HomeMy WebLinkAboutORD 1972-018 ' ORDINANCE NO. 72-18 AN ORDINANCE BY THE CITY COL'NCIL OF THE CITY OF GRAPEVINE, TEXAS, CALLING AN ELECTION FOR CERTAIN CHANGES IN THE CITY CHARTER OF SAID CITY, INCLUDING CHANGES IN THE NUMSER OF CITY COUNCILMEN, AND GRANTING THE MAYOR VOTING PRIVILEGES; CHANGES IN THE MANNER OF FILLING �,,, VAC,ANCIES; CHANGES IN THE NUM�ER OF COL'NCILMEN CONSTITUTING A QUORUM; CI-�NGES IN THE PROCEDURE FOR PASSAGE OF ORDINANCES; CI-I�NGES IN THE NAME � OF THE CORPORATION COURT; CIIANGES IN THE ELECTION OF COUNCILMEN AND MAYOR; CHANGES IN THE METHOD OF ASSESSMENT OF PROPERTY TAX; CHANGES IN THE DATE TH� BOARD OF EQUALIZATION SHALL MEET; CHANGES IN THE INTERIM MliNICIPAL GOVERNMENT; SETTING A DATE FOR SAID ELECTION, AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF' GRAPEVINE, TEXAS: ' SECTION 1 . That it is to the best interest of the City to call an election for certain changes detailed herein to the Home Rule Charter of the City of Grapevine, Texas . SECTION 2. That an election is hereby ordered to be �,,,, had on the 13th day in May, 1972, to be held at the Fire Station, G Grapevine, Texas , at which election the following propositions , � should be submitted to the qualified voters , to-wit: PROPOSITION NO. l, SECTION 3.01 The Legislative and Governing body of the City shall consist of a Mayor, and Six (6) Councilmen, and shall be known and re- ferred to as the City Council , of the City of Grapevine, Texas . (a) The Mayor, and the other members of the City Council, shall be elected from the City at large . (b) The Mayor shall preside at meetings of the City Council , and shall be recognized as head of the City Government for all ceremonial purposes , and by the Governor for purposes of military law, but shall have no regular administrative duties . He may participate in the discussion of all matters coming before the Council , and shall have the right to vote on all propositions , but shall not have any veto powers . (c) In each odd-numbered year, three Councilmen and Mayor shall be elected, and in each even-numbered year, three Councilmen shall be elected. (d) The Mayor and each Councilman shall hold office for a period � of two years and until his successor is elected and qualified. � All elections shall be held in the manner provided in Article 5 ; of this Charter. � . PROPOSITION NO. 2, SECTION 3. 10 Delete: "The City Council shall determine its own rules of procedure and may compel the attendance of its members . Four (4) qualified members of the City Council , including the Mayor, or Mayor Pro-Tem, shall constitute a quorum to do business , and the affirmative vote of a majority of those present shall be necessary to adopt any ordinances or resolutions: " � Substituting therefor: � "The City Council shall determine its own rules of procedure and may compel the attendance of its members . Five (5) qualified members of the City Council including the Mayor, or Mayor Pro-Tem, shall constitute a quorum to do business , and the affirmative vote of a majority of those present shall be necessary to adopt any ordinance or resolution: " PROPOSITION NO. 3, SECTION 4.04 Delete all references to the phrase "Corporation Court" . Substituting therefor: The phrase "Municipal Court" as it appears in said Section. PROPOSITION NO. 4, SECTION 5.01 Delete "The Regular City Election shall be h�ld annually on the first Tuesday in April , at which time officers will be elected to fill those offices , the terms of which expire in April of that � year; " � Substituting therefor: "The Regular City Election shall be held annually on the first Saturday in April, at which time offic�rs will be elected to fill those offices , the terms of which expire in April of that year. " PROPOSITION NO. 5, SECTION 5.05 Delete all of Section 5.05 Substituting therefor: "Election of Councilmen and Mayor by majority: at any regular or special municipal election the candidates in each place on the ballot who shall have received the majority of votes cast in such election shall be declared elected. Should any candidate fail to receive a majority of votes for the office for which he is a candidate , the Council shall immediately order a special election to be Ai�ld between thirty (30) to forty-five (45) days after the election in which no candidate received a majority !�"""' of votes ; at this special election the names only of the two � candidates receiving the highest number of votes at the regular � election, for the office for which they were candidates , shall �rr be printed on the ballot and submitted to the qualified voters for election, and the candidate receiving the majority of votes in such special election , for the place of office for which he was candidate , shall be declared duly elected. 2 PROPOSITION NO. 6, SECTION 9. 19 Delete the date "Fifteenth day of April" as the date for return- ing tax rendition forms to the City Tax Assessor-Collector. Substituting therefor: The date "First day of April" , as the date of returning tax �+ rendition forms to the City Tax Assessor-Collector. � PROPOSITION NO. 7, SECTION 9.20 Delete "not later than the first day of June, " as the date the Board of Equalization meets . Substituting therefor: "not later than the first day of August, " as the date the Board of Equalization meets . PROPOSITION NO. 8 , SECTION 11 . 19 Delete all of Section 11 . 19 Substituting therefor: "From and after the date of the adoption of any amendment hereto in which a new place is created on the Council , then such place shall be filled by the calling of a special election to be held within forty-five (45) days after the election creating said � new place to elect a person to fill the place for its unexpired term; providing , however, if such newly created place occurs with- �• in ninety (90) days prior to a general City election, no special �, election shall be held, but said position to be filled at the ' next general election. SECTION 3. The Mayor is specifically empowered .to name all necessary election officers in the manner prescribed by Section 3.01 of- the Election Code of the State of Texas . SECTION 4. This Charter Amendment Election is to be held simultaneously with a special runoff election for the election of a City Councilman, to Place 5, on the City Council . SECTION 5. The Clerk is hereby notified to publish the caption of this ordinance at least once in the official news- paper of the City of Grapevine, Texas , not less than ten (10) , � nor more than twenty (20) days before election. � � � 3 SECTION 6. That the public importance of this measure , and the fact that it is to the best interest to the City to provide for an immediate election constitu::es an emergency, affecting the public peace, property, health and � safety of the citizens of the City of Grapevine , Texas ; there- �° for, the Charter rules governing the effective date of any � ordinance are hereby suspended and this ordinance shall take effect and be in full force �rom and �after its final passage, and it is so ordained.
