Home My WebLink AboutORD 1968-002 ORDIN[�1NCE NO. 68-Z SPEED ZONE ORDINANCE AN ORDINANCE AMENDING TITLE 9, CHAPTER 3 OF THE CITY CODE OF THE CITY OF Q2APEVINE, TEXAS SO AS TO FIX THE PRIMA FACIE SPEED LIMITS " ON THE STREETS AND HIGHWAYS OF GRAPEVINE: PROVIDING FOR A PENALTY FOR VIOLATSON; PROVIDING A SEVERABILITY CLAUSE: AND RE- PEALING CONFLICTING ORDINANCES : WHEREAS, the City Counc.il of the City of Grapevine, Texas has found and determined it necessary to fix the speed limits in the City of Grapevine; and, WHEREAS, Section 167 and 169 of Article XIX, R.C.S. 6701d, Uniform Act Regulating Traffic on Highways, provides that whenever the governing body of the City shall determine upon the basis of an engineering and traffic investigation that any prima facie speed therein set forth is greater or less than is reasonable or safe under the conditions found to exist at any intezsection or other place or upon any part of a street or highway, with the City taking into considera- tion the width and condition of the pavement and other circum- stances on such portion of said street or highway, as well as the usual traffic thereon, said governing body may determine and decl.are a reasonable and safe prima facie speed limit there- at or thereon by the passage of an ordinance, which shall be effective when appropriate signs giving notice thereof are erected at such intersection or other place or part of the street or highway, now therefore, BE IT ORDAINED By the City Council of the City of Grapevine, Texas : that, Section 1. Upon the basis of an engineering and traffic in- vestigation, heretofore made as authorized by the provisions of sections 167 and 169 of Article XIX, R.C.S. 6701d, Uniform Act Regulating Traffic on Highways, the maximum prima facie speed limit for all vehicles shall be thirty (30) miles per hour, except on the following designated streets where prima facie speed limits shall be as hereinafter indicated, which prima facie speed limits are hereby determined and declared to be reasonable and safe: and such speed limits are hereby fixed for vehicles traveling in said city, and any speeds in excess of said limits shall be prima facie evidence that the speed is not reasonable or prudent and that it is unlawful : A. 15 MILE PER HOUR SCHOOL ZONE East Worth from the intersection of Austin Street to . � the intersection of Ruth Street. Section 3. AI1 ordinances and parts of ordinances in �" confliction herewith are hereby repealed. Section 4. If any section or provision of this chapter shall be declared invalid by account of competent jurisdic- tion, such adjudication shall not affect the remaining sections or portions of this chapter.
