
crease by $10. 00 , for example, if a dog is impounded two (2) times
in a twelve (12) month period, the impoundment fee shall be $20 . 00
for the second impoundment , if a dog is impounded four (4) times
during a twelve (12) month period, the impoundment fee shall be
$40. 00 for the fourth impoundment. In addition to the impoundment
fee the owner shall pay the registration fee and fine , if any. "
Section 2 . Penalty. Any person violating any of the
provisions of this ordinance shall be deemed guilty of a misdemean-
or and upon conviction thereof shall be fined in a sum not to exceed
two hundred ($200. 00) and a separate offense shall be deemed com-
mitted upon each day during or on which a violation occurs or con-
tinues after the notice period provided herein has expired. The
Court shall order removal and abatement of the nuisance.
Section 3 . Severability. If any section, article, para-
graph, sentence, clause, phrase or word in this ordinance, or applica-
tion thereto any person or circumstances is held invalid or unconsti-
tutional by a Court of competent jurisdiction such holding shall not
affect the validity of the remaining portions of the ordinance; and
the City Council hereby decalres it would have passed such remain-
ing portions of the ordinance despite such invalidity, which remain-
ing portions shall remain in full force and effect.
Section 4. Emergency. The fact that no present ordinances
of the City of Grapevine increasing the dog impoundment fee from
$1. 50 to $10. 00 exist , creates an urgency and an emergency and in
the preservation of the public health, safety, and welfare requires
that this ordinance shall take effect immediately from and after
its passage and the publication of the caption as the law and
charter in such cases provides .
