HomeMy WebLinkAboutORD 1975-025 / �, ORDINANCE NO. 75-25 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, AMENDING TITLE 7 OF THE CITY ' CODE, BEING THE HEALTH AND SANITATION TITLE, BY REPEALING SECTION 3 OF CHAPTER 1 AND SUBSTITUTING THEREFOR A NEW SECTION 3, RELATING TO LIVESTOCK IN THE CITY; PROVIDING A PENALTY FOR THE VIOLATION THEREOF; PROVIDING A SEVERABILITY CLAUSE; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CIN COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1 . That Titie 7, Chapter 1, Section 3 (7-1-3) of the City Code of Grapevine, Texas, is hereby repealed. Section 2. That a new section to the City Code in lieu of that repealed above is hereby passed and approved "to be known as Title 7, Chapter 1, $ection 3, (7-1-3), as fol lows: � "7-1-3: Livestock in City Limits: It shol! be unlawful for any person to own, lease, keep, have or use within the corporate limits of the City any pen, barn, stable or other structure within which is kept, stored or boarded cattle, horses, mules, sheep or goats, except as provided herein. A pen, barn, stoble or other structure will be permitted on a lot having an area of more than twenty thousand (20,000) square feet, provided such structure is located not less than one hundred feet (100') from the front lot line and not "' less than fifty feet (50') from any dwelling used for human habitation, except that of those persons dwe)I ing on the same lot. There shol I be provided on such lot ten thousond (10,000) square feet for each horse, mule, sheep or � goat and twenty thousand (20,000) square feet of lot area for each cow. "Additionally such horses, mules, sheep, goats and cattle shall not be allowed within fifty teet (50') from any dvelling used for human habitation, except that of those persons dniel�ing on the same iot. "Any person violating or failing to comply with any provisions of this Ordinance shall be fined upon canviction, not less than One Dolla� ($1.00) nor more than Two Hundred Dollars ($200,00) and each day any violation of non-compliance continues shall constitute a separate offense," Section 3. That the terms and provisions of this Ordinance shall be deemed to be sEverable and that if the validity of any portion of this Ordinance shall be declared invalid, the same shall not affect the validity of the balance of this Ordinance. Section 4, The fact that it is necessary for the citizens of the City to be protected against possible abuses as the result of such cattle, livestock, and other similar animals, creates an eme�gency for the immediate preservation of the pubiic ``'"� peace, heolth and general welfare, and therefore the Charter requirement that �-.� � '. . � ordinances be read on two (2) several days is hereby suspended, and this Ordinance shal) become effective from and after the date of its final passage, as provided by ' the City Charter, and it is accordingly so ordained.
