HomeMy WebLinkAboutORD 1975-024 ORDINANCE NO. 75-24 AN ORDINANCE PROVIDING FOR THE GRANTING, SELLING, CONVEYANCE, LEASING, VACATING OR ABANDONING OF ; UNNEEDED REAL PROPERTY OR INTERESTS; PROVIDING FOR APPLICATION TO BE MADE TO CITY MANAGER FOR ACQUISI- w TION OF PROPERTY; PROVIDING FOR APPLICATION FEE; PROVIDING FOR CITY MANAGER TO FURNISH INFORMATION TO CIN COUNCIL; PROVIDING FOR CIN ATTORNEY TO RENDER OPINION; PRQVIDING FOR THE CITY COUNCIL TO DETERMINE IF THE PROPERTY WILL BE NEEDED IN THE FUTURE FOR PUBLIC OR MUNICIPAL PURPOSES; PROVIDING FOR BIDS; PROVIDING FOR ACCEPTANCE OF BIDS; AUTHORIZING THE MAYOR TO EXECUTE DEED; PROVIDING FOR APPLICATION FEE TO BE REFUNDED IF RECIPIENT OF PROPERN IS OTHER THAN ONE MAKING APPLICATION. " WHEREAS, the City of Grapevine is the owner of real property, both in fee simple and lesser estates, acquired and held for municipal purposes; and WHEREAS, at future times certain parcels or tracts of said real property and interests therein may not be of further use to the City of Grapevine, Texas; and WHEREAS, an orderly procedure for the granting, selling, conveyancing, leasing, vacating or abandoning of said unneeded real property or interests therein will be useful in obtaining the highest and most beneficial consideration for the citizens of Grapevine, Texas, in exchange for such grant, sale, conveyance, lease, vacation or abandonment. �" � NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: �:,� SECTION 1. Any person or legal entity who may desire to purc ase or exchange for or request vacation and abandonment of any real property held in fee simple title or a lesser estate in land by the City of Grapevine shall make application to the City Nlonager and furnish such information as the City Manager may require including a description of the property sufficient to locate the same for ' purposes of the application and the type of interest in the property which applicant desires to acquire. SECTION 2. An application fee in the amount of $50.00 to cover the City's cost in processing and investigating the request shall accompany each application. SECTION 3. The City Manager shall furnish all information in the application to the City Counci) including his recommendation as to whether the property is or will be needed for public or municipol purposes in the future, a market analysis or recommendation on the value of the property, and such other information as may be needed by the City Council. The City Attorney shall furnish his opinion as to whether the property may legally be granted, sold, con- veyed, leased, vacated or abandoned. SECTION 4. If the City Counci) shall determine that the property is not and will not be needed in the future for public or municipa) purposes and that the Yf e property may be legally granted, sold, conveyed, leased, vacated or a;�andoned, the Council shall pass a resolution so stating and instructing that bids be taken on property, or on the interest, therein to be gronted, sold or conveyed, or that an ordinance be drafted vacating and abandoning the property interest. SECTION 5. When bids have been accepted, the City Council shall b�' ordinance, authorize the grant, sale or conveyance of the property or subject interest therein authorizing the Mayor to execute a deed or other instrument of conveyance upon receipt of the consideration stated in the accepted bid. SECTION 6. The application fee is not refundable if the application is c�� turned down. If the application is consummated and the recipient of the � �' conveyance is a party other than the party making the application, then the recipient as part of the closing costs must pay the $50.00 fee, in addition to all other considerations which shall be refunded to the applicant.
