HomeMy WebLinkAboutORD 1992-016 ORDINANCE NO. 92-16 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS CANVASSING RETURNS AND DECLARING THE RESULTS OF A BOND ELECTION HELD IN SAID CITY ON TH� 28TH DAY OF MARCH, 1992; DECLARING AN EMERGENCY; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City Council of the City of Grapevine, Texas by ordinance duly passed and adopted, made provision for an election to be held within the City on the 28th day of March 1992 (the "Election") , for the purpose of submitting certain propositions for the issuance of general obligation bonds to the resident, qualified voters of the City; and WHEREAS, this City Council has investigated all matters pertaining to the Election, including the ordering, giving notice, appointing officers, holding and making returns of the Election; the election officers who held the Election have duly made the returns of the results thereof; and said returns have been duly delivered to this City Council for official canvassing of the returns thereof; and WHEREAS, upon consideration of the returns of the Election, it appears that the Election was held in accordance with the authorized proceedings and was in all respects legally held after proper notice had been given, and that the said returns were duly and legally made, showing the following results: PROPOSITION NO. 1 THE ISSUANCE OF $18, 600, 000 GENERAL OBLIGATION STREET IMPROVEMENT BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF: VOTES FOR: 1161 VOTES AGAINST: 833 PROPOSITION NO. 2 THE ISSUANCE OF $600, 000 GENERAL OBLIGATION FIRE STATION AND TRAINING FACILITIES BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF: VOTES FOR: 1521 VOTES AGAINST: 463 � PROPOSITION NO. 3 THE ISSUANCE OF $4, 500, 000 GENERAL OBLIGATION CITY HALL FACILITIES BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF: VOTES FOR: 915 VOTES AGAINST: 1066 PROPOSITION NO. 4 THE ISSUANCE OF $600, 000 GENERAL OBLIGATION PARK AND RECREATIONAL FACILITIES BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF: VOTES FOR: 1262 VOTES AGAINST: 732 NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. All of the recitals contained in the preambles of this Ordinance are found to be true and are adopted as findings of fact by this governing body and as part of its official record. Section 2 . It is further found and determined that the results of the Election as canvassed and tabulated in the preambles hereof reflect the expressed desires of the resident, qualified voters of the City. Section 3 . Based upon the results of the Election, the City Council finds, determines, and declares the following to be the official results of the Election: Proposition Nos. 1, 2 and 4 have received a favorable vote of the majority of the resident, qualified voters participating in the Election and the City Council may issue bonds thereunder in accordance with law. Proposition No. 3 has not received a favorable vote of the majority of the resident, qualified voters participating in the Election. .�:�$ Section 4. As a result of this canvass, the City Council hereby finds and determines that a total of 1996 persons voted in the Election. _�.,,:� 2 Section 5. That the public importance of this Ordinance and the fact that it is in the best interest of the City to provide for the canvass of the returns of the City's special election on the earliest possible date constitutes an emergency and creates a necessity for the immediate preservation of the public peace, property, health and safety of the citizens of the City, requiring that this Ordinance be passed and take effect as an emergency measure, and it is accordingly ordained that this Ordinance shall be in full force and effect from and after its passage in accordance with the Charter of the City. Boyle, Jr City Attorney ��..:,� 3 _ _ �.,. , MINUTES AND CERTIFICATION � THE STATE OF TEXAS � �:=-f COUNTY OF TARRANT � ' CZTY OF GRAPEVINE § On the 30th day of March, 1992 , the City Council of the City of Grapevine, Texas , convened in a regular meeting at the regular meeting place thereof , the meeting being open to the public and notice of said meeting, giving the date, place and subject thereof , having been posted as prescribed �by Vernon ' s Texas Revised Civil Statutes Annotated, Article 6252-�7 , as amended, and the roll was called of the duly constituted officers and members of the City Council , which officers and members are as follows, to wit : William D. Tate Mayor Ted R. Ware Mayor Pro Tem Sharron Spencer Councilmember C. Shane Wilbanks Councilmember Gil Traverse Councilmember Jerry L. Pittman Councilmember Will Wickman Councilmember and all of said persons were present, except the following �w absentee(s) : Jerry L. Pittman , thus constituting a quorum. Whereupon, among other business , a �;,� written ordinance bearing the following caption was introduced at said meeting : An Ordinance of the City Council of the City of Grapevine, Texas , Canvassing Returns and Declaring the Results of a Bond Election Held in said City on the 28th day of March, 1992 ; Declaring an Emergency The Ordinance, a full , true and correct copy of which is attached hereto, was read and reviewed by the City Council . Thereupon, it was moved by Member Spencer and seconded by Member Wilbanks that the Ordinance be finally passed and adopted.
