WHEREAS, the City Cauncil o� the City of Grapevine, Texas, does
find that there is a public necessity for the zaning change, that the public demands
it, thaz the public interest cleariy requires the amendment, that the zoning change
does not unreasonably invade the rights of thase who bought or impraved property
with reference to the c3assification which existed at the time their ozigina2
investment was made; and
WHEREAS, the City Cauncii of the City of Grapevine, Texas, does find
that zhe change �n zoning Iessens the congestian in the stree�s, helps secure

safety frorn fire, panic and o�her dan�ers; promores health and the general
,�:,:, we2fare; provides adequate Iighr and air; prevents the over-crowding of Iand;
avoids undue concentration of papulatian; faczlitates the adequate pravisians af
transportation, water, sewerage, schoals, parks and axher public requirements; and
WHEREAS, the City Council of the City of Grapevine, Te�as, h�s
deterr.�ined that there is a necess,ity and need for this change in zoning and nas

BE IT QRDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
SECTION 1. That Qrdinanee No. 70-IQ of the Zoning Ordinance .
� of tk�e City of Grapevine, Texas, passed on April 7, 1970, be, and the same is

amended and changed in that the use of the property, described in the attached
Exhibit "A" which is hereby ineorporat�d herein and which is p�esently zoned
R-1 under Ordinance 70-IO is changed to "PD" planned Developrnent District
for the following uses,
A. Multiple-family dwelling,
B. Apartment accessory uses,
C. Swimmi.ng pools, private.
SECTION 1-A. That the zoning change herein described is hereby

approved and granted upon the following described conditians:
A. That no development will occur prior to submission

a s described in Exhibit "A" attached hereto.
B. All development sha1.I strictly adhere to Lh� site
plan which is attached hereto and marked as Exhibit "B".
The above requirements shall not be construed a� conditions precedent to the
granting of a zoning change, but shall be construed as conditions precedent to
the issuance of any building permit by the �ity of Grapevi.ne, Texas,

SECTION 4. That the zoning rebulations and districts as herein
established have been made in accordance with the comprehensive p3ant for the

purpose oi promoting health, safety, mo-rals and �eneral welfare of the community.
They have been desi�ned, with respect to both present conditions and the
•� � conditions reasonably anticipated t� exist in the foreseeable future, to lessen
con�estion in the streets; to secure safety from fire, panic, flood and other
dan�ers, provide adequate light and air; to prevent over-crowding of land, to
avoid undue concentrat ion of population; facilitate the adequate provisions of
transportation, water, sewerage, drainage and surface water, parks and other
public requirements, and to make adequate provisions for the nor�al business,
commercial needs and development of the community. They have been made
with reasonable consideration, among other things of the character of the
district, and its peculiar suitability for the particular uses and with a view
� of conserving the value of buildings and encouraging the most appropriate

use of land throughout the community.
SECTION 5. This ordinance shall be cumulative of all other
ordinances of the City of Grapevine affecting zoning and shall not repeal any
of the provisions of said ordinances except in those instances where provisions
of those ordinances which are in direct conflict with the provisions of this
ordina nce.
SECTION 6. That the terms and provisions of this ordinance shall
be deemecl to be severable and that if the validity of the zoning affecting any
por�ion of the tract or tracts of land described herein shall be delcared

to be invalid, the same shall not affect the validity of the zoning of the balance
oi the tract or tracts of land described herein.
SECTION 7. That any person, :irm or corporation violating u.:.,r o:
the t�rms and provisions of this ordinance shali be subject to the same penG��izs
provided for in Ordinance No. 70-10, Zoni:��b Ordinance of the City o: G.G�,evi�e,

SECTION 8. The fact that the present zoning ordinance and
regulations of the City are inadequate to properly safeguard the health, safety,
morals, peace and general welfare of the inhabitants o: the Ci�y creates an

emergency for the immediate preservation of the public business, property,
�„,�, health, safety and general welfare of the public which requires that this
ordinance shall become effective from and after the date of its final passage,
as provided by the Charter of the City, and it is accordingly so ordained.
