HomeMy WebLinkAboutORD 1979-017 ORDINANCE NO. 79-17 AN ORDINANCE OF THE CITY OF GRAPEVINE PROVIDING FOR IT TO BE UNLAWFUL FOR UNAUTHORIZED PARTIES TO ENTER INTO OR BE WITHIN THE AREA DELINEATED AS THE GRAPEVINE MUNICIPAL GOLF COURSE DURING CERTAIN HOURS ; PROVIDING FOR SIGNS TO BE POSTED ACCORDINGLY; PROVIDING A PENALTY; PROVIDING A SEVERABILITY CLAUSE; AND DECLARING AN EMERGENCY. WHEREAS , the City of Grapevine is the owner of a Municipal Golf Course located within an area leased from the United States Government , Army Corps of Engineer , on property owned by the United States Government at Grapevine Lake, and; WHEREAS , the City of Grapevine has made substantial and valuable improvements to the leased area by construction of a Golf Course, and; WHEREAS , it is extremely important to the citizens and taxpayers of the City of Grapevine that the course be well maintained and kept in good playing condition and that the prop- erty not be damaged or vandalized, and; WHEREAS , it is deemed in the best interests of the City that within the Golf Course area no unauthorized parties be allowed in the area after a specified time , which time shall be posted on signs located on the main streets , roads or arteries leading into the Golf Course. NOW, THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE , TEXAS : Section 1. It shall be unlawful for any person to enter into or be within the area delineated as the Grapevine Municipal Golf Course located on the United States Government property at Grapevine Lake during the time that duly posted signs preclude unauthorized persons within said area. Section 2 . The City Manager or his duly designated employee shall be authorized and directed to post signs at a point where the primary streets , roads and arteries leading to the Golf Course enter the Golf Course which signs shall state "No Unauthorized Parties Allowed on Grapevine Municipal Golf Course Property Between the Hours of P .M. to A.M. " . Section 3 . The definition of "Unauthorized Parties" means any individual who has not been authorized by the Federal , State, County or Local Government to be on the property pursuant to his or her official duties or any individual who is not at- tending a City approved function at the Golf Course. Section 4. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed two hundred dollars ($200 . 00) and a separate offense shall be deemed coumuitted upon each day during or on which a violation occurs or continues after the notice period provided herein has expired. The Court shall order removal and abatement of the nui- sance. Section 5 . Severability. If any section, article , paragraph, sentence, clause , phrase or word in this ordinance , or application thereto to any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction such holding shall not affect the validity of the remaining por- tions of the ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 6 . Emergency. The fact that no present ordi- nance of the City of Grapevine regulating unauthorized parties to be allowed in the Golf Course area exist , creates an urgency and an emergency and in the preservation of the public health, safety and welfare requires that this ordinance shall take effect immediately from and after its passage and the publication of the caption as the law and charter in such cases provides .
