HomeMy WebLinkAboutORD 2014-017ORDINANCE NO. 2014-17 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, ABANDONING AND VACATING CANNON STREET BETWEEN AUSTIN STREET AND RUTH STREET IN THE CITY OF GRAPEVINE, TEXAS CONTINGENT UPON FUTURE FAITH CHRISTIAN SCHOOL SITE PLAN APPROVAL BY THE CITY; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, Faith Christian School has requested the City to abandon and vacate Cannon Street between Austin Street and Ruth Street; and WHEREAS, expansion plans for Faith Christian School depend upon this abandonment to allow incorporation of the street into the overall site plan for the campus to be considered for approval by the City at some future date; and WHEREAS, the street will not be needed for public street use and will not be needed in the future for public street use if utilized and incorporated into the Faith Christian School site plan; and WHEREAS, abandoning and vacating the said street will relieve the City of Grapevine, Texas from the cost and expense of maintaining said property. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated in the preamble of this ordinance are true and correct and are hereby incorporated into the body of this ordinance as if copied in their entirety. Section 2. That subject to the following conditions, Cannon Street between Austin Street and Ruth Street, depicted in Exhibit "A", attached hereto and incorporated herein for all purposes, is hereby authorized to be abandoned and vacated for public use. The abandonment is wholly contingent upon City approval of a zoning case to be filed by Faith Christian School which includes and incorporates this portion of Cannon Street into the site plan. If for any reason, such a site plan is not approved by the City Council, then this authorization shall be of no force or effect. Section 3. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of any section, subsection, word, sentence or phrase shall be held to be invalid, it shall not affect the remaining part of this ordinance. Section 4. That the fact that the right of way is no longer needed by the public for public usage and would create a hardship or burden upon the City of Grapevine to keep open and maintain such right of way creates an urgency and an emergency for the immediate preservation of the public health, safety, and general welfare which requires that this ordinance shall take effect immediately from and after its passage and it is accordingly so ordained. Said Cannon Street right of way having been dedicated as a 16 foot wide Giddens Alley right of way in the plat of Blocks 113 and 114, College Heights Addition, recorded April 14, 1921, and dedicated as a 34 foot wide Cannon Street right of way in the plat of Blocks 117, 118 and 119 of the Clifton H.
