HomeMy WebLinkAboutORD 1999-022 ORDINANCE NO. 99-22 �� AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS EXTENDING ORDINANCE NO. 93-34 WHICH GRANTED A TELECOMMUNICATIONS FRANCHISE TO GTE SOUTHWEST, INCORPORATED UNTIL AUGUST 1, 1999 OR UNTIL THE NEW TELECOMMUNICATIONS ORDINANCE AND MUNICIPAL CONSENT AGREEMENT ARE EFFECTIVE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, Ordinance No. 93-34, approved by the City Council of the City of Grapevine on August 17, 1993, granted a five year franchise to GTE Southwest, Inc.; and WHEREAS, GTE Southwest, Inc. has requested the City of Grapevine to grant it a new franchise and the negotiations relative to the terms of a new franchise are still underway and not yet finalized; and WHEREAS, Ordinance No. 98-105, approved by the City Council of the City of Grapevine on September 1, 1998, granted an extension for a six month period until March 1, 1999 to the existing franchise; and WHEREAS, both the City and GTE Southwest, Inc. desire for an extension of said franchise ordinance until August 1, 1999, or until the new telecommunications ordinance and municipal consent agreement are effective, whichever date is sooner, to allow negotiations to be continued. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated in the preamble are found to be true and correct and are incorporated herein for all purposes as if copied in their entirety. Section 2. That Ordinance No. 93-34, which granted the franchise to GTE Southwest, Inc. is hereby extended to August 1, 1999 or until the new telecommunications ordinance and municipal consent agreement are effective, whichever date is sooner. Section 3. That this ordinance shall take effect from and after its passage and at such time as GTE Southwest, Inc. submits written acceptance, which written ,�,,>:� acceptance shall be attached to this ordinance and labeled Exhibit "A". ,�.:.,� Section 4. The fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, ��� peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its final passage, and it is accordingly so ordained.
