AN ORDINANCE AMENDING THE BASIC ZONING
ORDINANCE OF THE CITY OF GRAPEVINE BY
AMENDING SECTION 9 OF THE GRAPEVINE CITY
CODE RELATING TO SIGNS BY AMENDING THE
SET BACK REQUIREMENTS FOR GENERAL BUSI-
NESS SIGNS IN "C-1" AND "C-2" ZONING
DISTRICTS ; PROVIDING A PENALTY; PROVID-
ING A SEVERABILITY CLAUSE AND DECLARING
AN EMERGENCY.
NOW, THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF GRAPEVINE , TEXAS :
Section 1. That Section 9 of the Grapevine City Code
is hereby amended to amend the set back requirements for General
Business Signs and to retain and reaffirm all other parts , por-
tions , and sub-sections of said Section as follows :
"Set back requirements for General Business Signs in
"C-1" and "C-2" Districts is none provided, however, the Build-
ing Official , upon receipt of an application for a sign con-
struction permit , shall examine the proposed location of said
sign and shall not issue a permit that would permit a sign to
be placed in such a manner as to impede in any manner the visi-
bility of traffic traveling in the adjacent streets or highways .
The Building Official' s decision relative to placement of the
sign in order to preclude any such traffic visibility problems
shall be final. No such sign shall project or cantilever over
the property line. "
Section 2 . Penalty. Any person violating any of the
provisions of this ordinance shall be deemed guilty of a misde-
meanor and upon conviction thereof shall be fined in a sum not
to exceed two hundred dollars ($200 . 00) and a separate offense
shall be deemed committed upon each day during or on which a
violation occurs or continues after the notice period herein
has expired. The Court shall order removal and abatement of
the nuisance.
Section 3 . Severability. If any section, article ,
paragraph, sentence , clause , phrase or word in this ordinance ,
or application thereto to any person or circumstances is held
invalid or unconstitutional by a Court of competent jurisdic-
tion such holding shall not affect the validity of the remain-
ing portions of the ordinance ; and the City Council hereby de-
clares it would have passed such remaining portions of the ordi-
nance despite such invalidity, which remaining portions shall
remain in full force and effect.
Section 4. Emergency. The fact that no present ordi-
nances of the City of Grapevine amends Section 9 of the Grapevine
City Code relating to signs by amending the set back requirements
exist , creates an urgency and an emergency and in the preserva-
tion of the public health, safety and welfare requires that this
ordinance shall take effect immediately from and after its pass-
age and the publication of the caption as the law and charter in
such cases provides .
PASSED AND APPROVED By the City Council of the City of
Grapevine , Texas on this the 17th day of April , 1979 .
