PENALTY OF A FINE NOT TO EXCEID �200 FOR THE VIOLATION OF THIS ORDINI'�NCE 1rJHERE��S, Sectinn 167 and 169 of Article XIX, R.C.S. 6�Old, Uniform Act Regulating Traffic on Highways� provides that whenever the governing body of the City shall determine upon the basis of an engineering and traffic investigation that any prima facie speed there- in set forth is greater or less than is reasonable or safe under the conditions found to exist at any intersection or other place or upon ""`"" any part of a street or highway within the City� taking into considera� tion the width and condition of the pavement and other circumstances on such portion of said street or highway, as ?aell as the usual traffic � � thereon, said governing body may determine and declare a reasonable and safe prima facie speed limit thereat or thereon by the passage of an ordinance, which shall be effective when appropriate signs giving notice thereof are er�ected at such intersections or other place or part of' the street or highway, now therefore� BE IT ORDAINED by the City Council of the City of Crra�vi ne , Texas SE�CTION 1. The following prima facie speed limits hereafter indicated for vehicles are hereby dEtermined and declared to be reasonable and safe; and such speed limits are hereby fixed at the rate of speed indicated for vehicles traveling upon the named streets and highways or parts thereof, described as follows: Control 353-7 Toop 382 (a) From Station 1430*27.15 (Intersection State Hiohwa,y 11�) � ��asterly 1.819 miles to Station 133L��74•5 (l:ntersection with State Highway 121) not to exceed !�0 miles per hour. � (See Attached Sheet} �� Control 363-4 Spur 103 � (a) From Station 3+74.35 (Intersection with State Highway 121) Southerly 0.721 miles to 5tation la.1+82.05 (Intersection with State Highway 11�) not to exceed 40 miles per hour. Control 36�-1 State Highwa�r 121 (a} From Station 1097+83.71 (Intersection with Loop 382) Idortheasterly 1.080 miles to Station 115��86 (Grapevine Dam Road) not to exceed �0 miles per hour. � � ...� � 8peed Zone Ordinance -2- � S�CTIOI�1 2. The City Council of the Cit✓r of Grapevine declares ancl fixes the above maximum speed limits and the District Engineer is hereby authori.zed to proceed with the erection of the ap:-:ropriate si�s. SECTIOi� 3. It is hereby declared that the construction project on Etc. Highvaay No. etc. has necessitated the enactment of this ordinance for the safety of those traversing �� Highway A1o. etc. in the City of a . Therefore� the above re�ations shall be in ef�'ect af er he passage of this ordi.nance and the erection of �he proper sign.s; and, this shall remain in effect until the completion and acceptance of the said construction project by the Hi�hway District �ngin�er or until such t�sne as the construction project has pro,�,ressed to a sta�e whereby, in the opinion of the Hi�htiaay District Engineer, traffic may safely- travel the construction _ project, or por-�ions thereof� at the rate of speed posted prior to the con- struction. The Hi�hway District �ngineer ��ill have the authority to replace . the construction speed zone signs with speed zone signs reestablishing the speed zonin� prior to construction and the placement of such sig,ns shall be evidence of the governin; speed zone or zones. The completion and/or accept- ance of the said construction project by the Hi�hway District �En^•ineer shall cancel the provisions of this ordinance and the Hi�hway �istrict Lngineer shall be authorized to remove all such signes used in compliance ti�-ith regul- ations se� forth in this ordinance. � S�CTION !�, �lny ordinance or any part thereof in dixect conflict with this ordinance is hereby superseded and the pax•t of the ordinance in conflict heret�rith shall be nu11 and void so lon; as this ordinance is in. effecto I?ot�ever, any ordznance or part of an ordi.nance supersedec'. by this ordinance shall �utomatically 'r�e reinstated in force upon the date o.f completion and/or acce�ta.nce of the said construction project, when this ordinance is no lon;er in effect. SEC�.'IOI�T 5. liny person violatinU any of the provisions of this ordinance shall be deemed �;uilty of a misdemeanor and upon conviction thereof shall be fined in any sum not more than two hundred (�200.00) dollars. SECTIO�T 6. If any part of this ordinance be declared unconstitutional or otherwise void by a court of competent jurisdiction, such decision sha11, in no way, effect �Lhe validity of any of the remainin� parts of this ordinance unless the part held unconsititutional or void is insepa- ble from, and indispenaable to, the operation of the remainina parts.
