placed on the agenda for public hearing at the discretion of the staff. Based on the size of the
agenda, your application may be scheduled to a later date.
All public hearings will be opened and testimony given by applicants and interested citizenry. Public
hearings may be continued to the next public hearing. Public hearings will not be tabled.
Any changes to a site plan (no matter how minor or major) approved with a conditional use or a
special use permit can only be approved by city council through the public hearing process.
Any application for a change in zoning or for an amendment to the zoning ordinance shall have,
from the date of submittal, a period of four months to request and be scheduled on an agenda

Staff recommends the Site Plan Review Committee consider the proposed changes to
Conditional Use Request CU94-12 (Ord. 94-48) approved at the June 21, 1994 meeting
for a planned commercial center to allow the possession, storage, retail sale and on -
premise consumption of alcoholic beverages (beer, wine, and mixed beverages) in
conjunction with a restaurant, specifically to allow modifications to the exterior
elevations and floor plan, and take any other action necessary.
BACKGROUND INFORMATION
Conditional Use Request CU94-12 was considered and approved by Council at their
June 21, 1994 meeting to allow for on -premise alcohol beverage sales and consumption
in conjunction with a restaurant.
On August 25, 2005 the Site Plan Review Committee approved Conditional Use
Request CU05-53, specifically to make a small patio enlargement near the northeast
corner of the structure to seat approximately 91 patrons: total seating count proposed
was 282 seats.
With this request the applicant proposes minor exterior and floor plan renovations to
enhance customer circulation and convenience. Exterior changes include adding four
TV monitors and two speakers to the outdoor patio, extending an existing patio cover
and converting existing windows on the patio to doors. Floor plan modifications include
adding a door to the north elevation, close to the main entrance to provide an additional
access to the patio along with revised seating configurations. The revised floor plan will
seat 281 patrons -203 seats inside and 78 seats outdoors requiring 94 parking spaces;
95 are provided. This building, previously occupied by Tony Roma's restaurant is home
to Flip's, Patio Grill.

This letter is to verify that your request for a conditional use permit located at 415 West State
Highway 114 and platted as Lot 4, Block 6, Metroplace 2nd Installment, to amend the previously
approved site plan of CU94-12 (Ord. 94-48) for a planned commercial center to allow the
possession, storage, retail sale and on -premise consumption of alcoholic beverages (beer, wine
and mixed beverages) in conjunction with a restaurant, specifically to allow modifications to the
exterior elevations and floor plan was approved by the Site Plan Review Committee on October 2,
2013. A copy of the approved site plan is enclosed.
Any changes to a site plan approved with a conditional use or a special use (no matter how
minor or major) can only be approved by city council through the public hearing process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date on
which the City Council grants the Conditional Use, unless within such one (1) year period: (1) a
Building Permit is obtained and the erection or alteration of a structure is started, or (2) an
Occupancy Permit is obtained and a use commenced.
The City Council may grant one additional extension not exceeding one (1) year, upon written
application, without notice or hearing. No additional extension shall be granted without complying
with the notice and hearing requirements for an initial application for a Conditional Use Permit.

Dear Planning & Zoning Staff:
Please consider this formal request for a Conditional Use for Alcohol Sales / Outdoor
Dining for the existing Flips Patio Grill located at 415 W State Highway 114, to replace
the CU issued in 2005 (CU05-53).
As part of their remodel scope of work, Flips Patio Grill plans to extend a portion of the
roof over the outdoor patio space, install doors in place of existing windows and replace
some picnic tables and booth seating with tables and chairs. The new proposed floor plan
does not exceed the maximum 282 seats allowed, per the existing parking spaces
provided. The overall areas of Alcohol Consumption, Sales and Storage are not changing.
We do not anticipate that this modification will cause any harm to the value, use or
enjoyment of other property in the area and expect that it will continue to add value, use
and enjoyment to the surrounding development.
