HomeMy WebLinkAboutORD 2007-013 ORDINANCE NO. 2007-13 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, ADOPTING A ONE HALF OF ONE PERCENT SALES AND USE TAX FOR THE PURPOSE OF FINANCING THE OPERATION OF THE GRAPEVINE CRIME CONTROL AND PREVENTION DISTRICT; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City of Grapevine, pursuant to Chapter 363 of the Texas Local Government Code ("Code"), duly called an election on November 7, 2006, for the purpose of presenting to the voters a proposition to increase the sales and use tax by one half of one percent as permitted and for such purposes as prescribed under such statute; and WHEREAS, by the results of the Crime Control and Prevention District election conducted in accordance with the law, as duly canvassed and tabulated, the majority of the votes cast favored the creation of a Crime Control and Prevention District and the adoption of a one half of one percent sales and use tax for the purpose of financing the operation of the Crime Control and Prevention District; and WHEREAS, pursuant to the authority granted by the Code, this City Council finds it in the best interest of the citizens of the City of Grapevine to levy the tax authorized by the election for the purpose of financing the operation of the Grapevine Crime Control and Prevention District. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That the findings and declarations contained in the preamble of this ordinance are incorporated herein as part of this ordinance. Section 2. The City Council hereby levies a one half percent sales and use tax for the purpose of financing the operation of the Grapevine Crime Control and Prevention District. Section 3. The City Council hereby makes an appropriation for the Grapevine Crime Control and Prevention District operations in the amount of $ 9,642,377 for the first year and $9,980,300 for the second year. The City Manager of the City of Grapevine, or his designee, is hereby authorized to allocate the appropriated budget between City fiscal years to accommodate the record keeping functions of the City and is authorized to make intra and inter division fund transfers during the appropriation periods as becomes necessary. Section 4. The fact that the present ordinances and regulations of the City of Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the public creates an emergency which requires that this ordinance become effective from and after the date of its passage, and it is accordingly so ordained.
