FOSTER SURVEY, A.BSTRACT � 518, IN THE CITY OF GR.APEVINE, TEXAS, AND MORE FULLY DESCRIBED HEREIN; ORDERING A CH,FINGE IN THE USE OR SAID PROPERTY FROM R-2 TO I-1, LIGHT INDUSTRY; CORRECTING THE OFFICIAL ZONING MA.P; PRESERVING ALL OTHER PORTIONS OF THE ZONING ORDINANCE; PROVIDING A SEVERABILITY CLAUSE; DETERMINING THAT THE PUBLIC INTEREST, MORALS AND GENERAL WELF'ARE DEMEIND A ZONING CHANGE AND AMENDMENT HF_REIN MADE; AND PROVIDING A PENALTY; AND DECLARING *� � AN EMERQ�NCY. �.�� � �r WHEREAS, applications were �, made to amend the Official Zoning Map, City of Grapevine, Texas, by making applications for same with the Planning and Zoning Commission of the City of Grapevine, Teaas, i - as required by state statutes and the zoning ordinar�ce of the City of Grapevine, Teaas, and all the legal requirements, conditions and pre-�equisites having been complied with, the cases having come before the City Council of the City of Grapevine, Texas, after all legal notices, requirements, conditions and pre-requisites having been complied with; and, ; WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing called by the City Council did consider the following factore in making a determination as to whether thes�e requested changes ahould be granted or denied; safety of the motoring public and the pedestrians using the facilities in the area immediately surrounding the sites; safety from fire hazards and measures for fire control, protection of adjacent property from . flood or water darnages, noise producing elements and glare of the vehicular and stationary lights and effect of such lights on established character of the neighborhood, location, lighting and types of signs and relation of signs to traffic control and adjacent property, street size and adequacy of width for traffic reasonably expected to be generated by the proposed use around the site and in the immediate neighborhood, adequacy of parking as determined by requirements of this ordinance for off-street parking facilities, location of ingress and egress points for parking and off-street loading spaces, and protection of public health by aurfacing on all parkin� areas to control dust, effect on the promotion of health and the general welfare, effect on light and air, the effect on the over-crowing of the land, the effect on the concentration of population, the effect on the transportation, water, sewerage, schools, parks and other public facilities; and WHEREAS, the City Council of the City of Grapevine, Teicas, at a public hearing called by the City Council of the City of Grapevine, TeXas, did consider the following factors in making � determination as to whether this requested change ehould be granted or denied; effect on the congestion of the streets, the fire hazards, panics and other dangers possibly present in the �, � , :� r � securing of safety frorn same, the effect on the promotion of health and the { general weifare, effect on adequate light ar�d air, the effect an the over-crowing C of the land, the effect on the cancentration on papulation, the effect on the transportation; water, sewerage, schoals, parks and other public facilities; and WHEREAS, the City Cauncil further considered among other things the character of the district and its peculiar sczitability far particuiar uses and with the view to canserve the value af buildings, encoura�e the most apprapriate use of �and throughaut this city; and t�VHEREAS, the City Council of the City af Gragevine, Texas, does find that there is a public necessity for the zoning change, that the pctblic demands it, that the public interest clearly requires the amendment, that the � i zoning changes do not unreasonably invade the rights of those who bo�ght or ` 9 R improved praperty with reference to the classification which existed at the time � their original investmem was made; and I 1 WHEREAS, the City Councii of the City af Grapevine, 'T�:�cas � does find that the change in zoning lessens the cr,ngestion in the streets, helps secure safety from fire, p�nic and other dangers; pramotes health and the general welfare; provides adequate light and air; prevents the over-crowding of Iand; avoids undue concentration of pogulatio�, faci,litates the adequate grovisians of transportation, water, sewerage, schools, parks and other pt.�blic requirements; and VVHEREAS, the City Council of the City of Grapevine, Te�s, has determined that there is a necessity and need far this change in zoning and has also found and determined that there has been a change in the conditions of the praperty surroe�nding and in clase proxi.mity to the prc�perty requested for a change since this property was originally classified and therefore feels that a change in zoning classification for the particular piece of prc�perty is needed, is called for, and is in the best interest of the public at large, the citizens of the City of Grapevine, and helps promote the generai health, safety and welfare of this commun�ty; NOW, THEREFt1RE, � � BE IT ORDAINED BY THE CITY COUNCIL OR THE CITY OF GRAPEVINE, TEXAS: SECTION 1. That Ordinance No. 70-10, a Zoning Ordinance of the City of Grapevine, Texas passed on April 7, 1970, be� and �`� the same is amended and changed in that the use of the following described property, to-wit: �.� A tract of land out of the A. Foster Survey, A-518, in the City of Grapevine, Tarrant County, Texas, and being more particularly described as follows: BEGINNING at an iron pin in the South line of Wall Street, said point being S O� 11� E 76.55 feet from the Northeast Corner of said A. Foster Survey; THENCE S O° 11� E 303.7 feet to an iron pin for corner; THENCE S 64° 26� W along a fence 269.4 feet to a pipe for corner; THENCE S 89° ,�.,_, 34� W 105.0 feet to an iron pin fo r corner; � THENCE N O° 11� W 462.0 feet to an iron pin in the South line of Wall Street; THENCE along the � South Line of Wall Street as follows: S 88° 37� E 162.4 feet to an iron pin for corner; S 87° 03� E 82.3 feet to an iron pin for corner; S 74� 58� E 55.00 feet to an iron pin for corner; S 69� 30� E 53.9 feet to the POINT OF BEGINNING and containing 143,149.0 square feet of land. which is presently zoned R-2 under Ordinance 70-10 is changed to I-1, Light Industrial District. � � �rr i �F � �T��z ^�� � �p � � i�'� � II.. The City Manager is hereby directed to co�'ect the ¢� official zoning maps of the Ciey of Grapevine, Texas, to reflect the her��n change in zoning, : SECTION 3. That in all other respects the use of the tra��t or tracts of land herein above described shall be subject to all the applicabr;�e , �. �� regulations contained in said City of Grapevine zoning ordinance ar�d alX��ther applicable �nd pertinent ordinances of the City of Grapevine, �� SECTION 4. That the zoning regulations and district� a�herein �,;. '3 established have been made in accordance with the comprehensive plant �or the purpose of promoting health, safety, morals and the general welfaxe o� ihe ;� community. They have been designed, with respect to both present cot�itions ;� .� and the conditions reasonably anticipated to exist in the foreseeable futt�e, to leseen w�� congestion in the streets; to secure safety from fire, panic, flood�ar�d �er �� dangers; provide adequate light and air; to prevent over�rowding of lai�d, to �.a ,� avoid undue concentration of papulation; facilitate the adequate provisiot�s of transportation, water, sewerage, drainage and surface warer, parks a�i �x; other public requirements, and to make adequate provisions for the nori�al business, commercial needs and development of the community. They have been made with reasonable consideration, among other thinga'of the.character of the district, and its peculiar suitability for the particular uses and.w�th a view � conserving the value of buildings and enco�.r aging the most �ipprapriate use of land throughout the community. Section 5. This ordinance shall be cumulative�of all pther ordinances of the City of Grapevine affecting zoning and shall not rep�al �ny of the provisions of said ordinances except in those instances where pr�visions of � �: those ordinances which are in direct conflict with the provisions of thi� ordinance. :. .' � , P4g . � 6� Section 6. That any person, firm or corporation violating any of the terms and provisions of this ordinance shall be subject to the same penalties provided for in "�"�` Ordinance No. 70-10, Zoning Ordinance of the City of Grapevine, Texas. r� ,� SECTION 8.
