BE IT ORDAINED BY TH� CITY QJUNCIL OF THE CITY OF GRAPEVINE, TEXAS : S ECT I O1V 1. DEFINITIONS. The following words and phrases, when used in this Ordinance, shall for the purpose of this Ordinance, have the meanings respectively ascribed to them in this section as follows : "Vehicle," Evezy mechanical device, in, upon, oz by which any person or property is or may be transported or drawn upon a public highway, including motor vehicles, commercial motor vehicles, truck- �r�ctors, trailers, and semi-trailers, severally, as hereinafter de-- fined, but excepting devices moved by human power or used exclusively upon stationary rails or tracks. ,� ,. "Motor Vehicle. " Every vehicle,as herein defined, which is ,� -,; self-propelled. "Commercial Motor Vehicle. " Any motor vehicle designed or used � for the transportation of property, not including a passenger bus, passenger automobile, motorcycle, panel dela�very truck or pick-up truck. "Truck-Tractors. " Every motor vehicle designed or used primarily for drawing other vehicles and not so constructed as to carry a load other than a part of the weight of the vehicle and load so drawn. "Trailer." Every vehicle withaut motive power designed or used for carrying proPerty or passengers wholly on its own structure and to be drawn by a motor vehicle. "Semi-Trailer." Every vehicle of the trailer type so designed or used in conjuction with a motor vehicle that some part of its own weight and that of its own load rests upon or is carried by another motar vehicle. '�Mobile Home." A living quarters equipped and used for sleeping and eating which may be moved from one location to another over a �.._� public street by b2.'mg pulled behind a motor vehicle. t�Pole Trailer." Every vehicle without motive power designed w�. to be drawn by another vehicle and attached to the towing vehicle by means of a reach, or pole, or by beng boomed, or otherwise secured to the towing vehicle, and ordinarilK used fox transporting long or irregularly shaped loads such as poles, pipes, or structural members capable, generally, of sustaining themselves as beams between the supporting connections. �.. S ECTION 2. No person shall operate or cause to be operated any commercial motor vehicle, truck-tractor, trailer, semi-trailer, mobile homes, except with two wheels and less than 21 feet in length, or any combi- nation thereof through the City of Grapevine' in inter-city travel, � without a local destination or point of origin, except upon such streets as are designated as Truck Routes by this oi�dinance. � S ECT I ON 3,. �1. Except as otherwise provided herein, no person sh�ll operate or cause to be operated upon any street within the corporate limits of the City of Grapevine any commercial motar vehicle, truck-tractor, tr�iler, semi-trailer, mobil homes, except with two wheels and less than 21 feet in length, or any combination thereof except on such . street or streets as are designated as Truck Routes by this ordinance; and such vehicles shall be operated on a Truck Route wherever reason*-- ably practicable. B. EXCEPTIONS The provisions of this section shall not apply : (1) to a vehicle traveling to or from a truck terminal, garage, plece of xepair, place of performing a service, or a place of loading or unloading, over the shortest practicable route to a point on a Truck Route; or any such vehicle shall be permitted to proceed from one such point not on a Truck Route to another such point without returning to a Truck Route if to so return would unreasonably increase the distance to be traveled between such points; the operators or such vehicles shall carry evidencP of the location of its last stop and of its immediate destination in order for this exception to apply; ,�, ., (2) to emergency vehicles operating in response to any emer-- �� gency call; (3) to vehicles operated by a public uti.lity while cruising in an assigned area for the purpose of inspecting the facilities of said public utility and/or providing maintenance service to said facilities; (4} to vehicles 13 feet and ovex in height, rneasured from the ground to the highest part of such vehicle or to the highest part of any load on such vehicle. SECTION 4. w. The following streets and parts of streets are designated "Trucic Routes" under this ordi.nance : (1) 5tate Highway No. 121 from the I�lortheast city limits to its intersection with State Highway No. 114 Business Route. (2) 5tate Highway No. 121 from West Dallas Road to the South- west city limits. (3) west Dallas Road from State Highway No, 121 to Spur No. 103 or South Main Street. w�+ (4) 5tate Highway No. 114 Business Route from the Southeast city limits to the Northwest city limits. (S) State Highway No. 114 from the Southeast city limits to the Northwest city limits. �r• (6) Farm Road No. 157 from State Highway No, 121 to the Southwest dty limits. (7) 5pur No. 103 or South Main Street from S�ate Highway No, 114 to its intersection with State Highway No. 114 Business Route. �,.� B. An appropriate city employee shall erect appropriate signs I and markings to designate the Truck Routes described herein. • �,.� C. Whenever any street designated as a TYuck Route is being repaired or is otherwise temporarily out of use, an appropriate city employee is hereby authorized to designate alternate 1Yuck Routes for such period as might be necessary. SECTION 5. Any person, firm, corporation or any agent or employee thereof, who violates any of the provisions of tYis ordinance shall be quilty of a misdemeanor and, upon convictinn thereof, shall be fined not to exceed TWO HUNDRED AND NO/100 DOLIARS ($200.00) for each offense. Each day that a violation is permitted to exist shall constitue a separate offense. SECTION 6. This ordinance shall be and is hezeby declared to be cumulative of all other ordinances of the City of Grapevine providing for the regulation of motor vehicles upon the public streets, and this ordinance shall not operate to repeal or affect any of such other ordinances ex� cept insofar as the provisions thereof might be inconsistent or in �° conflict with the provisions of this ordinance, in which event such conflicting provisions, if any, in such other ordinance or ordinances �Fg� are hereby repealed. SECTION 7. till of the regulations provided in this ordinance are hereby declared to be governmental for the health, safety, and welfare of the general public. Hny meznber of the City Council, any City Official or employee charged with the enforcement of this ordinance, acting for the City of Grapevine in the discharge of his duties, shall not there- by render himself personally liable, and he is hereby relieved from all personal liability, for any damage that might accrue to persons or property as a result of any act required or permitted in the discharge of hi.s said duties. SECTION 8. Any violation of this ordinance can be enjoined by a suit fiZed in the name of the City of Grapevine in a court of competent jurisdiction, and this remedy shall be in addition to any penal provision in this ordinance or in the Grapevine City Code.
