--- � AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
° GRAPEVINE, TEXAS ABANDONING AND VACATING A
FIFTEEN FOOT (15') UTILITY EASEMENT DEDICATED IN
- LOT 1, BLOCK 1, ST. MORITZ ADDITION, CITY OF
�-- GRAPEVINE, TEXAS; PROVIDING A SEVERABILITY

WHEREAS, a fifteen foot (15') ut':litv P.��PfY1P,n,t r�pr���at��r �� !�± 1, Bloc�: '!,
St. Moritz Addition, recorded in Cabinet A, Slides 2327 and 2328, Plat Records of Tarrant
County, more specifically described in Exhibit "A" attached hereto and incorporated herein
for all purposes, is not needed for public use and will not be needed in the future for public
use; and
� WHEREAS, the owners of Lot 1, Block 1, St. Moritz Addition have requested the
City of Grapevine to abandon and vacate said fifteen foot (15') utility easement; and
� WHEREAS, the request for abandonment and vacation has been reviewed and
approved by the franchised utilities in the City of Grapevine; and

WHEREAS, abandoning and vacating this portion of said utility easement will
relieve the City of Grapevine, Texas from the cost and expense of maintaining said
property.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That all matters stated in the preamble of this ordinance are true and
correct and are herebv incornorated into th? h�d;! nf trig nrr�j�?�?r� ?� ;f ���,;��' ;� *h�;;
entirety.
Section 2. That a fifteen foot (15') utility easement dedicated in Lot 1, Block 1,
St. Moritz Addition recorded in Cabinet A, Slides 2327 and 2328, Plat Records of Tarrant
County, as shown in Exhibit "A" attached hereto and made a part hereof, is hereby
abandoned and vacated for public use and the same is hereby abandoned and vacated
insofar as all public right, title, and interest in and to said utility easement is concerned.
Section 3. If any section, article, paragraph, sentence, clause, phrase or word in
� " this ordinance, or application thereto any person or circumstance is held invalid or
, unconstitutional by a Court of competent jurisdiction, such holding shall not affect the ,
��" validity of the remaining portions of this ordinance; and the City Council hereby declares
'��° .... �;, it would have passed such remaining portions of the ordinance despite such invalidity,
��� �� which remaining portions shall remain in full force and effect.

.,- Section 4. The fact that the present ordinances and regulations of the City of
= Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace

_ and general welfare of the public creates an emergency which requires that this ordinance

- become effective from and after the date of its passage.

" BIENG a description of a portion of a 15 foot wide Utility Easement situated in the A.Thompson Survey
Abstract No. 1532 and the J.R Stephens Survey Abstract No. 1490 in the City of Grapevine,Tarrant
_ County,Texas,and being a portion of Lot 1 Block 1 of St.Moritz Additian,an addition to the City of
- Grapevine as shown on the Plat recorded in Cabinet A at Slide 2327 thru 2328 of the Plat Records of
Tarrant County,Texas. Said portion containing 0.033 acre and being more fully described as follows:
°- COMIlvIENCING at the most northerly east corner of said addition,being the east comman comer between
- said addition and Southwest Grapevine Commercial Park,an addition to the City of Grapevine as shown an
the Plat recorded in Cabinet A at Slide 2844 of the said Tarrant County Plat Records and also being on the
northwest right-of-way line of Grayson Drive(a variable width right-of-way);
THENCE South 48 deg.42 min. 10 sec.West,departing said Southwest Grapevine Commercial Park
Addition and along the said northwest right-of-way of Grayson Drive,a distance of 15.00 feet to a point for
corner;
THENCE North 41 deg. 10 min.39 sec. West,departing said right-of-way line,a distance of 800.18 feet to
a point for corner;
THENCE South 48 deg.50 min.26 sec. West,a distance of 190.99 feet to the POINT OF BEGINNING;
THENCE South 67 deg.43 min.34 sec.East,a distance of 92.87 feet to a point for corner;
