HomeMy WebLinkAboutORD 1998-023 �:.� ORDINANCE NO. 98-23 ,,�, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS AMENDING THE GRAPEVINE CODE OF ORDINANCES BY AMENDING CHAPTER 7 BUILDINGS AND CONSTRUCTION, ARTICLE III, DIVISION 4, SECTIONS 7-91 AND 7-97 RELATIVE TO THE ADOPTION OF THE 1996 NATIONAL ELECTRICAL CODE; PROVIDING AMENDMENTS TO SAME; REPEALING CONFLICTING ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY, NOT TO EXCEED TWO THOUSAND DOLLARS ($2,000.00) FOR EACH SEPARATE OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED UPON EACH DAY DURING OR ON WHICH A VIOLATION OCCURS; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, ���, TEXAS: Section 1. That Chapter 7, Article I I I, Division 4, Section 7-91(a) is hereby �� amended to read as follows: "Sec. 7-91. National Electrical Code adopted; penalty. (a) There is hereby adopted by the City, for the purpose of prescribing regulations, governing conditions hazardous to life and property, that certain 1996 Edition of the National Electrical Code, with the exception of such sections thereof as are hereinafter deleted, modified or amended, and the same is hereby adopted and incorporated herein as if the same were copied in its entirety, and from the date on which this section shall take effect, the provisions thereof shall be controlling within the limits of the City with amendments as herein noted in Section 7-97. This article titled "Article III. Electrical Code", its contents, the 1996 Edition of the National Electrical Code, and the amendments as herein noted in Section 7-97 shall be known as the "Grapevine Electrical Code," and a copy of said code shall be maintained in the office of the City Secretary." Section 2. That Chapter 7, Article III, Division 4, Section 7-97 is hereby � amended in its entirety to read as follows: "Sec.7-97. Amendments to National Electrical Code. � �, � The following are amendments to the 1996 Edition of the National Electrical Code: ,,,�,,, (1) 230-2. Number of Services. (a) Number. A building or other structure shall be served by only one service. Exception No. 1: For fire pumps...(text unchanged)...considered to be one service lateral. Exception No.8: In supplying electrical service to multifamily dwellings, two or more laterals or overhead service drops shall be permitted to a building when all of the following conditions are met: a. The building height is limited to three stories. b. The building has six or more individual gang meters and all meters are grouped at the same location. c. Each lateral or overhead service drop originates from the same point of service. �k� (2). 230-71.Maximum Number of Disconnects. � (a)General. The service disconnecting means for each service permitted by Section 230-2, or for each set of service-entrance conductors permitted by Section 230- 40, Exception No.1, shall consist of not more than six switches or six circuit breakers mounted in a single enclosure, in a group of separate enclosures, or in or on a switchboard. There shall be no more than six disconnects per service grouped in any one location. Exception No. 1: Multi-Occupant Buildings. Individual service disconnecting means is limited to six for each occupant. The number of individual disconnects at one location may exceed six. Exception No.2: For the purpose of this section, disconnecting means used solely for the control circuit of the ground fault protection system, installed as part of the listed equipment, shall not be considered a service disconnecting means. (3) Article 230-2 is hereby amended to add Exception No. 8 to read as follows: "Exception No. 8: For Single Family Lots. There shall be only one meter per single-family lot as zoned by the City of Grapevine and as described by the Grapevine Comprehensive Zoning Ordinance. By """�` special permission, a second meter may be requested for a single-family lot and shall be in writing to the Building Official stating the reason(s) a second meter is necessary. A permit mistakenly issued for a second ORD. NO. 98-23 2 �.,� meter without written consent of the Building Official is immediately null and void." ,,,�,�, 250-81.Grounding Electrode System. If available on the premises at each building or structure served, each item (a) through (d) below, and any made electrodes... Exception No. 2: In industrial and commercial buildings where conditions of maintenance and supervision ensure that only qualified persons will service the installation and the entire length of the interior metal water pipe that is being used for the conductor is exposed. Where a metal underground water pipe, as described in item (a), is not present, a method of grounding as specified in (b) through (d) below shall be used. (FPN): See Section 547-8 for special grounding and bonding requirements for agriculture buildings. (5) 310-16 through 310-19 —Allowable Ampacity Tables. Notes to Ampacity Tables of 0 to 2000 Volts �..�. 3. 120/240 Volts, 3-Wire, Single-Phase Dwelling Services and Feeders. For �� dwelling units, conductors, as listed below, shall be (text unchanged) conductors. The grounded conductor shall be permitted to be smaller than the ungrounded conductors, provided the requirements of Sections 215-2, 220-22, and 230-42 are met. This Note to Tables 310-16 through 310-19 shall not be used in conjunction with Section 220-30. (6) 336-5. Uses Not Permitted. (a) Types NM, NMC and NMS. Types NM, NMC, and NMS cables shall not be used: (1) In any dwelling or structure exceeding three floors above grade. For the purpose of this article, the first floor of a (text unchanged) vehicle parking, storage, or similar use shall be permitted. Exception No.1: An additional level shall be permitted where the renovation of attic, vehicle parking, or storage space creates a �,•�. habitable floor level in an existing one-family dwelling. Exception No.2: An additional level shall be permitted in � dwellings where the entire structure is protected throughout by an ORD. NO. 98-23 3 ,� ,� approved automatic sprinkler system. (2) As service-entrance cable. �� (10) In non-residential metal frame structures. (1) Article 555-1 is hereby amended to add 555-1.1., to read as follows: "555-1.1. Inspections. An inspection of all electrical wiring, ground connections, conduit, hangers, supports, connections, outlets, appliances, devices, and portable cables installed or used in a marina, boatyard, boat basin, boat houses, floating buildings or structures, or similar establishment shall be made at regular intervals in conjunction with and at the request of the Grapevine Lake Corps of Engineers to assure a complete inspection at least annually. All corroded, worn, broken or improper materials shall be replaced or repaired immediately. The use of tape to repair broken or cracked insulation of jackets on flexible cables or cords shall be prohibited. The inspection shall take particular notice of the following conditions, but is not limited to the following conditions, and corrective action shall be taken as appropriate: a. Areas being used for the purpose not originally contemplated and that introduce hazards greater than those for which the electrical system was ��� designed. �.� b. Locked or otherwise restricted areas or equipment being left open. c. The use of grounding-type portable electrical equipment that is not properly and adequately grounded. d. Special attention is to be given to shore power cable sets used by vessels for connection to shore power outlets. Shore power cable sets shall not be permitted to lie on or across pier walkways or to trail into the water. e. Flexible cords being used for purposes not in accordance with the Grapevine Electrical Code, i.e. used for permanent wiring. f. Damaged or inoperative switches, lighting fixtures, and receptacle outlets. g. Overloading of electrical circuits. (8) Article 680-70 is hereby amended to add 680-70.1, to read as follows: "680-70.1. Location of Ground-Fault Circuit-Interrupter. The ground-fault °��' circuit-interrupter shall be located in an adjacent closet or a ground-fault circuit-interrupter breaker shall be located in the electrical panel." ORD. NO. 98-23 4 � .� (9) Article 680-70 is hereby amended to add 680-70.2., to read as follows: "680-70.2. Bonding. Hydro-massage bathtub motor shall be bonded to the cold water metal piping system with a minimum of size No. 8 copper ,�,� conductor, or as recommended by manufacturers specifications." Section 2. That all ordinances or any parts thereof in conflict with the terms of this ordinance shall be and hereby are deemed repealed and of no force or effect. Section 3. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed two thousand dollars ($2,000.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 4. If any section, subsection, sentence, clause or phrase of this ordinance shall for any reason be held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance. Section 5. The fact that the present ordinances and regulations of the City of Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance shall become '""`" effective from and after the date of its passage, and it is accordingly so ordained. �•.m� PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, on this the 17th day of February , 1998.
