AN ORDINANCE CLOSING, ABANDONING AND
VACATING A PORTION OF BREWER STREET
IN THE CITY OF GRAPEVINE, TEXAS, AS
HEREINAFTER DESCRIBED; AND DECLARING
AN EMERGENCY .
WHEREAS, the owners of property abutting Brewer Street
� in the City o� Grapevine, Texas , have requested the right-
of-way of Brewer Street, as hereinaf ter described, be closed,
abandoned and vacated; and
WHEREAS, the right-o�-way of said street as hereina�ter
described is not now needed �or public street and will not
be needed in the �uture for a public street; and
WHEREAS, the closing, abandoning and vacating the right-
of-way of said street will relieve the City o� Grapevihe , Texas ,
from the cost and expense of maintaining said property:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF GRAPEVINE, TEXAS:
SECTION 1 . That the right-of-way known as Brewer Street,
more particularly described as follows :
BEGINNING at the Southwest corner of Lot 24, North
Side Addition to the City o� Grapevine, Tarrant
County, Texas , as recorded in Volume 388-12, Page
58 , Plat Records of Tarrant County, Texas ;
THENCE South 89 degrees 43 minutes West 7. 4 �eet
to an iron for a corner;
�„ THENCE North 0 degrees 05 minutes West 195. 4 �eet
to an iron for a corner ;
THENCE South 89 degrees 30 minutes East 7. 4 �eet
to an iron in the Northwest corner of Lot 22, North
�k""Y' Side Addition;
THENCE South 0 degrees 05 minutes East along the
West line o� Lots 22, 23 and 24, North Side Addition
195. 4 feet to the PLACE OF BEGINNING.
be, and the same is hereby closed, abandoned and vaca-ted �or
public use, and the same is hereby closed, abandoned and vacated
insof ar as all public right, title and interest in and to said
described portion of said right-o�-way is concerned, subject to
and contingent upon the owner o� abutting property removing and
relocating any existing City o� Grapevine utilities into a city
easement to the satisfaction and approval of the City Manager
of the City of Grapevine.
SECTION 2. That the Mayor , be, and is hereby authorized
to execute a Quit-Claim Deed to convey the hereinaf ter des-
cribed property to �he owners of the property abutting said
rigl-it-oF'-way, wl-io I-iave o��icially declared by a��idavit that
tl-�ey eacl-i are tl-ie rigl-it�ul �ee owners o� tl-ie right-of-way
vecated and abandoned by this ordinance and tl-iat tl�ey know
of no o ther parties who own property abutting said right-of-
� „��_ way.
SECTION 3. That the terms and provisions of this ordi-
nance shall be deemed to be severable and tha-t if the validity
o� any section , subsection , word, sentence or phrase shall be
held to be invalid, it shall not a�f ect the remaining part of
this ordinance.
SECTION 4. The fact that right-of-way o� Brewer Street
is no longer needed by the public for public usage or traveling
and would create a hardship or burden upon the City of Grape-
vine to keep open and maintain such street creates an urgency
and an emergency for the immediate preservation of the public
health, sa�ety and general welfare which requires that this
ordinance shall take ef�ect immediately from and af ter its
passage and it is accordingly so ordained.
