All Planned Development Overlay Requests are assumed to be complete when filed and will be
placed on the agenda for public hearing at the discretion of staff. Based on the size of the
agenda, your application may be scheduled to a later date.
All public hearings will be opened and testimony given by applicants and interested citizenry.
Public hearings may be continued to the next public hearing. Public hearings will not be tabled.
Any changes to a site plan set approved with a planned development overlay request can only
be approved by City Council through the public hearing process.
Any application for a change in zoning or for an amendment to the zoning ordinance shall have,
from the date of submittal, a period of four months to request and be scheduled on an agenda
before the Planning and Zoning Commission and City Council. If after said period of four months
an application has not been scheduled before the Commission and Council said application
shall be considered withdrawn, with forfeiture of all filing fees. The application, along with the
required llllng 'fee may be resubmitted any time thereafter for reconsideration. Delays In scheduling appllcatlons before the Planning and Zoning Commission and City Council created
by city staff shall not be considered a part of the four-month period.

08) to allow the possession, storage, retail sale of on and off premise consumption of alcoholic

applicant is also requesting a planned development overlay (PD24-02) to deviate from, but not be
limited to required parking from Section 56, Off-Street Parking Requirements of the

has “1,832 SF”. The site data table has “1,829 SF” and the parking table has “1,819 SF”.
R eview and revise accordingly.
• Add/ Correct Title Block (see below) and Signature Block to each sheet of plan set in the lower
right-hand corner.
• Number each sheet consecutively within the signature block (Sheet 1 of 3, 2 of 3, etc.).
• Correct the case number in the signature block on each sheet.
• Correct the zoning on each sheet – the zoning is “HC”, Highway Commercial District, not CN.
• Add the following purpose statement to each sheet:
o “The purpose of CU24-08 is to allow for the possession, storage, retail sales of on- and

GROUND LEASE
WHEREAS, the City of Grapevine, hereinafter referred to as Lessee, a
home rule city situated in Tarrant County, Texas is in need of space for public
parking.
WHEREAS, KC Kingdom Perspective, LLC, hereinafter referred to as
Lessor, is the owner of a tract of land situated at the intersection of Northwest
Highway and Main Street (northeast comer) and which tract is depicted in Exhibit
A', attached hereto and incorporated herein (the "Leased Property"), and is
agreeable to entering into this Ground Lease (the "Lease") with the City of
Grapevine, (Lessee).
NOW, THERFORE, Lessor does hereby for and in consideration of the
rents, covenants and promises herein contained to be kept, performed and
observed by Lessee does hereby lease and demise to Lessee and Lessee does
hereby rent and accept from Lessor, the Leased Property.
I. TERM
This term of this Lease shall be for twenty (20) years beginning February
2022, and shall be renewable additional ten (10) year extensions upon
mutual agreement of the parties.
This Lease is a right appurtenant to the Leased Property, is binding upon,
and inures to the benefit of Lessor, Lessee, and their respective successor(s)
and assign(s).
11. RENT
Lessee shall not be obligated to pay an annual or monthly rental on said
Leased Property. Lessee's consideration to Lessor is provided for the Leasehold
Improvements provided for in Section III below, the receipt and sufficiency of
which are hereby affirmed.
III. LEASEHOLD IMPROVEMENTS
Lessee agrees to improve and maintain the parking lot on the Leased
Property during the term of the Lease pursuant to plans approved by Lessor and
Lessee at an estimated cost of $40,000. The improvements maintenance shall
be as follows: maintain paving of parking lot, reconstructing driveway at
Northwest Highway, tie together the parking lot to the north, install parking lot
lighting, maintain any landscaping along both Main Street and Northwest
Highway, and pavement striping according to plan. These improvements are
generally depicted in Exhibit °B".
IV. PROPERTY DEDICATIONS
In exchange for the Leasehold Improvements noted above, Lessor agrees
to dedicate certain perpetual property interests to the City as generally shown in
Exhibit "C". Lessee may assign these interests at its sole discretion.
V. PUBLIC CONVENIENCE
During the term of the Lease the Leased Property shall be open and
available for public parking with the following exceptions:
No commercial vehicles are allowed to park on the Leased
Property.
2. 50% or 16 of the 32 proposed spaces on the Leased Property may
be marked by Lessor, for Lessor's sole use.
VI. MAINTENANCE OF LEASED PROPERTY
Lessee agrees to . maintain the Leased Property during the term of the
Lease. Maintenance shall include reasonable repairs to the pavement surface,
landscaping, and striping of the Leased Property. Lessor and Lessee agree to
use their best efforts to remove abandoned vehicles from the Leased Property.
VII. TERMINATION
Lessor may not terminate the Lease within seven years of execution.
Either party may terminate the Lease upon expiration of the Lease term.
Termination of the Lease shall release Lessor and Lessee from the terms and
agreements contained in the Lease.
Vi ll. LOCATION
This lease is performable in Grapevine, Tarrant County, Texas and is
subject to all applicable Texas law.

THAT I, KC KINGDOM PERSPECTIVE:. LLC, for and in consideration of the sum of one
Dollar ($1.00) cash to us in hand paid by the City of Grapevine, Texas, a municipal
corporation of the County of Tarrant, State of Texas, the receipt of which is hereby
acknowledged, and other good and valuable consideration including the benefits that
will accrue to our property, do hereby GIVE, GRANT, and EXTEND to the said City of
Grapevine, Texas, its successors and assigns, the right to construct, reconstruct and
perpetually maintain water line easement upon, under and across land described as
hollows:

The easement described on the attached Exhibit W is a part of a certain tract of land
recorded by plat as shown in Instrument #D211=5196, Official Public Records of
Tarrant County, State of Texas. Said easement across this property, as herein
designated and described, being a permanent pedestrian access, drainage, utility and
roadway easement for the construction, reconstruction and perpetual maintenance of
the said water line (fire hydrant).
The City of Grapevine, Texas shall have the right and privileges to remove and dispose
of to an offslte location, any trees, brush, debris, excess excavated material, and other
material in the said easement, that would interfere with access to the construction site
and that would interfere with construction, reconstruction and perpetual maintenance of
the said water line (fire hydrant).
TO HAVE AND TO HOLD, all singular, the privileges aforesaid to it, the said City of
Grapevine, Texas, its successors and assigns forever, together with the right and
privilege, at any and all times to enter said premises or any part thereof, for the purpose
of constructing, reconstructing, and perpetually maintaining said water line together with
necessary appurtenances Inside said permanent easement and for making connections
therewith; all upon the condition that the City of Grapevine, Texas, will at all times, after
entering upon said premises and/or doing any work in connection With the construction,
reconstruction, or repair of said water line, restore said premises to a like condition in
which same were found before such entry and/or work was undertaken, including repair
of all fences that might be disturbed or damaged in entering and/or performing said
work, and further upon the condition that in the use of the aforesaid rights and
privileges herein granted, the City of Grapevine, Texas, will not create a nuisance or do
any act that will be detrimental to said premises and that said tract will not be used by
said City of Grapevine, Texas, for any other purpose under this_ grant, except herein
provided.

APPLICANT: Gena Cannon – All Tex Permits, LLC
PROPERTY LOCATION AND SIZE:
The subject property is located at 110 North Main
Street and platted as Block 1, Lot 5, North Main
Shopping Center Addition Phase 3. The site contains
0.65 acre and has approximately 149 feet of frontage
on North Main Street.
REQUESTED CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to amend the previously approved site
plan CU96-28 (Ord. 1996-87) for an expansion to the existing building on Lot 5, and a
waiver to Section 47.E.2. Site Plan Review in accordance with Section 47.F. Procedure for
Processing Site Plans. This request is specifically to allow the possession, storage, retail
sales of on- and off- premise consumption of alcoholic beverages (beer and wine only) and
a planned development overlay to allow deviation from parking requirements in conjunction
with an existing restaurant (Sauce’d).
The subject site was developed prior to 1987 as a single-story, multi-tenant building. The
applicant is requesting to sell and store beer and wine on-site, specifically for the existing
restaurant's customers. The multi-tenant building has one parking lot with a total of 83
parking spaces, which are shared among tenants occupying Lots 1-5. Lot 5 has a total of
40 parking spaces, while the existing three tenants require 50, leaving a deficit of 10 spots.
To help address the issue, the applicant has requested a planned development overlay and

has agreed to lease five spaces from the adjacent parking lot to the south to alleviate the
future deficit.
PRESENT ZONING AND USE:
The property is currently zoned “HC”, Highway Commercial District and is an existing multi-
tenant building.
HISTORY OF TRACT AND SURROUNDING AREA:
The subject site was zoned “C-2”, Community Business District prior to the 1984 City-wide
Rezoning at which time the subject site was rezoned to “HC”, Highway Commercial District.
• On October 15, 1996, City Council approved conditional use request, CU96-28 (Ord.
1996-87) for an expansion to the existing building on Lot 5, and a waiver to Section
47.E.2. in accordance with Section 47.F.
• On October 21, 1997, City Council approved an extension for the previously approved
conditional use permit CU96-28 (Ord. 1996-87) for an expansion to the existing
building on lot 5, and a waiver to Section 47.E.2. in accordance with Section 47.F.
SURROUNDING ZONING AND EXISTING LAND USE:
NORTH: “HC”, Highway Commercial District – Multi-tenant building with retail,
restaurants, and a salon
SOUTH: “HC”, Highway Commercial District – Commercial parking lot
EAST: “HC”, Highway Commercial District – Mohler MMA Mixed Martial Arts
WEST: “HC”, Highway Commercial – Bank of the West
AIRPORT IMPACT:
The subject tract is located within “Zone A” zone of minimal effect as defined on the
“Aircraft Sound Exposure: Dallas Fort Worth Regional Airport Environs” map. Few activities
will be affected by aircraft sounds in Zone A except for sound sensitive activities such as
auditoriums, churches, schools, hospitals, and theaters. The applicant’s proposal is an
appropriate use in this noise zone.
MASTER PLAN APPLICATION:
Map 2: Land Use Plan of the Comprehensive Master Plan designates the subject property
as a Commercial (CO) land use. The applicant’s proposal is compliant with the Master
Plan.
