HomeMy WebLinkAboutORD 1990-027 � � � � l� � _/� ORDINANCE NO. 90-27 �/�" AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, ABANDONING AND VACATING A PORTION OF A UTILITY EASEMENT LOCATED ALONG THE NORTH LINE OF LOT 30 , BLOCK 2 , GREENBRIAR ESTATES AS DESCRIBED IN EXHIBITS "A" AND "B" ; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE �""` WHEREAS, a portion of a utility easement located in the Greenbriar Estates Addition in the City of Grapevine, Texas, as described in Exhibits "A" and "B" attached hereto and incorporated herein for all purposes, is not needed for public use and will not be needed in the future for public use; and WHEREAS, abandoning and vacating this portion of said utility easement will relieve the City of Grapevine, Texas from the cost and expense of maintaining said property. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1 . That all the matters stated in the preamble of this ordinance are true and correct and are hereby incorporated into the body of this ordinance as if copied in their entirety. Section 2 . That a portion of the City of Grapevine ' s utility easement dedicated to the City by deed as recorded in Volume 7317 , �s� Page 1255, of the Tarrant County Deed Records, and as described in Exhibits "A" and "B" , attached hereto and made a part hereof, is hereby abandoned and vacated for public use and the same is hereby abandoned and vacated insofar as all public right, title, and interest in and to said described portion of said utility easement is concerned. Section 3. The electric, telephone, gas and cable public utility companies have indicated by letter their consent to the abandonment and vacation of the portion of the easement above-described as reflected in Exhibits "C" , "D" , "E" and "F" , respectively, attached hereto and incorporated herein for all purposes. Section 4 . That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of any section, subsection, word, sentence, or phrase shall be held to ,be invalid, it shall not affect the remaining part of this ordinance. Section 5 . The fact that the present ordinances and regula- tions of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace, and general welfare of the public creates an emergency which requires that this ordinance become effective from and after the date of its passage. � PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXA� on this the 15th day of May, 1990 . FIELD NOTES �,,, BEING part of an existing 20 foot wide Utility Easement situated in the City of Grapevine, Tarrant County, Texas , dedicated to the City of Grapevine by Instri�ment recorded in Volume 7317 , Page 1255, Deed Records, Tarrant C�ounty, Texas; and being part of the C.C. Doss � Survey, Abstract Number 439; and being that portion of said easement contained within Lot 30, Block 2, Greenbriar Estates, an addition to the City of Grapevine, recorded in Cabinet A, Hanger 180, Plat Records, Tarrant County, Texas; and being more particularly described as follows: BEGINNING at a point in the centerline of said 20 foot wide utility easement along the North line of said Lot 30 , said point being South 89�47'33" West a distance of 155.00 feet from the Northeast corner of said Lot 30; THENCE South 00'04'10" West a distance of 136.15 feet to a point in the South line of said Lot 30, and the North line of Bentley Court, to the end of the centerline of said 20 foot wide utility easement, and containing 0 .06 acres of land, more or less.
