HomeMy WebLinkAboutORD 1979-016 ORDINANCE NO. 79-16 AN ORDINANCE AMENDING THE CITY OF GRAPEVINE ' S BASIC ZONING ORDINANCE BY AMENDING THE HEIGHT REQUIREMENT FOR GENERAL BUSINESS AND ADVERTIS- ING SIGNS AND PROVIDING FOR PLANS TO BE CERTI- FIED BY A REGISTERED PROFESSIONAL ENGINEER ON ALL SIGNS IN EXCESS OF TWENTY FEET (20 ' ) IN HEIGHT; PROVIDING A SEVERABILITY CLAUSE; PRO- VIDING A PENALTY AND DECLARING AN EMERGENCY. WHEREAS , the basic zoning ordinance of the city of Grapevine was adopted to enhance and benefit the health, morals and general welfare of the citizens and property owners of the City of Grapevine; and, WHEREAS , from time to time the Planning and Zoning Commission recommends that certain specified changes and amend- ments be promulgated into the said basic zoning ordinance as same is codified in the Code of Ordinances for the City of Grapevine; and, WHEREAS , all of the necessary and required notices have been complied with and public hearings held as required by State Law and the City' s Code; and, WHEREAS , the Planning and Zoning Commission has sub- mitted its recommendations to the City Council that the basic Ordinance be amended; and, WHEREAS , the City Council does find that the amend- ments are in the best interests of the citizens and property owners and that said amendments do enhance and benefit the health, moral and general welfare of the citizens and property owners of the City of Grapevine ; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE , TEXAS : Section 1 . The basic Zoning Ordinance of the City of Grapevine contained in the Grapevine City Code is hereby amended as follows : "Title Chapter relating to sign standards is hereby amended by amending Section to incorporate the following standards into the schedule : "General Business and Advertising signs located within "C-2" or Industrial Zoning districts on property within 200 ' of a limited access highway and on property that fronts said limited access highways shall have an allowable maximum height of sixty (60' ) feet above existing ground level at the base of the sign. Building Permit Applications for all signs in excess of twenty (20 ' ) feet in height above ground level shall be accompanied by a certificate from a registered professional engineer. All other requirements relating to signs in the Zoning Ordinance and any other City Ordinances remain in full force and effect . " Section 2 . Severability - If any section, article, paragraph, sentence , clause, pharse or word in this ordinance , or application thereto to any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdic- tion such holding shall not affect the validity of the remain- ing portions of the ordinance; and the City Council herby de- clares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 3 . Penalty - Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed two hundred dollars ($200. 00) and a separate offense shall be deemed committed upon each day during or on taw which a violation occurs or continues after the notice period provided herein has expired. The Court shall order removal and abatement of the nuisance. Section 4. Emergency - The fact that the present ordinance and regulations of the City of Grapevine are inade- quate to properly safeguard the health, safety, morals , peace and general welfare of the inhabitants of the City of Grapevine, Texas , creates an urgency and an emergency and in the preserva- tion of the public health, safety and welfare requires that this oridnance shall take effect immediately from and after its pas- sage and the publication of the caption as the law and charter in such cases provides .
