HomeMy WebLinkAboutRES 1957-010WHEREAS, a contract has been received, to wit:: "This contrPct and aoreer,,ient made and entered into by and bet- ween TARAANT COUNTY,acting by and through its Commissioners Court, hereinafter referred to as C01JNTY, and the City of Grape- vine, Texas acting by and through its City Council, hereinafter referred to as TOWN:, W I T NE, S Si TH: "The above named TO JTZ has a fire department recognized by the Insurance Commission of the State of Texas, and has by an orde or resolution of its governing authorities, petitioned the Commissioners Court of CL,[J4TY to enter into a contract with said TCYNN for the use of the fire truck and other fire fighting equip- ment of said TOWN for the purpose of fire protection to real and personal property located outside of the boundaries of said TO14N and within such distance as such fire department may reasonable be expected to reach and render service in case of fire, and said COUTINTY has agreed to enter, and does by these presents enter into a contract by the terms of which TAR'1RANT COUNTY acting by its Commissioners Court will pay to said TOWN for the purposes afore- said, the sum of Twelve "undred ($1,200.00) Dollars per annum, such amounts to be paid in a lump sum or in equal monthly in- stallments within the discretion of the Commissioners Court of Tarrant County, taking into consideration the needs and demands of said Town and its fire department. Said town or village further agrees that in the eventits fire department has hot been raised to a standard whereby it has been reco,7n_`Lzed by the Insurance Commission of the State of Texas, that it will during the ensuing twelve months, take such steps as are necessary to secure re- cognition by the Insurance Commission of the State of Texas. rx In making ap-Jication for this contribution or ai,lowance 1 from the Commissioners Court of Tarrant County, the City of Grapevine des hereby certify that it does have title to all of the fire fighting equipment in its fire department, and has established the Fire Department by City Ordinance according to the laws of the State of Texas. "Said Town does further agree, as a part of this contract that will furnish to the Commissionefs Court, or to the County Auditor Tarrant County, an itemized account of the spending of such funds as are granted to it by the Commissioners Court not later than December 1st of each year of such funds as may be acquired by said Town as a result of this contract® It further agrees that the funds acquired by this contract shall be kept in a separate account and may be expended for purchase, maintenance and oper- ation of the fire dpartrtient of said Town and not entered into the general fund or building fund of said Town, nor used for building purposes except it may be used for the construction of ?sousing said fire fighting equipment of said Twon. REM "Said Town does further agree that its Fire Department shall abide by the laws of the State of Texas which established the office of County Fire Marshal, and shall be subject to the Recommendations of such office in coordinating mutual aid' fire service and investigation for Tarrant County® "This contract shall be in full force and ei"fect for and during the entire period of 1958, and no longer, unless re- newed or extended by further contract® "The funds to be paid by Tarrant County for the use of the fire fighting equipment, and the use and service thereof by the fire department of such Town for fighting fires outsideof the limits of said Town shall be paid out of the General Fund of Tarrant County, and shall be paid to the above named incorporated ;down as hereinabove provided'.' vVHEREAS,the Fire Department has recommended that the contract be approved, NOW TriEREFORE BE IT RESULVED BY 'ITfE CITY CU'UNCIL OF THE CITY OF GRAPEVINE, TEXAS: (1) That the City Council accept and approve the ab,-I,ve contract as written, (2) That the Mayor and City Secretary be authorized to sign said contract for the City of Grapevine.
