PROVIDING FOR SIGNS; PROVIDING FOR A PENA LTY;
PROVLDING FOR A SAVINGS CLAUSE; AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF 'IH E CITY OF
GRAPEVINE, TEXAS:

SECTION l. That Title 9, Chapter 3 of the City Code of Grapevine,
ro Teaas, be, and the same is hereby amended by adding the following paragraph:

Upon the basis of an engineering and traffic investigation submitted to
the City Council, the City Council hereby finds and determines that a maximum
prima facie speed limit heretofore set for a public street, roadway or highway
set forth below in the City of Grapevine, Texas, is not reasonable or prudent
under the conditions found to exist in the City of Grapevine, Texas, at said
location, therefore, the City Council hereby finds, determines and declares that
� when no special hazard exists that requires a lower speed for compliance with the

provisions of this ordinance andJor the laws of the State of Te�as, no person
shall operate or drive any vehicle on the public streets, roadways or highways
, set forth below in the City of Grapevine, Texas, at a greater speed than
fifty � 50 � miles per hour, unless otherwise provided by this
ordinance or subsequent ordinance, and any speed in excess of fifty
� 50 � miles per hour, unless otherwise provided by this ordinance or subsequent
ordinance, shall be prima facie evidence that the speed is not reasonable or

prudent and is unlawful.

pro��isions, of all ordii.3 nces and sectio��s of the Ciry Co_le of Gi-apevine, 'I-exas,
in conflict with the provisions hereof, but sl�all in no ����.y r��pcal an5� provisiolls
� � of any ordinance or section of the City Code of Grapcvine, Te�as, establishin;

a "School Zone" in an area covered by this ordil�ance,
+����� � SI;CTION 3. The City M�nager is h�-rcby dir_�cted to cause appropriate
signs to be posted at reasonable intervals to.apprise the public of tne speed
limit and give them notice thereof. �
SECTION 4. Any person violating or failing to comply with any provisions
of this ordinance shall be fined upon conviction not less than One Dollar
(�1. 00) nor more than Two I�undred Dolla�s (�200. 00).

SECTION 5, It is hereby declared to be the in�ention of the City Council
of the City of Grapevine, Te�;as, that the sections, paragraphs, sen�ences,

clauses and phrases of this ordinance are severable and if any phrase, clause,
sentence, paragraph or section hereof should bP declared unc�nstit��r;�nal, s��ch
uncons�itutionality or invalidity shall not affect any of the remaining phrases,
clauses, sentences, paragraphs or sections of this ordinance, since the same
�;�cuid have been enacted b}T �he Gity Council «>>thout the incozporation in this
ordinance of any such unconstitutional or invalid phrase, clause, ser,tence,
paragraph or section,
�°' SECrl�ION 6. `l�he fact that.that the City Code of Grapetrine, Texas,
and o�l�cr oz-dinances and re�ulations of the City of Grapevine, Texas, are
inad2quate to control the speed of vehicles within the corporate limits of the
�` '"" City of Grapevine, Texas, creat�s an emergency for the immediate preser��ation
of the public business, property, health, safety, and general welfare of the
public which requires that this ordinance shall become effective from and after
the date of its passage as provided by the Charter of the City of Grapevine,
