HomeMy WebLinkAboutORD 1973-020 ORDINANCE NO. 73-20 AN ORDINANCE AMENDING ORDINANCE NO. 70-10, A ZONING ORDINANCE OF THE CITY OF GRAPEVINE, TEXAS, � GRANTING A ZONING CHANGE ON A TRACT OF LAND IN THE � THOMAS EASTER SURVEY, ABSTRACT NO. 474, AND THE ALEX THOMPSON SURVEY, ABSTRACT NO. 1532, IN THE CITY OF GRAPEVINE, TEXAS� AND MORE FULLY DESCRIBED HEREIN; ORDERING A CHANGE IN THE USE OF SAID PROPERTY FROM "R_1" TO "L-I" LIMITED INDUSTRY DISTRICT; CORRECTING THE OFFICIAL ZONING MAP; PRESERVING ALL OTHER PORTIONS OF THE ZONING ORDINANCE; PROVIDING A SEVERABILITY CLAUSE; DETERMINING THAT THE PUBLIC INTEREST, MORALS AND GENERAL WELFARE DEMAND A ZONING CH�NGE AND AMENDMENT HEREIN MADE; PROVIDING A PENALTY; AND � DECLARING AN EMERGENCY. � � � WHEREAS, applications were made to a.mend the Official Zoning Map, City of Grapevine, Texas, by making applications for same with the Planning and Zoning Commission of the City of Grapevine, Texas , as required by state statutes and the zoning ordinances of the City of Grapevine, Texas, and all the legal requirements, conditions and pre-requisites having been complied with, the case having come before the City Council of the City of Grapevine, Texas , after all legal notices, require- ments, conditions and pre-requisites having been complied with; and, WHERFAS, the City Council of the City of Grapevine, Texas, at a public hearing called by the City Council did consider the following factors in making a determination as to whether these requested changes should be granted or denied; safety of the � motoring public. and the pedestrains using the facilities ! in the area immediately surrounding the site; safety � from fire hazards and measures for fire control, protection j of adjacent property from flood or water damages , noise jproducing elements and glare of the vehicular and I stationary lights and effect of such lights on established ' character of the neighborhood, location, lighting and types of signs and relation of signs to traffic control ; and adjacent property, street size and adequacy of width for traffic reasonably expected to be generated by the proposed use around the site and in the immediate ; neighborhood, adequacy of parking as determined by � requirements of this ordinance foz off-street parking � facilities, location of ingress and egress points for I parking and off-street loading spaces, and protection I of public health by surfacing on all parking areas to control dust, effect on the promotion of health and the general welfaref effect on light and air, the effect on i the over-crowding of the land, the effect on the concen- � tration of population, the effect on , the transportation, water, sewerage, schools, parks and other public facilities; and, ; WHEREAS, the City Council of the City of Grapevine, Texas , at a public hearing called by the , City Council of the City of Grapevine, Texas , did consider i the following factors in making a determination as to whether this requested change should be granted or denied; effect on the congestion of the streets, the fire hazards, panics and other dangers possibly present in the securing of safety from same, the effect on the promotion of health and the general welfare, effe�t on adequate light and air, the effect on tl�e over-crowding of the land, the effect on the concentration on population, the effect on the transportation; water, sewerage, schools, parks and other I public facilities; and, I WHERF.�S, the City Council further considered I among other things the character of the district and its ; peculiar suitability for particular uses and with the � view to canserve the value of buildings, encourage the � most appropriate use of land throughout this city; and, � � ' I - i � � ;I ; _ � . . � .. . . .. ,_ . .. . . e .... . . . � ' . . _ . . ._. .. , ..u,ot..r.ae�Y. WHEREAS, the City Council of the Ca.ty of Grapevine, Texas, daes find that there is a public necessity for the zon�ing change, that the public demands it, that the public interest clearly requires the amend- ment, that the aoning changes do not unreasonably invade the rights Qf those wha bought or improved propexty with reference to the classification which existed at the time their original investment was made; and, WHEREAS, the City Council of the City af Grapeva.ne, Texas , does find that the change in zoning lessens the cangestion in the streets, helps secure safety from fire, panic and ather dangers ; promotes health and the general welfare; pravides adequate light and a�,x; prevents the over-crowding af Iand; avaids undue cancent�atian of pa�ulation ; facilitates the adequate provisions of transportation, water, sewerage, schc�ois, parks and otlher public xequirem�nts; anci, WHEREAS, the City Cauncil of the City of Grapevine, Texas, has determined that there is a necessity and need for �his change in zonin g and has also found and determined that there has been a change in the conditians af the property surraunding and ir� close proximity to the property requested for a change since tha.s pzoperty was originally classified and therefo�e f�els that a change in zoning classification fox the particulaz piece of pzoperty is needed, is called for , and is in the best interest af the public at laxge, the citizens of the C�.ty of Grapevine, Texas, and helps promote thQ general health, safety and welfare of this cammunity; N(7W� THEREFORE, .. ,--�� 4.: :�'. �:y� BE IT ORDAINED BY 2HE CITY COUNCIL QF THE CITY aF GRAF'EVINE, TF.XAS: SEC2ION 1 . The Gity Manager is hereby directed ta correct the official zoning map of the City of Grap�vine, Texas, to reflect the herein change in �oning. SECTI4N 3. That in al1 other respects the use of the tract or tracts of land hexein above described shali be subject to ail the applicabie regulations contained in said Gity af Grapevine za�ing ordinance and all other applicable and pertinent ordznances of the City of Gzapeuine, Texas. SECTI4N 4, That the zoning xegulations and districts as herei� established have been made in accordance wzth the camprehensive plant fox the purpose of pramoting health, safety, morals and the general welfare of the c�mmunity. They have been designed, with respect to both present conditians and the CO�ditl0�5 reasonably anticipated to exist in the foreseeable future, to 3ess�n congestion in the streets; ta secure safety from fire, panic, flood and ather dangers; provide adequate li�ht and air; to prevent aver-�rowding af Iand, to avoid undue cancentxation of population; facilitate the adequate provision� of trans- portation, water, sewezage, drainage and suzface water, parks and othe� public requirements, and ta make adequate provisions for the normal business, ca�mercial needs and development af the community. They have been made with reasonable consideration, among other things of the character of the district, and its peculiar suitability for the part�cular uses and with a view of conserving the value af buildings and encouraging the �ost appropriate use of 2and through�ut the community. SECTZQN S. This ordinance shall �e cumulative of all other ardinances of the City af Grapevine, Texas, affecting zoning and sha11 not repeal any of the pr�visio�s of said ordinances except zn those instanaes where provisions af those ordinances which are in �irect conflict with the pravisions of this ordinance. SECTION 6. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning aftecting any portion of the tract or tracts of land described herein shall be declared to be invalid, the same sha11 not affect the validity of the zoning of the balance of �he tract or tracts of land described herein. SECTION �. That any person, firm or corporation violating ariy of the terms � and provisions of this ordi�ance shall be subject to the s�me penalties pxovided for in Ordinance No. 70-10, Zonin� Qrdinance of the City of Grapevine, Texas. SECTION 8.
