1. Please add case number CU11-22, the case name and address to
signature block found on all each sheets.
2. Please replace the existing request note with the following notes to the
master site plan and dimension control site plan:
a) Conditional use request, CU 11-22 is a request to amend the
previously approved site plan of CU03-02 SPRC, CU93-05 (Ord.
93-29) for a planned commercial center, specifically to allow the
possession, storage, retail sale and off -premise consumption of
alcoholic beverages (beer and wine only) outside dining and
outside speakers in conjunction with the development of a 10,931
square foot market/bakery.
b) The entire site is the premise.
3. Please provide a dimension control site plan which shows the
distance to the property lines of the existing building, new vestibule
and outside dining areas.
4. Please add the following note to the face of the site plan: All on
site electrical conductors associated with new construction
shall be located underground.
5. Please contact Dewey Stoffels of Environmental Services at (817)
410-3389 regarding recycling storage areas.
6. Please provide a site data table on the dimension control site plan
sheet in a chart format showing the amount required and provided:
height in stories and feet, total building area, total open space
(landscaped area), total building, paved areas, total parking
provided including accessible parking spaces. Please verify that
the existing parking shown on the survey and the undisturbed future
parking is consistent. Planning staff's count of the available parking
is 144 spaces, the site plan shows 156 and the master site plan has
155. Please verify the proposed parking count is contained within
Lot 3R1.
7. Please label the adjacent zoning on the dimension control site plan
to the plan north, east and south as "CC" Community Commercial.
8. Please provide a graphic scale in addition to the numeric scale on
the dimension control site plan and floor plan.
9. Please note on the site plan that lighting levels at the property lines,
including the lighted sign may not exceed 3.0 footcandles. Please
provide an elevation of the light fixtures. Also add the following note to the
site plan:
• The sign was included in the determination of the illumination
levels.
10. Please note the following Fire Department comments. Please
direct all questions regarding the following comments to
Randie Frisinger or Craig Reed at 817.410.8100:
• The building requires fire sprinkling for fire protection.
• Show fire lanes on this site plan. A fire lane is required from the
driveway intersecting with SH -114 east to the common drive for the
whole development (near Jason's Deli). A fire lane also needs to
run along the west side of the building, running north from the
previously mentioned (east -west) fire lane, turning east to the
common access drive along the north side of the building.
• A preliminary utility plan will be needed if a fire sprinkler system is
to be installed. Show fire hydrants on the site. A Fire Hydrant
Connection (FDC) is needed within 150 -feet of a hydrant and 25 -
feet of a fire lane.
11. Please verify the dimensions of the proposed pole sign. The
dimensions shown are in excess of 288 -square feet listed.
12. Please verify the building area to insure the area shown is
consistent throughout all documents.
13. Please provide a ghosted elevation which insures that if rooftop
mechanical equipment is proposed that it will be screened from
public view.
14. Please provide an elevation and the material used for screening,
including the gate of the refuse storage area.
15. Please provide a dimensioned (of the perimeter) floor plan and
lightly hatch the alcohol storage/display area(s), and point of sale
location(s). The floor plan text should be clearly legible on an 11" x
17" reduction.
16. Please provide a seating chart, area calculation chart and occupancy
calculation.
17. Please provide information in layman's terms regarding the sound
level and the purpose of the proposed outdoor speakers.
18. Please include an internal traffic circulation plan on the dimension
control site plan.
19. For verification purposes please email a PDF of the final plans to
tripltt _rapevinetas._ ov prior to producing the final copies.

The above comments must be reflected in the revised submittal,
which is due by Tuesday, July 26th at 12:00 p.m. for the August 16th
public hearing. Please submit the revised documents to the Department
of Development Services at 200 South Main Street.
The revised submittal shall include:
one (1) mylar (uncolored) of each sheet (minimum size 22" x 34")
one (1) colored version of a rendered landscape plan (absent text) on 11"
x 17" or a digital version of the same
two (2) folded blackline copies of each sheet, (minimum size 22" x 34")
forty (40) reduced sorted (collated sets) copies at 11" x 17" three hole
punched, stapled and z -folded (fold the right edge to the left edge
and then fold the right edge in half to form a z -fold).
If these revisions are made and submitted at the correct time, you will be
scheduled for the next available agenda.

On Tuesday evening, August 16, 2011 at 7:30 P.M. in the City Council Chambers, 2nd
Floor, 200 South Main Street, Grapevine, Texas, the City Council and Planning and Zoning
Commission of the City of Grapevine will hold a public hearing to consider the following
items:
Z11-05 & CU11-20 — Esparza's - submitted Sun Coast Architects for property located at
124 & 204 East Worth Street and proposed to be platted as Lots 2RA and 3R, Block 32,
City of Grapevine Addition. The applicant is requesting to rezone approximately 0.2 acres
from R-7.5 Single Family Residential to CBD Central Business District and a conditional
use permit to allow outside dining in conjunction with a restaurant. The property is zoned
CBD Central Business District and is owned by EZB Restaurants.
CU11-21 — Grapevine Station - submitted by North American Properties for property
located at 1024 Texan Trail and platted as Lots 1-7, Block 1, Lots 1 RA & 2A, Block 2A,
Lots 2 & 3, Block 3, Lot 3, Block 4, Grapevine Station Addition. The applicant is requesting
a conditional use permit to eliminate 5.85 acres from the planned business park
designation. The property is zoned BP Business Park and is owned by multiple owners.
CU11-22 — EatZi's - submitted by EBG, LLC for property located at 1200 West State
Highway 114 and platted as Lot 3R1, Block 1, Towne Center Addition. The applicant is
requesting a conditional use permit to allow the possession, storage, retail sale and off -
premise consumption of alcoholic beverages (beer, and wine only) outdoor dining and
outdoor speakers in conjunction with a market and bakery. The property is currently zoned
CC Community Commercial and is owned by AJL Equity LLC.
CU11-23 — Towers of Grapevine - submitted by Ball Street Joint Venture for property
located at 1293 William D Tate Avenue and proposed to be platted as Lot 1 R2R-1 R, Block
1, Hayley Addition. The applicant is requesting a conditional use permit to revise lot lines
and allow a drive-thru restaurant with outdoor speakers. The property is zoned HC
Highway Commercial and is owned by Tate Street Joint Venture, R Koenigseder IV Family
LP, Ball Street Joint Venture and Grapevine Towers, Ltd.
Z11-03, CU11-24 & PD1 1-04 — Residences at Grapevine Station - submitted by North
American Properties for property located at 1022 Texan Trail and proposed to be platted
as Lot 2R, Block 4, Grapevine Station Addition. The applicant is requesting to rezone

10. 16 acres from BP Business Park District & CC Community Commercial District to R -MF -
2 Multifamily District for the development of a 3 -story apartment complex. The applicant is
also requesting conditional use permit for density, height, open space, front yard setback,
parking and a planned development to include but not be limited to deviation the density,
height, open space, parking, front yard setback, landscape buffer, length of buildings,
building articulation, accessory uses between building line and property line. The property
is currently zoned BP Business Park and CC Community Commercial and is owned by
Triple T Farms.
AMI 1-05 AMENDMENTS TO COMPREHENSIVE ZONING ORDINANCE 82-73 - The City
Council and the Commission will consider amendments and changes to the
Comprehensive Zoning Ordinance, No. 82-73, same being Appendix D of the Code of
Ordinances as follows: Section 52, Tree Preservation relative to tree preservation and any
other additions, deletions, or changes to various sections, articles and provisions contained
in said Ordinance No. 82-73.
After all parties have been given an opportunity to speak, the public hearing will be closed
and the Commission and the City Council will deliberate the pending matters. Please

REQUESTED CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to amend the previously approved site
plan of, CU93-05 (Ord. 93-29) for a planned commercial center, specifically to allow the
possession, storage, retail sale and off -premise consumption of alcoholic beverages (beer,
and wine only) outdoor dining, a 40 -foot pole sign and outdoor speakers in coniunction with
a market and bake
The applicant intends to utilize an existing building formerly occupied by Luby's Cafeteria
for a new 10,873 -square foot market and bakery. Three seating areas are proposed for
119 patrons -19 -seats inside and 96 -seats outdoors. Total parking required for the use is 82
spaces; 152 are provided.
In addition, the applicant proposes changes to the exterior elevations which include a new

vestibule with an arched exterior canopy, stucco exterior walls, four speakers within two
covered outdoor dining areas and three faux chimneys. The former pole sign is proposed
to be replaced with a new 40 -foot pole sign totaling 287 -square feet. The planned
commercial center is currently served by 11 monument signs, five multi -tenant pylon signs
and three pole signs along three street frontages. Including the proposed sign, four
pylon/pole signs will be present along State Highway 114.
PRESENT ZONING AND USE:
The property is currently zoned "CC" Community Commercial District with a Planned
Commercial Center designation.
HISTORY OF TRACT AND SURROUNDING AREA:
The subject property was zoned "C-2" Community Business District prior to the 1984 City
Rezoning. The tract was platted as the Towne Center Addition in 1986. The addition was
replatted twice in 1989. Conditional Use Permit CU89-15 for a Planned Commercial
Center to be developed as four lots with three restaurants (Luby's, Arby's and International
House of Pancakes) and one retail center was approved in 1989. A one-year extension of
CU99-15 was approved in December 1990. CU91-19 for both a Jack in the Box
Restaurant and an amendment to the approved site plan of Luby's Cafeteria was approved
in 1991. CU93-05, approved in 1993, again amended the approved site plan and sign for
Luby's Cafeteria. CU95-02 (Ord. No. 95-10) was approved in February, 1995, allowing the
possession, storage, retail sale and on -premise consumption of alcoholic beverages (beer
and wine only) in conjunction with an existing restaurant for Jason's Deli.
The Towne Center Addition II which contains 62.47 acres, was rezoned in 1992 (Z92-09
and CU92-23) from "PCD" Planned Commerce Development District to "CC" Community
Commercial District with a conditional use permit for a planned commercial center which
brought forward the development of the Target store. In 1994, the site plan was amended
to include Ross Dress for Less, Barnes and Noble, Famous Footwear, and Showcase
Hallmark (CU94-31, Ord. No. 94-100). In 1995 the master site plan was amended again to
allow for the development of Linens N' Things on Lot 4R-1 with Mattress Giant and
Chesapeake Bagel on Lot 5 (CU95-16). In 1996, the site plan was modified to develop
retail space for Barbecue's Galore and Coleman Spas on Lot 9 (CU96-20), Office Depot
and Cost Plus on Lot 6R (CU96-29), and a 20,000 square foot retail building on Lot 7 that
houses Chuck's Hamburgers, Haltom's Jewelers, and Busybody Home Fitness (CU96-36).
CU99-06 allowed the development of a 6,581 square foot restaurant (Mimi's Caf6) with the
possession, storage, retail sale, and on -premise consumption of alcoholic beverages (beer,
wine, and mixed drinks) along with an attached 3,295 square foot retail building. CU99-57
was approved in November 1999, allowing outdoor seating at Jason's Deli. Conditional
Use Request C000-11 (Ord. 00-34) was approved at the March 28, 2000 meeting which
allowed for a bank with drive-through service. In addition a 50 -foot landscape buffer was
approved with the request around the remainder of the undeveloped portion of the Towne
Center Addition including the bank site to bring the entire planned commercial center into
compliance with the landscaping requirements. The Site Plan Review Committee approved

CU03-01 in March 2003, allowing the placement of a pole sign for Haltom's Jewelers. The
Site Plan Review Committee also approved CU03-02 in March 2003, permitting a revision
of the Luby's Restaurant pole sign. At the August 19, 2003 meeting, Council approved a
conditional use request (CU03-26) for modifications to the site plan for the Target retail

(Ord. 98-07) was approved at the March 24, 2009 meeting to allow gasoline sales and
alcohol sales for off -premise consumption (beer and wine) and two monument signs in
conjunction with a 4,902 square foot convenience store. At the June 15, 2010 meeting
conditional use permit CU10-13 (Ord. 2010-28) for a monument sign and to allow the
possession, storage, retail sales and on -premise consumption of alcoholic beverages
(beer, wine and mixed beverages) along with SU10-05 (Ord. 2010-29) to allow for the use
of one billiard table in conjunction with a restaurant were both approved. Conditional Use
Request CU 10-30 (Ord. 11-01) was approved at the January 18, 2011 meeting to allow
outdoor dining in conjunction with a restaurant. Conditional Use Request CU10-34 (Ord.
11-04) was approved at the January 18, 2011 meeting to a multi -tenant monument sign.

This letter is to verify that your request for a conditional use permit located at 1200 West State
Highway 114 and platted as Lot 2, Block 1, Bank of the West Addition, to amend the previously
approved site plan of, CU93-05 (Ord. 93-29) for a planned commercial center, specifically to allow
the possession, storage, retail sale and off -premise consumption of alcoholic beverages (beer, and
wine only) outdoor dining, a 40 -foot pole sign and outdoor speakers in conjunction with a market
and bakery was approved by City Council on August 16, 2011. A copy of the approved site plan
and Ordinance 2011-40 is enclosed.
On August 16, 2011, the Planning and Zoning Commission recommended the City Council approve
the request.
Any changes to a site plan approved with a conditional use or a special use (no matter how
minor or major) can only be approved by city council through the public hearing process,
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date on
which the City Council grants the Conditional Use, unless within such one (1) year period: (1) a
Building Permit is obtained and the erection or alteration of a structure is started, or (2) an
Occupancy Permit is obtained and a use commenced.
The City Council may grant one additional extension not exceeding one (1) year, upon written
application, without notice or hearing. No additional extension shall be granted without complying
with the notice and hearing requirements for an initial application for a Conditional Use Permit.

EBG, LLC (d.b.a. eatZi's Market & Bakery) has submitted a Conditional Use
Application/Site Plan Application to the City of Grapevine. As part of thearo application
process, we submit a brief summary of our proposed conditional use of the property at
1200 E. State Highway, Grapevine, TX.
eatZi's Market & Bakery is a European -style eatery, specializing in chef -crafted prepared
foods, breads and pastries, and custom made sandwiches, salads, and grill specials. Also
included are non-alcoholic beverages, wine and beer (sold for off -premise consumption).
On-site seating is available, though limited.
With projected sales of $12 million per year, eatZi's will create approximately 150 — 175
jobs for the local economy. It will also attract approximately 2000 — 2500 guests per day,
increasing consumer traffic for the surrounding retail area.
eatZi's will lease a pre-existing location previously occupied by a restaurant. Though
structural changes will be made to accommodate the eatZi's market footprint, we will
basically assume the existing structure. Therefore no significant changes are expected to
be made to the external dimensions of the building or parking area.
Upon approval of this application, eatZi's will immediately begin construction. We
anticipate an opening date of March 2012. We appreciate the opportunity to share in the
development and success of the City of Grapevine. Thank you for your consideration
