SPLANE SURVEY, ABSTRACT NO. 1453, IN THE CITY OF GRAPEVINE, TEXAS, AND MORE FULLY DESCRIBED HEREIN; ORDERING A CHANGE IN THE USE OF SAID PROPERTY FROM "R-1�� TO "R-3" MULTIPLE FAMILY DISTRICT; CORRECTING THE OFFICIAL ZONING MAP; PRESERVING ALL OTHER PORTIONS OF THE ZONING ORDINANCE; PROVIDING A SEVERABILITY CLAUSE; DETERMINING THAT THE PUBLIC INTEREST, MORALS AND GENERAL WELFARE DEMAND A ZONING CHANGE AND AMEND- MENT HEREIN MADE; AND PROVIDING A PENALTY; AND DECLARING AN ENIERGENCY. ��-,�. ��� � � � WHEREAS, applications were made to amend the Official Zoning Map, City of Grapevine, Texas, by making applications for same with the Planning and Zoning Commission of the City of Grapevine , Texas , as required by state statutes and the zoning ordinances of the City of Grapevine, Texas, and all the legal requirements, conditions and pre-requisites having been complied with, the case having come before the City Council of the City of Grapevine, Texas , after all legal notices, require- ments, conditions and pre-requisites having been complied with; and, ' WHERFAS, the City Council of the City of Grapevine, Texas, at a public hearing called by the City Council did consider the following factors in making a determination as to whether these requested ; changes should be granted or denied; safety of the ; motoring public and the pedestrains using the facilities in the area immediately surrounding the site; safety ( from fire hazards and measures far fire control, protection of adjacent property from flood or water da.mages , noise � producing elements and glare of the vehicular and � stationary lights and effect of such lights on established i character of the neighborhood, location, lighting and �, types of signs and relation of signs to traffic control � and adjacent property, street size and adequacy of width for traffic rea'sonably expected to be generated by the � proposed use ardund the site and in the immediate neighborhood, adequacy of parking as determined by � requirements of this ordinance for off-street parking i facilities, location of ingress and egress points for � parking and off�street loading spaces, and protection ! of public health by surfacing on all parking areas to � control dust, effect on the promotion of health and the ' general welfare, effect on light and air, the effect on the over-crowding of the land, the effect on the concen- tration of popu�.ation, the effect on the transportation, ! water, sewerage, schools, parks and other public facilities ; � and, I WHEREAS, the City Council of the City of Grapevine, Texas , at a public hearing called by the City Council of� the City of Grapevine, Texas , did consider the following factors in making a determination as to whether this requested change should be granted or denied; effect on the congestion of the streets, the fire hazards, panics and other dangers possibly present in the securing of safety from �ame, the effect on the promotion of health and the genesal' welfare, effect on adequate light and air, the effect on the over-crowding of the land, the effect i on the concentration on population, the effect on the transportation; water, sewerage, schools, parks and other public faciliti�es; and, WHEREAS, the City Council further considered among o�her things the character of the district and its peculiar suitability for particular uses and with the view to conserve the value of buildings, encour�ge the most appsopriate use of land throughout this city; and, � � � � i � � ::, �w. .�...... ,:-.::..a ..._ . . , ..: 4Gs'i�i� .;,;'', . . .. ... :..;� . . . .. . .. .�..�.. . .._ . . .. ._.. . . �d� .,. . ... .... ... ... z. .,....,.. .� „ .�_rt.0 ..�. WHEREAS, the City Council of the City of Grapevine, Texas, does f�nd that there is a public necessity for the zoning change, that the public demands it, that the public i�terest clearly requires the amend- ment, that the zoning changes do not unreasonably invade t�e rights of those who bought ox improved propeXty with reference to the classification which existed at the time their originaZ investment was made; and, WHERE,AS, the City Council of the City af Gxapevine, Texas , does find that the cha�ge in zoning lessens the congestion in the streets, helps secure safety from fire, panic and other dangers; pxomotes hea3th and the general welfare; provides adequate light and air; prevents the ovex-crowding of land; avoids undue concentration of populatian ; facilitates the adequate pxovisions of transportation, water, sewerage, schoals, parks and other public requirements; and, WHEREAS, the City Council of the Gity of G�rapevine, Texas, has determined that there is a necessity and need for this change in zoning and has also found and determin ed that there has been a change in the cc�nditions of the property surraunding and in close pxoximity ta the praperty requested for a change since this property was originally classified and therefore feels that a change in zoning classification for the particulax piece af pxoperty is r�eeded, is called for , and is in� the best interest of the pubiie at Iarge, the ca,tiaens of the Gity of Grapevine, Texas , and helps promate the genexal health, safety and welfare of this cammunity; NOW� THEREFOR�, �- .- :�,; . . ..,:.. . ����:�=.�.�. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: SECTION 1 . That Ordinance No. 70-10, a Zoning Ordina�ce of the City of Grapevine, Texas, passed on April 7, 1970, be, and the same is amended and changed in that the use of the following described property, to-wit: �.� BEING A PART of the P.R. Splane Survey, Abstract No. 1453, �,. Tarrant County, Texas, and being more fully described as follows: � BEGINNING at a point in the easterly line of the said P.R. Splane Survey, said point being an iron pin set in the northerly right-of-way line of Mustang Road at the approximate center of an existing undedicated asphalt road; THENCE N. O°18'26" W. along the easterly line of the P.R. Splane Survey being also the westerly line of the Alex Thompson Survey, said line lying generally along the center of an existing asphalt road, a distance of 745.9 feet to a point faor corner; THENCE N. 89°49' W. a distance of 1330.7 feet to a point for corner; THENCE S. 0�11 � W. a distance of 798.9 feet to an iron pin for corner; THENCE N. 74°46' E. along the northerly right-of-way of Mustang Road a distance of 126.9 feet to an iron �..A pin for corner ; THENCE around a curve in the northerly right-of-way of Mustang Road to the right, said curve havinq a radius �"""""" of 613.0 feet and a delta of 15°22' , a distance of 164.4 feet to an iron pin for point-of-tangent; THENCE S. 89°49' E. along the northerly right-of-way line of Mustang Road a distance of 1043.7 feet to the POINT OF BEGINNING; SAID TRACT herein described containing 22.97 acres. O.WNER: Warren V. McRoberts, Trustee which is presently zoned "R-1" under Ordinance No. 70-10 is changed to �'R-3�� Multiple Family District. � � • I i � � SEC2ION 2. The City Manager is hereby directed ta correct : the official zoning map of the City o.£ Grapevine, Texas, to reflect the herein change in zoning. SECTIQN 3. fihat a.n all other respects the use of the tract , or tracts of land herein above described shall be subject , to alI the applicable xegulations contained in said City af Grapevine zoning ordinance and all other appla.cable and pertinent ordinances af the City of Grapevine, Texas. i I - SECTIaN 4. That the zoning regulatiar►s and districts as � herein established have been made in accordance with the ' comprehensive plant fcsr the purpase of gromoting t�ealth, i safety, morals and the general, welfare of' the communa.ty. i� They have been designed, with respect to both present conditions and the conditicrns reasonably anticipated to exist in the fareseeable future, ta le�sen congestion in the streets; to secure safety from fire, panic, flood and ather dangers; provide adequate light and air; to prevent over-crowd�.ng of land, to avoid undue concentration of papulation; facilitate the adequate provisians of trans- portation, wa�er, sewexage, drainage and surface water, parks and other public requirements, and to make adequate pravisa.ons for the normal business , commercial needs and develQpment of the community. They have been made with reasonable considexation, among other things of the character of the district, and its peculiar suitabili.ty for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throuc�haut the commun a.ty. SEGTION 5. This ordinance shall be cumul.ative of all other ardinances of the City of Grapevine, Texas, affecta.ng zoni.ng and shall nat arepea3. any of the pxovisions of said ardinances except i.n tlaose instancses where provisions of thase ordinances which are in direct conflict with the provisions of this ordinance. SECTIQN 6. That the terms and pravisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract ar tracts o� land descrzbed herein shall be declared to be invalid, the satne shall not affect the val3.dity of the zoning of the baiance af the tract or tracts of land described herein . SECTION 7. That any person, firm or corporation violating any of the terms and provisions af this ordinance shall be subject ta the sarne penalties provided for in Ordinance No. '7�-1Q, Zonai.ng {}rdinance of the City of Gzapevine, Texas. SEGTIUN 8. The fact that the present zonin� ordinance and regulations oE the City af Grapevine , Texas , are inadequate to properly sa.feguard the health, safety, moxalsi peace and general welfare of the inhabitants of the City of Grapevine, fiexas, creates an emergency fo�r the immediate preservatior� of the public busi.ness, property, health, safety and general welfare af the public wha.ch requires that this ordinance shall became effective from and after the date of its final passage, as provided by the Charter of the City of Gxapevine, Texas, and it accordingly sa ordained.
