PROVISIONS AND FOR THE REPEAL OF CONFLICTING PROVISIONS OF THE CITY CODE OF GRAPEVINE, TEXAS; PROVIDING FOR SIGNS; PROVIDING FOR A PENA LTY; PROVIDING FOR A SAVINGS CLAUSE; AI�rD DECLARING AN EMERG ENCY. BE IT ORDAINED BY THE CITY COUNCIL OF 'II-i E CITY OF GRAPEVINE, TEXAS: SECTION 1. That Title 9, Chapter 3 of the City Code of Grapevine, ,r Texas, be, and the same is hereby amended by adding the following paragraph: "SpePd greater than the designated ( ; miles ner hour ,, on designated streets not reasonable and prudent. " Upon the basis of an engineering and traffic investigation submitted to the City Council, the City Council hereby finds and determines that a maximum prima facie speed limit heretofore set for a public street, roadway or high�vay set forth below in the City of Grapevine, Texas, is not rea sonable or prudent under the conditions found to exist in the City of Grapevine, Texas, at said location, therefore, the City Council hereby finds, determines and declares that � when no special hazard exists that requires a lower speed for compliance with the �� � provisions of this ordinance andJor the laws of the State of Texas, no person shall operate or drive any vehicle on the public streets, roadways or high�vays � set forth below in the City of Grapevine, Texas, at a greater speed than fifty-five ( 55 ) miles per hour, unless otherwise provided by this ordinance or subsequent ordinance, and any speed in excess of fifty-five ( 55 ) miles per hour, unless otherwise provided by this ordinance or subsequent ordinance, shall be prima facie evidence that the speed is not reasonable or prudent and is unlawful, SECTION 2. �[-his ordin�i�ce i-cp��als those provis�ons, and only those pro��isions, of all ordii� nces and scctions of the City Code of G 1-:�pcvin�, 1-exas, in conflict wit�h tl�e �rovisions hereof, but sl�all in no �i�ay repeal any provisions of any ordinance or section ��f the (;ity Co�;je of Grapc�ri»e, Texas, establishing "'�"� a "���h��r�l 7o��e" in an area cover�d by this or�3ii�ance, � �.� S1;C`I-ION 3. The City Manager is hereby directed to cause appropriate signs to be posted at reasonable intervals to appt�ise the public of the speed limit and give them notice thereof. � SECTION 4, Any person violating or failing to comply ��vith any provisions of this ordinance shall be fined upon conviction not less than One Dollar (�l. 00) nor more than T��ao Hundred Dollars ($200. 00). ,�, � SEC"1-ION S. It is hereb}T declared to be the iniention of the City Council of the City of Grapevine, Te�as, that the sections, paragraphs, sen�ences, �� :� clauses and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph or section hereof should be declared UT]CnrlStit��tinn�l, s��ch � �_mconstitutionality or invalidity s�all ilot affect any of the r�:n,zin�i�o phrases, clauses, sentences, paragrapl�s or sections of this ordinance, since the sai�ne �x�c�.�ld have been enacted by �he Gity Council ��ith�ut the incorporation in this ordinance of any such uncoi�stitutional or invalid phrase, clause, sentence, paragraph or section, SECTION 6.
