y WHEREAS, the City of Grapevine, Texas has undertook
to protest the application of St. Louis Southwestern Railway
Co. and St. Louis Southwestern Railway Co. of Texas, (Docket
No. 2092R0) for an order authorizing the discontinuance of the
agency station at Grapevine, Texas, and the change of the tariff
to show Grapevine as a non-agency station and to retire the
depot; and
WHEREAS, the original hearing on said application was
duly held before an Examiner of the Texas Railroad Commission in
Austin, Texas, on October 8, 1969; whereby the City of Grapevine,
Texas, appeared by its City Attorney to protest said application;
and
WHEREAS, a rehearing on said application was duly granted
and will be held on November 11, 1969 in the City of Grapevine,
Texas; and
WHEREAS, it is deemed necessary and proper for the City
— of Grapevine, Texas to protest the said application at such
hearing, in order to preserve and protect the railroad facilities
located within the City of Grapevine, Texas, and the services
provided to the City of Grapevine, Texas;
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, that WILLIS PIRKLE, Mayor
of the City of Grapevine, Texas, and FLOY EZELL, City Manager of
the City of Grapevine, Texas, be and are hereby authorized and
directed to testify in their official capacities on behalf of
the City of Grapevine, Texas , at the Texas Railroad Commission
hearing to be held in the City of Grapevine, Texas on November 11,
1969 .
