HomeMy WebLinkAboutORD 1976-009 CITY OF GRAPEVINE ORDINANCE NO. 76-09 AN ORDINANCE AMENDING CIN OF GRAPEVINE ORDINANCE �/5-11, THE CITY PERSONNEL ORDINANCE BY AMENDING SECTION VIII RE- ��� LATIVE TO DISCIPLINARY SUSPENSION; PROVIDING A SEVERABILITY CLAUSE AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CIN COUNCIL OF THE CIN OF GRAPEVINE, TEXAS: Section 1 . 'That Ordinance 75-11, Section VIII, subsections C and D are hereby amended to read as follows:" C. RIGHT OF APPEAL BY EMPLOYEE " In order to appeal a notice of dismissal, it shall only be necessary for the employee to file a denial of the charges in writing with the Personnel Director directed to the City Manager, requesting a hearing. The appeal must be filed with the Personnel Director for the City Manager within two (2) days from the date of receipt of the dismissal order. Upon receival of the appeal, the City Manager shall set a date to hear the appeal . The employee shall be notified of the date of the hearing at least twenty-four (24) hours in advance. Failure of the employee to appear at the hearing shall result in the dismissal of the appeal . The City Managers decision shall be deemed final :' J. RESTORATION "If the City Manager orders that the suspended em- ployee be restored without prejudice to his position as a result of such hearing, the employee shall receive full compensation at the regular rate of pay for the actual time lost as a result of the dismissal and it shall be the duty of the Department Head immediately to "�`� reinstate him as ordered:' � �� Section 2. It is hereby declared to be the intention of the City Council of the City of Grapevine, Texas, that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and any phase, clause, sentence, paragraph or section hereof should be declared unconstitutional, such unconstitutionality or invalidity shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional invalid phrase, clause, sentence, paragraph or section. Section 3. The fact that the present ordinances and regulations of the City of Grapevine are inadequate to protect its citizens within the corporate limits of the City of Grapevine, creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its passage as provided by the Charter of the City of Grapevine and it is accordingly so ordained.
