HomeMy WebLinkAboutRES 1972-003I R-###### 72-3 A RESOLUTION DIRECTING THE DELIVERY OF INTEREST BEARING CERTIFICATES OF OBLIGATION losyd i! �Avwm WHEREAS, on December 23, 1971, the City Council of the City of Grapevine, Texas, passed an Ordinance authorizing the issuance of interest bearing Certificates of Obligation, to construct a public swimming pool and bathhouse in the City of Grapevine, Texas, and for the purpose of paying all or a part of the Architect's fees, Financial Advisor's fees, legal fees, and inspection and testing fees; and WHEREAS, pursuant to such Ordinance, an architectural agreement was executed on the 4th day of January, 1972, between the City of Grapevine, Texas, and Mr. James Patterson, of International Building Systems, Inc., architects for said City; RM WHEREAS, said agreement has been performed and a request for payment has been filed; and WHEREAS, Certificates of Obligation should not be issued to the above named Architect. THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: 1. That there shall be delivered to James Patterson., of International Building Systems, Inc., Certificates of Obliga- tion Numbers 1 through 4, in the amount of $1,000 each, aggre- gating $4,000, and a Claim in the amount of $400.00, plus cash in the amount of $10.00, aggregating $4,410.00. 2. That it is hereby officially found-and determined that said architectural agreement has been satisfactorily per- f•rmed in accordance with the terms of said agreement, and the City of Grapevine, Texas, has received full value of said ser- vices, and that in accordance with the agreement the Architect is • • paid 75% • the estimated fee upon completion • the bidding and award of the Construction Contract. 3. That the indebtedness above mentioned was in- curred for a purpose for which said Certificates of Obligation are authorized, to-wit: constructing a public swimming pool and bathhouse in the City of Grapevine, Texas, and for the pur- pose of paying all or a part of the Architect's fees, Financial Advisor's fees, legal fees, and inspection and testing fees, in connection with said project. 4. That this Resolution is hereby finally adopted on one reading as am emergency measure, to be effective immediately such emergency being that the authorization of the Certificates of Obligation authorized by this Resolution are required as soon as possible for the immediate preservation of the public peace, health, or public welfare. 5. That it is hereby officially found and determined that a case of emergency or urgent public necessity exists which requires the holding of the meeting at which this Resolution is passed, such emergency or urgent public necessity being that the proceeds from the proposed Certificates of Obligation are re- quired as soon as possible and without delay for necessary and urgently needed public improvements, and that said meeting was open to the public and public notice of the time, place, and purpose of said meeting was given, all as required by Vernon's Ann. Civ. St., Article 6252-17. JAMES PATTERSON, of International Building Systems, Inc., Dallas, Texas, hereby acknowledges and certifies that the City Secretary of the City of Grapevine, Texas, has on this date, delivered to me, CITY OF GRAPEVINE CERTIFICATES OF OBLIGATION, SERIES 1972 NUMBERS I THROUGH 4, in the aggregate amount of $4,000.00, and a Claim in the amount of $400.00, and cash in the amount of $10.00, aggregating $4,410.00. The City Council of said City convened in REGULAR MEETING ON THE 1ST DAY OF FEBRUARY, 1972, at the City Hall, and the roll was called of the duly constitut officers and members of said City Council, to-wit: C. That a true, full and correct copy of the aforesaid Resolution adopted at the Meeting described in the above and fore- going paragraph. is attached to and follows this Certificate; that said Resolution has been duly recorded in said City Council's minutes of said Meeting; that the above and foregoing paragraph is a true, full and correct excerpt from said City Council's minutes of said Meeting pertaining to the adoption of said Reso­, lution; that the persons named in the above and foregoing paragraph are the duly chosen, qualified and acting officers and members of said City Council as indicated therein; that each of the officers and members of said City Council was duly and sufficiently noti-I fied officially and personally in advance, of the time, place and purpose of the aforesaid Meeting, and that said Resolution would be introduced and considered for adoption at said Meeting and each of said officers and members consented, in advance, to the holding of said Meeting for such purpose; and that said meet' ing was open to the public and public notice of the time, place,`' and purpose of said meeting was given, all as required by Vernonts Ann. Civ. St.., Article 6252-17. 3. That the Mayor of said City has approved, and hereby approves, the aforesaid Resolution; that the Mayor and the City Secretary of said City have duly signed said Resolution; and that the Mayor and the City Secretary of said City hereby declare that their signing of this Certificate shall constitute the signing of the attached and following copy of said Resolution for all purposes.
