HomeMy WebLinkAboutORD 1994-021 �. _� ORDINANCE NO. 94-21 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, AMENDING THE CODE OF ORDINANCES OF THE CITY OF GRAPEVINE, TEXAS, BY AMENDING CERTAIN PROVISIONS OF CHAPTER 7, ARTICLE III THEREOF ENTITLED "ELECTRICAL CODE", BY ADOPTING AND AMENDING THE 1993 EDITION OF THE NATIONAL ELECTRICAL CODE; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1 . That Chapter 7, Article I11 entitled "Electrical Code" of The Code of Ordinances, City of Grapevine, Texas (the "City Code"), is hereby amended in the following particulars, and all other existing divisions, sections, subsections, "" � paragraphs, sentences, definitions, phrases and words of said City Code are not amended, but shall remain intact and are hereby ratified, verified and affirmed: �:.,� A. That definitions Approved, Registered, and Special Permission of Section 7-30 are hereby amended by deleting said definitions, in their entirety, and substituting in lieu thereof the following definitions which shall hereafter read as follows: "Approved: Acceptable to the Building Inspection Division and/or the Electrical Board of Appeals of the City." "Registered: When used with the words electrical, contractor, electrician, or the like shall mean that the person has made application to the Building Inspection Division and has satisfied the building official that he/she is qualified to do the work stated in the application, that he/she has paid the necessary registration fees to date, been issued a license, and that his/her name is carried in the records of the Building Inspection Division office as a person authorized to do electrical work for which he/she is registered or licensed as defined in this code." "Special Permissron: Written consent of the Building Inspection Division of the .� City." B. That Section 7-35 is hereby amended by deleting said Section 7-35, in its entirety, and substituting in lieu thereof the following Section 7-35, which Section 7-35 shall hereafter read as follows: "Section 7-35. Same - Applicability to federal government, state, county� "��' city and school district buildings and premises. � Buildings and premises owned and occupied by the federal government, state, county, and city shall be subject to the provisions of this code, but they shall be exempt from the payment of permit fees. This exemption shall be claimed in writing in each instance. School districts shall be required to remit only twenty-five (25) percent of the current fee schedule." C. That Section 7-39 is hereby amended by deleting said Section 7-39, in its entirety, and substituting in lieu thereof the following Section 7-39, which Section 7-39 shall hereafter read as follows: "Section 7-39. Same - A�pointment of subordinate inspectors. Electrical inspectors shall be appointed by the building official." D. That subsection (f) of Section 7-41 is hereby amended by deleting said subsection, in its entirety, and substituting in lieu thereof the following subsection (f), which subsection shall hereafter read as follows: "(f) Special Permission: The regulations of this code, which includes the "` `° National Electrical Code, may be modified or waived by special permission in specific cases where such modification or waiver is reasonable and does not �-T� differ from the intent of this code. Such permission shall in all cases be obtained from the chief electrical inspector an confirmed in writing. A copy of the permission shall be filed in the Building Inspection Division office." E. That paragraph (3) of subsection (a) of Section 7-43 is hereby amended by deleting said paragraph, in its entirety, and substituting in lieu thereof the following paragraph (3), which paragraph shall hereafter read as follows: "(3) The other three (3) members shall be members-at-large as appointed by the Grapevine City Council. Reference to the "board" shall mean the electrical board of appeals." F. That subsection (b) of Section 7-43 is hereby amended by deleting said subsection, in its entirety, and substituting in lieu thereof the following subsection (b), which subsection shall hereafter read as follows: "(b) Three (3) members of the board at any one meeting shall constitute a quorum. Recommendations or changes to this code will require the approval of a majority of the board present." � ORD. N0. 94-21 2 G. That subsections (a►, (b), and (c) of Section 7-44 are hereby amended by deleting � said subsections, in their entirety, and substituting in lieu thereof the following subsections (a), (b), and (c), which subsections shall hereafter read as follows: � "(a) The electrical board shall select a chairman and vice-chairman at the first meeting of each calendar year and shall prescribe a procedure and order of business for hearing appeals from the decisions of the chief electrical inspector. The decision of the board shall be final. (b) Electricians holding a currently valid license or certificate of registration from another city may apply for and receive a similar license or certificate of registration from this city without taking an examination provided the following conditions are complied with: (1 ) Applicant shall submit a reciprocal letter from the applicant's base city showing evidence satisfactory to the chief electrical inspector that his license or certificate of registration was issued under conditions not less restrictive than required by the City of Grapevine for issuance of a license, and that an electrician holding a license issued by this city would be permitted to apply and receive a similar type of license or certificate of registration in �-� such other city under reciprocal conditions. (2) An applicant shall pay the registration fee required and comply � � with all other requirements of this code. (c) Any person may file an appeal with the electrical board for a review of any decision of the chief electrical inspector, provided that such appeal is made in writing within five (5) days after such person shall have been notified of such decision by the electrical inspector. Upon receipt of such appeal the board shall proceed to determine whether the action of the chief electrical inspector complies with this code and within five (5) days shall make a decision in accordance with its findings. The decision of the electrical board shall be final." H. That Section 7-45 entitled "Same - Prescribing examinations; issuing certificates" is hereby repealed by deleting said Section 7-45 in its entirety, and furthermore said Section 7-45 is hereby reserved for future use. I. That subsections (a), (b), and (c) of Section 7-46 are hereby amended by deleting said subsections, in their entirety, and substituting in lieu thereof the following subsections (a�, (b�, and (cl, which subsections shall hereafter read as follows: �.� "(a) The electrical board shall keep minutes in which shall be recorded all transactions and business of the board. � ORD. N0. 94-21 3 �fN� (b) The minutes and other records shall be maintained in the Building Inspections Division office. �,, (c) The chief electrical inspector shall keep a record of all persons qualified to whom a license and certificate of registration has been issued, provided that he shall not be responsible for the record of any person whose registration has not been renewed and thereby lapsed for a period of two (2) years." J. That subsection (a) of Section 7-50 is hereby amended by deleting said subsection, in its entirety, and substituting in lieu thereof the following subsection (al, which subsection shall hereafter read as follows: "(a) It shall be unlawful for any person, as defined in Section 1-5, who is not licensed and registered as qualified electrician in accordance with the provisions of this code to engage in the business of electrical construction or to make any repairs, alterations, additions, or changes to any existing system of electrical conductors, wiring apparatus, or equipment within the city, except as provided in Sections 7-63 and 7-67." K. That Section 7-51 entitled "Term of temporary licenses" is hereby repealed by deleting said Section 7-51 in its entirety, and furthermore said Section 7-51 is hereby reserved forfuture use. L. That subsections (a), (b), (c1, (d), (e), (f), (g), and (h) of Section 7-53 are hereby �-� amended by deleting said subsections, in their entirety, and substituting in lieu thereof the following subsections (a), (b), (c), (d1, (e1, (f), and (g) which subsections shall hereafter read as follows: "(a) To secure a certificate of registration as a qualified and competent electrician in any of the classes set out in Section 7-52, an application shall be made out on forms available in the office of the Building Inspection Division. (b) Electricians holding a currently valid license or certificate of registration from another city may apply for and receiv� a similar license or certificate of registration from this city without taking an examination provided the conditions specified in Section 7-44(b) are complied with. (c) An electrical contractor may have laborers or apprentices on any of his jobs, but they must be under the direct supervision of a licensed master or journeyman electrician. (d) It shall be unlawful for any person holding a license to transfer same or ,,� allow the use of same, directly or indirectly by any other person for the purpose of obtaining a permit to do any electrical work therein specified. �. (e) Applicants for a certificate of registration as an electrical contractor, lighting maintenance contractor or elevator contractor shall file with the ORD. N0. 94-21 4 application an affidavit, setting forth the names of the persons who are the � � owners of the business or who are the officers of the firm who own the business, and the name and address of the person who shall be responsible for ,��, the business. (f) Applicants for master electricians' licenses shall appear in person before an approved testing agency as recognized by the Board and be examined as prescribed by an approved testing agency. (g) Any applicant who fulfills the requirements of this code and pays the required fees will be issued a license by the chief electrical inspector and registered in the records kept for that purpose." M. That subsections (a) and (c) and Table 1 of Section 7-54 is hereby amended by deleting said subsections and Table 1 , in their entirety, and substituting in lieu thereof the following subsections (a) and (c) and Table 1, which subsections and Table 1 shall hereafter read as follows: "(a) Fees for licenses as set out in Table 1 shall be payable at the building official's office. � M (c) The fees are as provided in the following table: TABLE 1 �,..�. LICENSE AND REGISTRATION FEES Annual license Classification upon registration Electrical contractor 575.00*' Lighting Maintenance contractor 75.00* Elevator contractor 75.00* Master electrician 25.00 Journeyman electrician 7.50 Maintenance electrician . 7.50 Specialist electrician 7.50 * If the registering contractor is also the master electrician, then no additional charge will be required.�� '� N. That subsections (a), and (b) of Section 7-55 are hereby amended by deleting said subsections, in their entirety, and substituting in lieu thereof the following subsections ,�,,, (a1, (b1, and new subsection (d) which subsections shall hereafter read as follows: ORD. N0. g4-21 5 ��� "(a) Every license or certificate of registration provided for in this code shall expire at midnight on December 31 st of the year it was issued, and shall be renewed by the chief electrical inspector upon request and payment of the ,�„ required fee, provided that if during the preceding year the applicant has been convicted of a violation of this code, it will be necessary for him to be re- examined by an approved testing agency recognized by the Board. (b) Should any license lapse more than thirty (30) days, the holder shall be considered a new applicant. (d) The registration of a contractor may be denied by the building official, or the registration may be revoked by the Board if the registration is issued on the basis of incorrect information supplied by the contractor." O. That Section 7-56 is hereby amended by deleting said Section 7-56, in its entirety, and substituting in lieu thereof the following Section 7-56 and subsection (a), which Section 7-56 and subsection (a) shall hereafter read as follows: "Section 7-56. Suspension or revocation of license. If the holder of an electrical license willfully violates any provision of this code or is incompetent to comply with such provisions, the building official may "�""m revoke or suspend a contractor's registration and/or license up to one (1) year. After one (1 � year revocation, the contractor may reapply for registration as a �� new contractor as set forth in Section 7-53. (a) In the event that a contractor wishes to appeal the decision of the building official for revocation or suspension, the contractor shall file a written notice in the office of the building official within ten (10) days of receipt of the notice for revocation or suspension. (1 ) A hearing shall be held before the electrical board of appeals after the contractor has been given notice of the hearing by personal service or certified mail, return receipt requested, at least ten (10) days prior to the hearing date. (2) After the hearing, the contractor shall be notified in writing of the determination of the electrical board of appeals by personal service or certified mail, return receipt requested." P. That subsection (b) of Section 7-57 is hereby amended by deleting said subsection, in its entirety, and substituting in lieu thereof the following subsection (b), ,�„�, which subsection shall hereafter read as follows: "(b) To secure a license as a qualified and competent electrician in any of the �� classes set out in this section, an application shall be made in writing on forms available in the Building Inspections Division office." ORD. N0. g4-21 6 �- ,� Q. That subsections (a), (b), (c), (d1, (e), (f), (g), (h), and li) of Section 7-58 are hereby amended by deleting said subsections, in their entirety, and substituting in lieu � thereof the following subsections (a), (b), (c1, (d), (e), (f), and (g) which subsections shall hereafter read as follows: "la) Any person holding an electrical contractor's license shall be a qualified master electrician. The master electrician shall be responsible for all work performed by employees, regardless if the master is present or not, as authorized by the electrical contractor. (b) Any person who has been appointed or employed as a master electrician by a registered electrical contractor shall register with the chief electrical inspector in writing on a form to be furnished by the Building Inspection Division office. (c) When an applicant has complied with the requirements of this code, the chief electrical inspector shall register him as a master electrician to a specific registered electrical contractor by placing his name on the contractor's registration certificate and by identification card issued to the registered master electrician. ""'� (d) The master electrician shall perform the work or supervise and direct the installation, alteration, repair and maintenance of electrical conductors and �Nx equipment authorized by permits issued under the authority of this code. The master electrician is responsible for all work performed, regardless if he is present for all work performed, for which he has been issued a permit, applied for a permit, or requires a permit by this code. (e) Whenever a master electrician shall leave or be discharged from the employ of any person who is required by this code to appoint or employ a master electrician, a notice in writing thereof shall be given immediately by both the employer and the master electrician to the chief electrical inspector's office, and the permit privileges of such person shall without further order or action stand suspended until the employment or appointment and qualifying of another master electrician as provided for in this code. (f1 No master electrician shall be permitted to use his certificate of registration in order to qualify more than one electrical contractor's license at any time. (g) It shall be unlawful for any master electrician to permit his name to be used or to knowingly permit himself to be held out as the officer or employee in a supervisory capacity of any person holding an electrical contractor's certificate unless he is in fact an officer or employee and does in fact supervise the installation of electrical work performed by such persons." � ORD. N0. 94-21 7 �..,, R. That subsections (a), (b) and (c) of Section 7-59 are hereby amended by deleting said subsections, in its entirety, and substituting in lieu thereof the following subsections (a) and (b), which subsections shall hereafter read as follows: �.� "(a) A journeyman electrician's license shall entitle the holder thereof to engage himself in the employ of any person registered under the provisions of this code; provided, however, a journeyman's license has been issued by the Building Inspection Division office. Ib) A license shall be issued to each registered journeyman electrician." S. That subsection (a) of Section 7-60 is hereby amended by deleting said subsection, in its entirety, and substituting in lieu thereof the following subsection (a), which subsection shall hereafter read as follows: "(a) Applicant must apply for a license as a maintenance electrician." T. That subsections (a1, (b) and (c) of Section 7-61 are hereby amended by deleting said subsections, in their entirety, and substituting in lieu thereof the following subsections (a) and (b), which subsections shall hereafter read as follows: "(a) Applicant may be a registered master electrician or may apply for a �` " certificate of registration as a specialist electrician in one of the following classes: �� (1 � Master Sign electrician (2) Journeyman Sign electrician (3) Elevator electrician (4) Residential Wireman electrician (b) A specialist electrician's license shall entitle the holder thereof to engage himself in the employ of any person holding a license to do the work for which the specialist has been qualified." U. That subsections (b) and (c) of Section 7-73 are hereby amended by deleting said subsections, in their entirety, and substituting in lieu thereof the following subsections (b) and (cl, which subsections shall hereafter read as follows: "(b) The Building Inspection Division shall keep complete records of all permits issued and inspections made and other official work performed under the requirements of this code. � (c) The applicant for a permit shall represent that the statements contained in said application are true and correct and any misrepresentation or false statements thereon shall be grounds for revocation of the applicant's license � ORD. N0. 94-21 $ �; w and cancellation of the permit issued. The work indicated on the application shall be performed only by the applicant and no other person shall perform any of the electrical work shown on the application." �� V. That Section 7-79 is hereby amended by deleting said Section 7-79, in its entirety, and substituting in lieu thereof the following Section 7-79, which Section 7-79 shall hereafter read as follows: "Section 7-79. Lapse of permits. Each specific permit issued by the Building Inspection Division under the provisions of this code shall expire by limitation and become null and void if the work authorized by such permit has not been started within six (6) months from the date of the issuance of such permit, or if the work authorized by such permit is suspended or abandoned at any time for a period of six (6) months after the work is started. Before such work can be started again, a new permit shall be obtained." W. That paragraph (6) of subsection (a) and subsections (b) and (c) of Section 7-81 are hereby amended by deleting said subsections, in their entirety, and substituting in lieu thereof the following paragraph (6) of subsection (a) and subsections (b) and � ., (c), which subsections shall hereafter read as follows: "(6) Mobile Home Service: 525.00 �-�� Temporary Pole Service: 525.00 Service Change: 525.00 (b) Reinspection: Any inspection called for that is not ready when called, when the inspector is not provided proper access to the work or the same violation exists when recalled, a thirty dollar (530.00) reinspection fee will be charged. (c) Minimum for unscheduled inspection: For any inspection not herein prescribed, a minimum charge may be made at thirty dollars (530.00) per hour with a minimum of a two (2) hour charge." X. That subsections (a), (b), and (c) of Section 7-91 are hereby amended by deleting said subsections, in their entirety, and substituting in lieu thereof the following subsections (a1, (b), and (c), which subsections shall hereafter read as follows: "(a) There is hereby adopted by the City of Grapevine, Texas, for the purpose of prescribing regulations, governing conditions hazardous to life and property, ,�, that certain 1993 Edition of the National Electrical Code, with the exception of such sections thereof as are hereinafter deleted, modified or amended, and the same is hereby adopted and incorporated herein as if the same were copied in �.,,. its entirety, and from the date on which this section shall take effect, the provisions thereof shall be controlling within the limits of the city with ORD. N0. 94-21 g �;,� amendments as herein noted in section 7-97. This article titled "Article III. Electrical Code:, its contents, the 1993 Edition of the National Electrical Code, and the amendments as herein noted in section 7-97 shall be known as the ,�, "Grapevine Electrical Code," and a copy of said code shall be maintained in the office of the city secretary. (b) The building official, or his designee, is hereby authorized and directed to enforce all the provisions of this code. For such purpose, he shall have the power of a law enforcement officer. (c) Any person violating any of the terms or provisions of the Grapevine Electrical Code shall be subject to punishment as provided in section 1-6 of the Code of Ordinances, and in this article." Y. That Section 7-95 is hereby amended by deleting said Section 7-95, in its entirety, and substituting in lieu thereof the following Section 7-95, which Section 7-95 shall hereafter read as follows: "Section 7-95. Same - Service poles. Temporary service on poles for construction purposes shall be adequately braced, safely constructed, and electrically grounded. It is the responsibility of �`"" the authorized electrical supplierto inspect and approve temporary service poles prior to connection of the power. Specifications for temporary poles may be �•� obtained from authorized electrical supplier or from the Building Inspection Division office." Z. That Section 7-97 entitled "Amendments to National Electrical Code" is hereby amended by deleting said Section, in its entirety, and substituting in lieu thereof the following Section 7-97, which Section shall hereafter read as follows: "Section 7-97. Amendments to National Electrical Code. The following are amendments to the 1993 Edition of the National Electrical Code: (1 ) Article 210-1 is hereby amended to add 210-1 .1 ., to read as follows: " 210-1 .1 . Bathtubs and shower areas. Conductors run around and by the bathtub and shower areas shall be installed below the bathtub or in an approved raceway." (2) Article 230-71 (a) is hereby amended to read as follows: "(a) �„� General. The service disconnecting means for each service permitted by Section 230-2, or for each set of service-entrance conductors permitted by Section 230-40, Exception No. 1, shall � consist of not more than six switches or six circuit breakers mounted in a single enclosure, in a group of separate enclosures, ORD. N0. g4-21 10 �.,� or in or on a switchboard. There shall be no more than six disconnects per meter grouped in any one location." � (3) Article 230-2 is hereby amended to add Exception No. 8 to read as follows: "Exception No. 8: For Single-Family Lots. There shall be only one meter per single-family lot as zoned by the City of Grapevine and as described by the Grapevine Comprehensive Zoning Ordinance. By special permission, a second meter may be requested for a single-family lot and shall be in writing to the building official stating the reason(s)a second meter is necessary. A permit mistakenly issued for a second meter without written consent of the building official is immediately null and void." (4) Table 290-94 is hereby amended to delete all Aluminum or Copper-Clad Aluminum grounding electrode conductors. (5) Article 310-14 is hereby amended in its entirety to read as follows: "There shall be no aluminum wire on the load side of the service meter smaller than No. 1/0." (6) Article 348-1 second paragraph is hereby deleted in its entirety. '� � (7) Article 555-1 is hereby amended to add 555-1 .1 ., to read as follows: "555-1 .1 . Inspections. An inspection of all electrical °�_ � wiring, ground connections, conduit, hangers, supports, connections, outlets, appliances, devices, and portable cables installed or used in a marina, boatyard, boat basin, boat houses, floating buildings or structures, or similar establishment shall be made at regular intervals in conjunction with and at the request of the Grapevine Lake Corps of Engineers to assure a complete inspection at least annually. All corroded, worn, broken or improper materials shall be replaced or repaired immediately. The use of tape to repair broken or cracked insulation of jackets on flexible cables or cords shall be prohibited. The inspection shall take particular notice of the following conditions, but is not limited to the following conditions, and corrective action shall be taken as appropriate: (a) Areas being used for the purpose not originally contemplated and that introduce hazards greater than those for which the electrical system was designed. �� (b) Locked or otherwise restricted areas or equipment being left open. � ORD. N0. g4-21 11 (c) The use of grounding-type portable electrical equipment that is not properly and adequately grounded. �� (d) Special attention is to be given to shore power cable sets used by vessels for connection to shore power outlets. Shore power cable sets shall not be permitted to lie on or across pier walkways or to trail into the water. (e) Flexible cords being used for purposes not in accordance with the Grapevine Electrical Code, i.e. used for permanent wiring. (f► Damaged or inoperative switches, lighting fixtures, and receptacle outlets. (g) Overloading of electrical circuits." (8) Article 680-70 is hereby amended to add 680-70.1 ., to read as follows: "680-70.1 . Location of Ground-Fault Circuit-Interrupter. The ground-fault circuit-interrupter shall be located in an adjacent �'`"° closet or a ground-fault circuit-interrupter breaker shall be located in the electrical panel." � (9) Article 680-70 is hereby amended to add 680-70.2., to read as follows: "680-70.2. Bonding. Hydro-massage bathtub motor shall be bonded to the cold water metal piping system with a minimum of size #8 copper conductor, or as recommended by manufacturers specifications." AA. That Section 7-103 is hereby amended by deleting said Section 7-103, in its entirety, and substituting in lieu thereof the following Section 7-103, which Section 7-103 shall hereafter read as follows: "Section 7-103. Inspection of new commercial and industrial buildinqs. The building official may be called as many times as necessary to inspect portions of new commercial and industrial buildings in the course of construction upon request, in order not to delay construction, and must inspect such work within forty-eight (48) hours from the time notice is received, Saturdays, Sundays and holidays excepted." �� � ORD. N0. 94-21 � 2 �.. � Section 2. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstance is held invalid or ,�, unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of this ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 3. The fact that the present ordinances and regulations of the City of Grapevine, Texas do not adequately regulate the traffic within the City creates an emergency and the preservation of the public health, safety, and welfare requires that this ordinance take effect immediately from and after the date of its passage.
