HomeMy WebLinkAboutORD 1990-033 f . � • ORDINANCE NO. 90-33 � AN ORDINANCE OF THE CITY OF GRAPEVINE, TEXAS, ANNEXING ADJACENT AND CONTIGUOUS TERRITORY TO THE CITY OF GRAPEVINE, TEXAS; FINDING THAT ALL NECESSARY AND REQUIRED LEGAL CONDITIONS HAVE BEEN SATISFIED; PROVIDING THAT SUCH AREAS SHALL BECOME A PART OF THE CITY AND THAT THE OWNERS AND INHABITANTS THEREOF SHALL BE ENTITLED TO THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS AND BE BOUND BY THE ACTS AND ORDINANCES NOW IN �"` EFFECT AND TO BE HEREAFTER ADOPTED; PROVIDING A SEVERABILITY CLAUSE; AND FURTHER PROVIDING FOR AMENDING AND CORRECTING THE OFFICIAL BOUNDARIES OF THE CITY AS HERETOFORE ADOPTED AND PROVIDING FOR THE ORDINANCE TO GO INTO EFFECT UPON PASSAGE OF THE ORDINANCE ON SECOND AND FINAL READING WHEREAS, the City, pursuant to the Municipal Annexation Act, Chapter 43, Local Government Code, has heretofore provided proper notice and conducted public hearings relating to annexation proceedings on the tract described in Exhibit "A" ; and WHEREAS, in accordance with the Municipal Annexation Act, a service plan was prepared by the appropriate department of the City, which plan was made available for inspection and explained to the inhabitants of the area to be annexed (of which there are none) at the public hearings conducted as hereinafter described; and WHEREAS, all required statutory notices pursuant to the Act � have been accomplished; and WHEREAS, public hearings were conducted by the Grapevine City Council on May 1 and May 15, 1990 , which public hearings were conducted after notices had been published in a newspaper of general circulation in the City and in the area proposed to be annexed not more that twenty (20) days nor less than ten (10) days prior to each hearing; and WHEREAS, the property to be annexed is contiguous and adjacent to the City limits of the City of Grapevine and not within the boundaries or extraterritorial jurisdiction of another City. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1 . That all of the above premises are found to be true and correct and are incorporated into the body of this ordinance as if copied herein in their entirety. Section 2 . The service plan submitted in accordance with the Municipal Annexation Act is hereby approved as part of this � ordinance, made a part hereof and attached hereto as Exhibit "B" . Section 3 . That the property described in Exhibit "A" , which exhibit is attached hereto and incorporated herein for all purposes, be and is hereby annexed and brought within the corporate limits of the City of Grapevine, Tarrant County, Texas, and same is hereby made an integral part hereof. Section 4 . That the owners and inhabitants of the area herein annexed be entitled to all of the rights and privileges of other citizens and property owners of said City and are hereby bound by all acts, ordinances, and all other legal action now in full force and effect and all those which may be hereafter adopted. � 's � � _ ;� .. . . ,..� � • Section 5. If any section, subsection, sentence, phrase, or word herein be found to be illegal, invalid, unconstitutional or if any portion of said property is incapable of being annexed by the City of Grapevine, Texas for any reason whatsoever, the adjudication shall not affect any other section, sentence, phrase, word, paragraph, or provision of this ordinance or the application of any other section, sentence, phrase, word, paragraph, or provision to any other person, situation, or circumstances, nor shall such adjudication affect any other section, sentence, phrase, �, word, paragraph, or provision of the Grapevine City Code. The City Council declares that it would have adopted the valid portions and applications of this ordinance and would have annexed the valid property without the invalid part, and to this end the provisions `�pi° of this ordinance are declared to be severable. Section 6 . That the official map and boundaries of the City of Grapevine, Texas, heretofore adopted and amended by and are hereby amended so as to include the aforementioned territory as part of the City of Grapevine. Section 7 . That this ordinance shall take effect immediately upon second and final reading. L�YERS P.�TION SERVICE PLAN � �� C�ERAL: The proposed annexation would incorporate 26.8183 acres of land west of the O'Lell ar.d a portion of Woodland Hills Subdivisions; west of Druid Hills; "'�" south of the Stor.ewr�od Addition; and north of Estill property into the City of Grapevine. POLICE P�7�C°�IOD1: The subject tract, within Police District II, is gatrolled twerity-four (24) h�urs a day, seven (7) days a week with one (1) officer per shift assigned to the district; and because the tract is surrounded by existing City of Grapevir.e incorporated land, r_o additional patrols will became necessarv. FIRE PRC7rEC'TIGI�?: Fi e protection and emergency medical sezvice will be provided by the Southwest Sub Fire Station, located at 2627 Brianaood. The Fire Departr*�nt presently sezves all adjacent property. Because of the City's participation in a fire protection agreement with Tarrant County, this unin.corporated area is already receiving fire protection fram the City of Grapevine. � S��JER SYSTEI`?: � Sar.itary sewer service to the project site is available through a 10" line, which runs through the subdivision and continues north to the Trinity River Authority intercepter. The 10" line has been sized for the total drainage basin, including the subject unincorporated area. � STRE'�,T MAINTE�vAi�?CE: Roadway maintenance will be provided by the City after the interior streets are constructed to city standards and are accept�d by the City of Grapevine. Interior streets will connect to Barberry Road and Parr Road. The prir:cipal means of access to the subdivision will be fram two arteri.als, Pool Road and Fiall-Johnson Road and one collector, Parr Road. Parr RQad has experienced increased traffic loading due to the development of the properties in this area. Due to this increase traffic, there have been some ccrrrpl.aints of congestion on Parr road at Hall Johnson Road. This intersection may require same upgrading to facilitate the increased traffic. loading. ��TF.f2 SERVICE: � The 1985 water master plan calls for a 1?." parallel line on Parr Road. The current 6" line is reaching its capacity to pravide watPr to this area.
