BE IT ORDAINED SY THE CITY COUNCIL OF THE CITY OF GRAPEVINE SECTION 1. That the certa in agreement dated �e��b '�`�, '``��- between the State of Texas and the. The State will reimburse the City £or the cost of the electrical +�°' energy used in operating the highwaq traffic signal(s) as measured bq means of � a meter installed to serve the highway traffic signal(s), or as determined by some method other than a meter whi.ch is mutually acceptable to al1 parti.es co�ncerned, The Statexs payment far the electrical energy shall be based an �h� minimum unit rate charged the City under the City's con�ract with the pawer agencq supplqing electrical energy to the Ci.ty. In the event the elec�rical energy is supplied through a municipally owned electrical power generation system, the State's payment far the electrical energy shal.l be based on the minimum unit rate appearing in the City's commercial rate strttcture. � The Ci.ty w3.11 forward the State twa copies of its existing contract with the power agency for el�ctrical energy�, and thereafter as the existing � or governin.g contro�. is terminated and new contracts are executed. A11 requests for payment for electrical energy shall be properly certified and submitted �y the Ci�y to the District Engineer of the State High� way Department at Fort Worth , Te�.s. Su.ch requests for payment shall be in accardance with forms prescribed by the State and shall be sub�nitted at not less than monthly intervals. The City wi1l maintai.n a sys�em of records necessary to suppart and establish the eligibility of all. cla3.ms for payment ux�der the terms of this contract. The Ci�p hereby consents to the canstructian of Che highway traffic � signal(s) shown on EXHIBIT 1 by the approva7. of the location and manner of constr�.ction as shawn on plans and described in specifications attached hereto, marked EX�IiBIT 2, and mada a part hereof. 4. The City wi11 exercise no control whatsoever over the ogeration, � maintenance, use, or exis�ence of Che highwa,y traffic signal(s) withouG raritten authority fram the State Highway Engineer. 5. The State shall have the authority to make such changes in the design and operation af the h�.ghwap traffic sigual{s) as it may deem necessary and adv3.sable to promote �he safe, canveniant, and orderly mavement af �raffic. � 6. The City will be responsible �or the police enfarcement required � for securing obedience to the highway traffic signa.l(s). 7.
