HomeMy WebLinkAboutORD 1979-019 ORDINANCE NO. 79-19 AN ORDINANCE AMENDING CITY OF GRAPEVINE ORDINANCE NO. 79-4 PASSED ON THE 20TH DAY OF FEBRUARY 1979 RELATING TO THE PARKING REQUIREMENTS FOR MULTI-FAMILY DISTRICTS IN THE ZONING ORDINANCE BY AMENDING THE EFFECTIVE DATE OF THE ORDINANCE FOR THOSE PROJECTS THAT HAD OBTAINED APPROVAL OF PERMANENT FINANCING AND THAT HAD RECEIVED WRITTEN PRELIMINARY APPROVAL FROM THE CITY PRIOR TO THE EFFECTIVE DATE ; PROVIDING A PENALTY; PROVIDING A SEVERABILITY CLAUSE AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE : Section 1. That Section 4 of Ordinance No . 79-4 passed on the 20th day of February, same being the Section that placed said Ordinance into immediate effect is hereby amended to read as follows : "Section 4. Effective Date. The effective date of Ordinance No. 79-4 passed on the 20th day of February 1979 on an emergency basis remains February 20 , 1979 provided, however , as to any party that had obtained prior to said effective date approval of permanent construction financing of a Multi-Family project , which approval shall be substantiated to the City' s satisfaction, based upon the parking requirements previously in effect and provided said party had received written prelim- inary approval of its proposed project from the City prior to said effective date said party' s project shall be governed by the prior parking requirements provided a building permit for construction of the proposed Multi-Family buildings and struc- , o tures is issued on or before June 30 , 1979 . All other Multi- Family projects from and after February 20 , 1979 , shall be governed by the requirements of Ordinance No . 79-4. " Section 2 . Penalty. Any person violating any of the provisions of this ordinance shall be deemed guilty of a mis- demeanor and upon conviction thereof shall be fined in a sum not to exceed two hundred dollars ($200 . 00) and a separate of- fense shall be deemed committed upon each day during or on which a violation occurs or continues after the notice period provided herein has expired. The Court shall order removal and abatement of the nuisance. Section 3 . Severability. If any section, article, paragraph, sentence , clause , phrase or word in this ordinance , or application thereto to any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdic- tion such holding shall not affect the validity of the remain- ing portions of the ordinance ; and the City Council hereby de- clares it would have passed such remaining portions of the ordi- nance despite such invalidity, which remaining portions shall re- main in full force and effect. Section 4. Emergency. The fact that no present ordi- nances of the City of Grapevine amends Ordinance No. 79-4 relat- ing to parking requirements for Multi-Family districts exists , creates an urgency and an emergency and in the preservation of the public health, safety and welfare requires that this ordi- `"m"'' nance shall take effect immediately from and after its passage and the publication of the caption as the law and charter in such cases provides .
