HomeMy WebLinkAboutORD 1979-012 ORDINANCE NO. 79-12 AN ORDINANCE OF THE CITY OF GRAPEVINE PROVIDING FOR THE MEMBERSHIP OF THE HOUSING ADVISORY AND APPEALS BOARD AUTHORIZED BY THE UNIFORM HOUSING CODE , 1973 EDITION, AND THE BOARD OF APPEALS AUTHORIZED BY THE 1976 EDITION OF THE UNIFORM BUILDING CODE TO CON- SIST OF THE SAME MEMBERS ; PROVIDING A SEVERABILITY CLAUSE AND DECLARING AN EMERGENCY. WHEREAS , the 1973 Edition, and any subsequent amendments of the Uniform Housing Code of 1973 , previously approved and adopted, authorizes the creation of a Housing Advisory and Appeals Board, and; WHEREAS , the 1976 Edition, and any subsequent amendments , of the Uniform Building Code, previously adopted authorizes a Board of Appeals , and; WHEREAS , the duties , responsibilities , number of members and qualifications of the two (2) Boards is generally the same, and; WHEREAS , the City Council believes it would be in the best interest of the public and the citizens of Grapevine that the membership of the two (2) Boards be the same. NOW, THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE , TEXAS : 46. Section 1. That the City Council shall appoint five (5) members to the Housing Advisory and Appeals Board as authorized by the Uniform Housing Code, 1973 Edition and Five (5) members to the Board of Appeals as authorized by the 1976 Edition of the Uniform Building Code and the membership of both Boards shall consist of the same five (5) individuals . The five (5) members appointed to the two (2) Boards shall qualify as members of both Boards as required by the respective Codes . Terms of the Board members and all other duties and responsi- bilities shall be as required by Codes . Section 2 . Severability - If any section, article , paragraph, sentence, clause , phrase or word in this ordinance, or application thereto to any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdic- tion such holding shall not affect the validity of the remain- ing portions of the ordinance; and the City Council hereby de- clares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect . Section 3 . Emergency - The fact that no present ordi- '" nance of the City of Grapevine providing for the membership of the Housing Advisory and Appeals Board authorized by the Uniform Housing Code exist , creates an urgency and an emergency and in the preservation of the public health, safety and welfare re- quires that this ordinance shall take effect immediately from and after its passage and the publication of the caption as the law and charter in such cases provides.
